JUSTICE R.M.DOSHIT\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 22\/03\/2007 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\tThe<br \/>\npetitioners ?  the Chief Officer and the Prsident of the Viramgam<br \/>\nMunicipality (hereinafter referred to as, ?Sthe Municipality??)<br \/>\nhave challenged the order dated 17th August, 2004 made by<br \/>\nthe Controlling Authority under the Payment of Gratuity Act, 1972 in<br \/>\nApplication No.48\/2004. It is not in dispute that the respondent was<br \/>\nthe employee of the Municipality and that on her retirement from<br \/>\nservice, she was entitled to gratuity. The Municipality did pay the<br \/>\ngratuity to the respondent in accordance with its rules regarding<br \/>\ngratuity. The respondent, however, approached the Controlling<br \/>\nAuthority under the Act and claimed the difference of amount of<br \/>\ngratuity calculated under the Act. The Application was contested by<br \/>\nthe Municipality. According to the Municipality, the Municipality has<br \/>\nits own rules of gratuity which are approved by the State Government<br \/>\nunder the Gujarat Municipalities Act, 1963. The Municipality,<br \/>\ntherefore, was not liable to pay gratuity under the Act. The said<br \/>\nobjection did not appeal to the Controlling Authority. The<br \/>\nControlling Authority held that the Municipality was liable to pay to<br \/>\nthe respondent gratuity in the sum of Rs.73,558=00 under the Act.<br \/>\nAccordingly, the Municipality was directed to pay the unpaid amount<br \/>\nof gratuity. Therefore, the present petition.\n<\/p>\n<p>\tMr.Dagli<br \/>\nhas submitted that under the rules of the Municipality, the<br \/>\nrespondent was entitled to a gratuity in the sum of Rs.60,109=00 i.e.<br \/>\nRs.13,449=00 less than the amount payable under the Act. He has<br \/>\nsubmitted that the Municipality having its own rules is not liable to<br \/>\npay gratuity under the Act.\n<\/p>\n<p>\tSection<br \/>\n14 of the Act gives an overriding effect to the provisions contained<br \/>\nin the Act over any enactment, rules or contract. In view of the said<br \/>\nprovision, rules framed by the Municipality, though prior to the date<br \/>\nof the Act, shall give way to the provisions contained in the Act.<br \/>\nMr.Dagli, having received instructions from the Chief Officer Shri<br \/>\nGoswami, admits the Municipality has not received exemption from the<br \/>\napplication of the Act granted by the appropriate Government as<br \/>\nenvisaged by Section 5 of the Act. In absence of such exemption<br \/>\ngranted by the appropriate Government, the Act shall apply to the<br \/>\nMunicipality.\n<\/p>\n<p>\tFor<br \/>\nthe aforesaid reasons, the petition is summarily rejected.\n<\/p>\n<p>\tMr.Dagli<br \/>\nhas submitted that there are as many as 33 such applications. The<br \/>\nMunicipality has been directed to pay the difference in amount of<br \/>\ngratuity to the concerned employees. Considering its financial<br \/>\ncondition, the Municipality is not in a position to pay the amount of<br \/>\ndifference in gratuity to each such employee in lump-sum. He has,<br \/>\ntherefore, requested that the Court may permit the payment of such<br \/>\namount in installments.\n<\/p>\n<p>\tI<br \/>\nam of the opinion that if at all the Municipality needs some<br \/>\nindulgence in respect of the payment of the amount as ordered by the<br \/>\nControlling Authority, the Municipality may approach the Controlling<br \/>\nAuthority with a request to make remittance of the amount of gratuity<br \/>\nin installments.
