Justice R.BASANT\n\n Dated :14\/12\/2006\n\n O R D E R\n                                         R.BASANT, J.\n\n                             ------------------------------------\n\n                             Crl.M.C.NO.2123 OF 2006\n\n                             ------------------------------------\n\n                Dated this the 14th day of December, 2006.\n\n\n                                                ORDER\n<\/pre>\n<p>      The   petitioners   are   accused   in   a   prosecution   launched<\/p>\n<p>against         them          by         the         respondent\/complaint.              The<\/p>\n<p>respondent\/complainant   had   business   transactions   with   the   1st<\/p>\n<p>petitioner\/accused company.  The 1st petitioner\/accused company<\/p>\n<p>has   initiated   steps   for   prosecution   of   the   respondent   under<\/p>\n<p>Section   138   of   the   N.I   Act   before   the   court   at   Chennai.<\/p>\n<p>Thereafter   the   1st  respondent   has   filed   the   present   complaint<\/p>\n<p>making   allegations   against   the   petitioners   herein,   inter   alia,<\/p>\n<p>under Section 406, 420 &amp; 471 I.P.C.  The crux of the allegations<\/p>\n<p>raised by the respondent\/complainant in the complaint is that the<\/p>\n<p>1st  petitioner   company   and   its   officials   had   induced   the<\/p>\n<p>petitioners to hand over a blank signed cheque as security when<\/p>\n<p>they entered into the business transaction.   It is the case of the<\/p>\n<p>respondent\/complainant   that   such   cheque   was   given   and<\/p>\n<p>received on the specific  understanding and in good faith that it<\/p>\n<p>will not be misused and it shall be kept only as security.  Fanciful<\/p>\n<p>entries have been made in such cheque and the same has been<\/p>\n<p>misutilised   to   vex   and   harass   the   respondent\/complainant   by<\/p>\n<p>initiating prosecution before the court at Chennai.<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.NO.2123 OF 2006                2<\/span><\/p>\n<p>      2.      The learned Magistrate after following the procedure<\/p>\n<p>prescribed   under   the   Code   of   Criminal   Procedure,   has   taken<\/p>\n<p>cognizance   of   the   offences   alleged   against   the   petitioners   and<\/p>\n<p>the case is now pending before the Court at Kannur, where the<\/p>\n<p>transaction was allegedly entered into  and blank signed cheque<\/p>\n<p>was   handed   over.     One   of   the   accused\/petitioners   has   entered<\/p>\n<p>appearance before the learned Magistrate.   The others have not<\/p>\n<p>entered   appearance   so   far.     The   petitioners   have   now   come<\/p>\n<p>before  this  Court  with a prayer  that  the   powers under Section<\/p>\n<p>482   Cr.P.C   may   be   invoked   in   their   favour   to   quash   the<\/p>\n<p>complaint.\n<\/p>\n<\/p>\n<p>      3.      The   learned   counsel   for   the   petitioners   submits   that<\/p>\n<p>the   complaint   is   liable   to   be   quashed   by   invoking   the   powers<\/p>\n<p>under Section 482 Cr.P.C for the first reason that the complaint<\/p>\n<p>is totally  false  and for   the  second reason   that the  complaint is<\/p>\n<p>lodged   with   the   transparent   intention   of   vexing   and   harassing<\/p>\n<p>the   petitioners.     For   these   reasons,   it   is   prayed   that   the<\/p>\n<p>complaint may be quashed.\n<\/p>\n<\/p>\n<p>      4.      I shall carefully  avoid detailed reference  to facts and<\/p>\n<p>any expression of opinion on the acceptability of the allegations<\/p>\n<p>in either of the two cases.  Suffice it to say that I do not find any<\/p>\n<p>sufficient,   satisfactory   or   compelling   reasons   which   should<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.NO.2123 OF 2006                     3<\/span><\/p>\n<p>persuade   this   Court   to   invoke   the   powers   under   Section   482<\/p>\n<p>Cr.P.C.         It   is   by   now   trite   that   the   disputed   questions   of   fact<\/p>\n<p>cannot   be   resolved   in   proceedings   under   Section   482   Cr.P.C.<\/p>\n<p>The   rival   contestants   have   raised   conflicting   claims   before<\/p>\n<p>different  fora  about the   circumstances under  which  the  cheque<\/p>\n<p>travelled   from   the   possession   of   the   complainant   to   the<\/p>\n<p>possession   of   the   petitioners.     Accepting   the   contentions   of<\/p>\n<p>either   at   this   stage,   relief   cannot   be   granted   to   either   of   the<\/p>\n<p>contestants.           The   petitioners&#8217;   prayer   for   quashing   the<\/p>\n<p>proceedings on the ground that the allegations are false, cannot<\/p>\n<p>in these circumstances succeed.\n<\/p>\n<\/p>\n<p>       5.     It   is   then   contended   that   the   allegations   are   raised<\/p>\n<p>belatedly   and   as   a   counter   blast   against   the   138   prosecution<\/p>\n<p>initiated   by   the   petitioners   before   the   court   at   Chennai.     The<\/p>\n<p>mere   fact   that   there   was   delay   in   filing   the   complaint   cannot<\/p>\n<p>certainly justify a conclusion that the allegations are false or are<\/p>\n<p>raised with objectionable motives and vexatious intent.  It would<\/p>\n<p>be premature and presumptuous on the part of this Court at this<\/p>\n<p>stage   to   come   to   any   specific   or   authentic   conclusion   on   that<\/p>\n<p>aspect.       Suffice   it   to   say   that   I   am   satisfied   that   the   powers<\/p>\n<p>under Section 482 Cr.P.C do not deserve to be invoked.<\/p>\n<p><span class=\"hidden_text\">Crl.M.C.NO.2123 OF 2006                   4<\/span><\/p>\n<p>        6.    A person against whom criminal adjudicatory process<\/p>\n<p>is   initiated   without   justifiable   reason   can   certainly   request   for<\/p>\n<p>premature termination  of proceedings initiated against him.   In<\/p>\n<p>that   view   of   the   matter,   the   petitioners   can   certainly   claim<\/p>\n<p>discharge   under   Section   245(1)   or   245(2)   Cr.P.C.     The   powers<\/p>\n<p>under Section 482 Cr.P.C are to be invoked sparingly and in an<\/p>\n<p>exceptional   case   in   aid   of   justice   &#8211;   to   prevent   the   failure   and<\/p>\n<p>miscarriage   of   justice.     In   the   facts   and   circumstances   of   this<\/p>\n<p>case, I am not persuaded to agree that such powers  deserve to<\/p>\n<p>be   invoked   in   favour   of   the   petitioners   at   this   stage   of   the<\/p>\n<p>proceedings.\n<\/p>\n<\/p>\n<p>        7.    In   the   result,   this   Crl.M.C   is,   dismissed.
