JUSTICE HARSHA DEVANI)<\/p>\n<p>1.\t\tBy<br \/>\nthis petition, the petitioner seeks a direction against the<br \/>\nrespondents not to demand and\/or recover arrears as mentioned in the<br \/>\nbills for assessment years 2000-01 up to 2008-09 and other<br \/>\nconsequential reliefs.\n<\/p>\n<p>2.\t\tOn<br \/>\n23rd July, 2010, this Court had passed an order in the<br \/>\nfollowing terms:-\n<\/p>\n<p>&#8220;The<br \/>\nmain grievance voiced by learned Advocate for the petitioner is that<br \/>\nearlier the petitioner had approached this Court by way of a writ<br \/>\npetition being Special Civil Application No.44 of 2002 wherein a<br \/>\nstatement had been made on behalf of respondent Corporation that<br \/>\ndemand against the petitioner was being made on the basis of the rate<br \/>\n of assessment at Rs.3,600\/- gross rateable value.  However, for the<br \/>\nsame period arrears are sought to be recovered from the petitioner at<br \/>\nRs.4,800\/- gross rateable value.\n<\/p>\n<p>Notice<br \/>\nreturnable on 20.08.2010.&#8221;\n<\/p>\n<p>3.\t\tToday,<br \/>\nMr. Mrugen Purohit, learned advocate for the respondents states<br \/>\nbefore the Court that the petitioner may file a representation before<br \/>\nthe respondents in relation to the grievance voiced in the present<br \/>\npetition and the same shall be considered in accordance with law<br \/>\nafter giving the petitioner an opportunity of hearing.\n<\/p>\n<p>4.\t\tIn<br \/>\nthe light of the aforesaid statement, Mr. Dilip Kanojiya, learned<br \/>\nadvocate for the petitioner, on instructions, seeks permission to<br \/>\nwithdraw the petition with a view to make a representation before the<br \/>\nrespondents. He, has, however requested that some time frame be<br \/>\nspecified within which the representation may be decided.\n<\/p>\n<p>5.\t\tThe<br \/>\nrequest appears to be reasonable. In the circumstances, it is<br \/>\ndirected that the petitioner shall make a representation to the<br \/>\nrespondent No.1 within a period of two weeks from today.  Upon<br \/>\nreceipt of such representation, the respondent No.1 shall decide the<br \/>\nsame within a period of one month thereafter, after giving the<br \/>\npetitioner a reasonable opportunity of hearing.  The petition is<br \/>\naccordingly disposed of as withdrawn in the aforesaid terms.
