The\u00a0CPIO\u00a0vide\u00a0his\u00a0order\u00a0dated\u00a010.9.2009\u00a0denied\u00a0disclosure\u00a0<br \/>\nquoting \u00a0 instructions \u00a0 of \u00a0 the \u00a0 Ministry \u00a0 of \u00a0 Personnel, \u00a0 Public\u00a0<br \/>\nGrievances \u00a0 and \u00a0 Pension, \u00a0 DoPT \u00a0 letter \u00a0 No. \u00a0 10\/2\/2008\u00adIR \u00a0 dated\u00a0<br \/>\n1.6.2009.\n<\/p>\n<p>3.     Not \u00a0 being \u00a0 \u00a0 satisfied, \u00a0 the \u00a0 appellant \u00a0 preferred \u00a0 appeal\u00a0<br \/>\nbefore\u00a0the\u00a0FAA.\u00a0 \u00a0Adjudicating\u00a0in\u00a0the\u00a0matter,\u00a0FAA\u00a0disposed\u00a0of\u00a0<br \/>\nthe \u00a0 matter \u00a0 by \u00a0 stating \u00a0 that \u00a0 the \u00a0 information \u00a0 sought \u00a0 by \u00a0 the\u00a0<br \/>\nappellant \u00a0 is \u00a0 not \u00a0 available \u00a0 with \u00a0 the \u00a0 CPIO \u00a0 and \u00a0 creation \u00a0 of\u00a0<br \/>\ninformation \u00a0 is \u00a0 not \u00a0 covered \u00a0 under \u00a0 the \u00a0 RTI \u00a0 Act. \u00a0 \u00a0 \u00a0 He \u00a0 also\u00a0<br \/>\nenclosed\u00a0a\u00a0copy\u00a0of\u00a0the\u00a0DoPT&#8217;s\u00a0letter\u00a0indicated\u00a0above\u00a0for\u00a0the\u00a0<br \/>\nperusal\u00a0of\u00a0the\u00a0appellant.\u00a0\n<\/p>\n<p>4.     Being \u00a0 aggrieved \u00a0 and \u00a0 not \u00a0 being \u00a0 satisfied, \u00a0 the \u00a0 appellant\u00a0<br \/>\nmoved\u00a0the\u00a0Commission\u00a0in\u00a0second\u00a0appeal.\u00a0\n<\/p>\n<p>5.     The\u00a0matter\u00a0was\u00a0heard\u00a0today\u00a0.\u00a0\u00a0Appellant\u00a0was\u00a0heard\u00a0through\u00a0<br \/>\nvideo\u00a0conferencing.\u00a0Respondents\u00a0were\u00a0not\u00a0present.\n<\/p>\n<p>6.     Respondents \u00a0 stated \u00a0 that \u00a0 information \u00a0 pertaining \u00a0 to\u00a0<br \/>\naddresses \u00a0 was \u00a0 maintained \u00a0 by \u00a0 the \u00a0 department \u00a0 through \u00a0 \u00a0 3 \u00a0 lists\u00a0<br \/>\n(1) \u00a0 Town \u00a0 Delivery \u00a0 List \u00a0 (TD \u00a0 List) \u00a0 which \u00a0 is \u00a0 \u00a0 the \u00a0 centralized\u00a0<br \/>\nlist\u00a0for\u00a0the\u00a0entire\u00a0Delhi\u00a0Circle;\u00a0(2)\u00a0Postman\u00a0Beat\u00a0List\u00a0which\u00a0<br \/>\n indicates\u00a0the\u00a0route\u00a0to\u00a0be\u00a0followed\u00a0by\u00a0Postman\u00a0for\u00a0delivery\u00a0in\u00a0<br \/>\nhis\u00a0jurisdiction\u00a0&amp;\u00a0(3)\u00a0Letter\u00a0Box\u00a0clearance\u00a0list\u00a0which\u00a0guides\u00a0<br \/>\nthe \u00a0 official \u00a0 regarding \u00a0 location \u00a0 of \u00a0 the \u00a0 letter \u00a0 boxes \u00a0 to \u00a0 be\u00a0<br \/>\ncleared\u00a0and\u00a0letters\u00a0brought\u00a0to\u00a0the\u00a0Post\u00a0Office.\u00a0 \u00a0 \u00a0He\u00a0further\u00a0<br \/>\nstated \u00a0 \u00a0that\u00a0important \u00a0locations\u00a0like\u00a0hospitals,\u00a0Schools\u00a0and\u00a0<br \/>\nbig\u00a0\u00a0roads\u00a0are\u00a0recorded\u00a0\u00a0in\u00a0these\u00a0lists\u00a0but\u00a0there\u00a0is\u00a0no\u00a0record\u00a0<br \/>\nof\u00a0individual\u00a0buildings\u00a0maintained\u00a0by\u00a0them.\u00a0\n<\/p>\n<p>7.    The \u00a0 appellant \u00a0 stated \u00a0 that \u00a0 this \u00a0 delayed \u00a0 information \u00a0 as\u00a0<br \/>\nprovided\u00a0by\u00a0the\u00a0respondent\u00a0at\u00a0the\u00a0hearing\u00a0was\u00a0not\u00a0given\u00a0to\u00a0him\u00a0<br \/>\nby\u00a0the\u00a0CPIO\u00a0and\u00a0objected\u00a0to\u00a0denial\u00a0of\u00a0information\u00a0on\u00a0the\u00a0basis\u00a0<br \/>\nof\u00a0\u00a0letter\u00a0of\u00a0DoPT.\u00a0\n<\/p>\n<p>8.    The\u00a0appellant \u00a0also\u00a0drew\u00a0the\u00a0attention \u00a0of\u00a0the\u00a0Commission\u00a0<br \/>\nand \u00a0 respondents \u00a0 to \u00a0 page \u00a0 12 \u00a0 of \u00a0 his \u00a0 second \u00a0 appeal \u00a0 which \u00a0 had\u00a0<br \/>\nphoto\u00a0copy\u00a0of\u00a0non\u00a0delivered\u00a0envelope\u00a0with\u00a0remarks\u00a0of\u00a0the\u00a0\u00a0Post\u00a0<br \/>\nOffice\u00a0&#8221;\u00a0no\u00a0such\u00a0premises&#8221;.\u00a0\n<\/p>\n<p>9.    Respondents\u00a0stated\u00a0that\u00a0this\u00a0information\u00a0was\u00a0not\u00a0earlier\u00a0<br \/>\navailable\u00a0with\u00a0him\u00a0since\u00a0it\u00a0was\u00a0not\u00a0provided\u00a0by\u00a0the\u00a0appellant\u00a0<br \/>\nin\u00a0his\u00a0RTI\u00a0application\u00a0nor\u00a0was\u00a0respondent\u00a0provided\u00a0a\u00a0copy\u00a0of\u00a0<br \/>\nthe\u00a0second \u00a0appeal \u00a0preferred\u00a0before \u00a0the\u00a0Commission. \u00a0He\u00a0stated\u00a0<br \/>\nthat \u00a0 based \u00a0 \u00a0 on \u00a0 this \u00a0 information, \u00a0 additional \u00a0 inputs \u00a0 could \u00a0 be\u00a0<br \/>\nprovided\u00a0to\u00a0the\u00a0appellant.\u00a0\n<\/p>\n<p>\u00a0<\/p>\n<p>                                  Decision\u00a0<\/p>\n<p>10. Commission \u00a0 directs \u00a0 respondent \u00a0 to \u00a0 provide \u00a0 an \u00a0 opportunity\u00a0<br \/>\nto\u00a0the\u00a0appellant\u00a0to\u00a0meet\u00a0with\u00a0SSPOs\u00a0of\u00a0Shahadara\u00a0Post\u00a0Office\u00a0<br \/>\nso \u00a0 that \u00a0 \u00a0 he \u00a0 can \u00a0 \u00a0 satisfy \u00a0 himself \u00a0 regarding \u00a0 the \u00a0 information\u00a0<br \/>\nbeing\u00a0sought.\u00a0\u00a0Appellant\u00a0stated\u00a0that\u00a0\u00a0he\u00a0would\u00a0be\u00a0in\u00a0Delhi\u00a0on\u00a0<br \/>\n21st. \u00a0 August, \u00a0 2010. \u00a0 Appellant \u00a0 and \u00a0 respondent \u00a0 will \u00a0 coordinate\u00a0<br \/>\neach\u00a0other\u00a0and\u00a0fix\u00a0mutually\u00a0convenient\u00a0time\u00a0within\u00a0one\u00a0week\u00a0of\u00a0<br \/>\nthe\u00a0receipt\u00a0of\u00a0this\u00a0order.\u00a0\n<\/p>\n<p>11.
