JUSTICE RAJIVE BHALLA<\/p>\n<p>Present:     Mr. Yogesh Goel, Advocate<br \/>\n             for the petitioner.\n<\/p>\n<p>             Mr. Gaurav Garg Dhuriwala, AAG Punjab,<br \/>\n             for respondent no. 1.\n<\/p>\n<p>RAJIVE BHALLA, J.(Oral)<\/p>\n<p>             Prayer in this petition filed under Section 482 of the Code<\/p>\n<p>of Criminal Procedure is for setting aside the order dated 4.02.2004<\/p>\n<p>passed by the Additional Sessions Judge, Ludhiana, whereby the<\/p>\n<p>petitioner has been summoned to face trial as an additional accused.<\/p>\n<p>             Counsel for the petitioner submits that the learned trial<\/p>\n<p>court has passed a non-speaking order and even otherwise the<\/p>\n<p>impugned order does not meet the parameters of an order required to<\/p>\n<p>be passed under Section 319 of the Code of Criminal Procedure . It is<\/p>\n<p>submitted that apart from setting out the facts,     the impugned order,<\/p>\n<p>is devoid of any reason, much less cogent reasons.<\/p>\n<p>             Counsel for the State of Punjab submits that the learned<\/p>\n<p>trial court has referred to the medical record, the injuries on the<\/p>\n<p>person of the injured-complainant and as a prima facie case is made<\/p>\n<p>out against the petitioner, therefore, the          present petition, be<\/p>\n<p>dismissed.\n<\/p>\n<p> Criminal Misc. No. M-42107 of 2004 &amp;            [ 2]<\/p>\n<p>              I have heard learned counsel for the parties and perused<\/p>\n<p>the impugned order.           The impugned order is devoid of            the<\/p>\n<p>fundamental attributes of a judicial order. Apart from setting out the<\/p>\n<p>facts in a perfunctionary manner, no reasons much less cogent reasons<\/p>\n<p>have been assigned       for summoning the petitioner. It would also be<\/p>\n<p>necessary to mention here that PW-1 has not been cross-examined<\/p>\n<p>and even his examination in chief is also incomplete. The power under<\/p>\n<p>Section 319 of the Code of Criminal Procedure is to be exercised<\/p>\n<p>judiciously    and only       where it appears to the Court , from the<\/p>\n<p>evidence on record        that the person sought to be summoned has<\/p>\n<p>committed an offence, for which he can           be tried with the already<\/p>\n<p>arraigned     accused.   It   appears   that   Additional   Sessions   Judge,<\/p>\n<p>Ludhiana, disregarded         the fundamental principles that govern the<\/p>\n<p>exercise of jurisdiction under Section 319 of the code of Criminal<\/p>\n<p>Procedure and therefore, committed an error of jurisdiction.<\/p>\n<p>              In view of what has been stated above, the present<\/p>\n<p>petition is allowed, the Order dated 4.02.2004 is set aside and the<\/p>\n<p>matter is remitted to the Additional Sessions Judge, Ludhiana, to<\/p>\n<p>decide the application, filed under Section 319 of the Code of Criminal<\/p>\n<p>Procedure afresh after        the cross-examination of PW-1 concludes or<\/p>\n<p>after the prosecution leads       such further evidence as the trial court<\/p>\n<p>deems appropriate.\n<\/p>\n<p>              The learned Additional Sessions Judge, Ludhiana, shall<\/p>\n<p>decide the application within a fortnight of the receipt of a copy of this<\/p>\n<p>order.\n<\/p>\n<\/p>\n<p>                                                       [RAJIVE BHALLA]<br \/>\n                                                          JUDGE<br \/>\n5th March, 2009<br \/>\nSKaushik\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Punjab-Haryana High Court Gurnam Singh vs State Of Punjab And Another on 5 March, 2009 Criminal Misc.
