Justice M.SASIDHARAN NAMBIAR\n\n Dated :02\/12\/2010\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n              Crl.M.C.No.4081 of 2010\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioners are the accused in C.C.No.436\/2010<\/p>\n<p>on the file of Judicial First Class Magistrate&#8217;s<\/p>\n<p>Court,  Kothamangalam, taken   cognizance  for  the<\/p>\n<p>offence under Section 27(1)(b) of Kerala Forest Act<\/p>\n<p>on Annexure-A1 final report submitted by Assistant<\/p>\n<p>Wild  Life  Warden,  Thattekkad  Birds   Sanctuary.<\/p>\n<p>Prosecution case is that petitioners, who were<\/p>\n<p>watchmen of Thattekkad Birds Sanctuary, set fire to<\/p>\n<p>the shed constructed for their residence on the<\/p>\n<p>night of 9.1.2002 and thereby caused a loss of<\/p>\n<p>Rs.2,500\/- and thereby committed the offence. This<\/p>\n<p>petition is filed under Section 482 of Code of<\/p>\n<p>Criminal  Procedure   to  quash   the   proceedings<\/p>\n<p>contending  that  the   alleged  incident  was   on<\/p>\n<p>9.1.2002 and Annexure-A2 forest offence seizure<\/p>\n<p>report (preliminary), as provided under Section 36<\/p>\n<p>of Kerala Forest Act, was submitted before the<\/p>\n<p><span class=\"hidden_text\">CRMC 4081\/10               2<\/span><\/p>\n<p>court on 10.1.2002 and final report was submitted<\/p>\n<p>only on 31.7.2010 and petitioners were not in any<\/p>\n<p>way connected with the destruction of the shed by<\/p>\n<p>setting fire and the case was foisted as they were<\/p>\n<p>the   office    bearers   of  trade   union.  Though<\/p>\n<p>petitioners are entitled to a speedy justice, which<\/p>\n<p>is guaranteed under Article 21 of Constitution of<\/p>\n<p>India,     the  proceedings   has   been  protracted<\/p>\n<p>unnecessarily and in such circumstances, it is to<\/p>\n<p>be quashed.\n<\/p>\n<p>    2. Assistant Wild Life Warden filed a statement<\/p>\n<p>disclosing     that   investigation  revealed   that<\/p>\n<p>petitioners    set   fire  to   the  temporary  shed<\/p>\n<p>deliberately to avoid their stay inside the forest<\/p>\n<p>during night hours and investigation was conducted<\/p>\n<p>in a free and fair manner. It is also stated that<\/p>\n<p>while investigation is almost over first petitioner<\/p>\n<p>submitted Annexure-R2(A) statement dated 5.9.2005<\/p>\n<p>expressing willingness to compound the offence and<\/p>\n<p>second     petitioner   also   filed  Annexure-R2(B)<\/p>\n<p><span class=\"hidden_text\">CRMC 4081\/10             3<\/span><\/p>\n<p>statement dated 10.9.2005 for the same purpose and<\/p>\n<p>considering    their  request,  by   Annexure-R2(C)<\/p>\n<p>proceedings    dated 15.9.2006,  Chief  Wild   Life<\/p>\n<p>Warden, Idukki permitted to compound the offence,<\/p>\n<p>but petitioners did not remit the amount and as<\/p>\n<p>there was an order to compound the offence, further<\/p>\n<p>action was not taken. It is contended that the<\/p>\n<p>complaint    received by  Conservator  of  Forests,<\/p>\n<p>Inspection and Evaluation Wing, Kottayam against<\/p>\n<p>the first petitioner was taken on file and an<\/p>\n<p>enquiry was ordered by the Conservator of Forests<\/p>\n<p>directing Assistant Wild Life warden to conduct an<\/p>\n<p>enquiry     and in  that enquiry,   some  witnesses<\/p>\n<p>disclosed that petitioners were involved in other<\/p>\n<p>offences and then only the files were traced out<\/p>\n<p>and on verification, it was found that petitioners,<\/p>\n<p>though permitted to compound the offence, did not<\/p>\n<p>compound the offence and hence charge was laid.<\/p>\n<p>    3. Learned senior counsel appearing for the<\/p>\n<p>petitioners, relying on the decisions of the Apex<\/p>\n<p><span class=\"hidden_text\">CRMC 4081\/10             4<\/span><\/p>\n<p>Court in <a href=\"\/doc\/1223002\/\">Pankaj Kumar v. State of Maharashtra<\/a><\/p>\n<p>((2008) 16 SCC 117) and Vakil Prasad Singh v. State<\/p>\n<p>of Bihar ((2009) 3 SCC 355), argued that right to<\/p>\n<p>speedy    trial in  criminal  prosecutions  is   an<\/p>\n<p>inalienable right under Article 21 of Constitution<\/p>\n<p>of India and petitioners were denied that right and<\/p>\n<p>on the materials, it is clear that petitioners were<\/p>\n<p>being   prosecuted with  mala  fides  and  in  such<\/p>\n<p>circumstances, to secure justice, proceedings is to<\/p>\n<p>be quashed.\n<\/p>\n<p>    4. Learned Public Prosecutor submitted that<\/p>\n<p>investigation revealed that petitioners set fire to<\/p>\n<p>the temporary shed, where they are expected to stay<\/p>\n<p>during night, as they were not willing to stay<\/p>\n<p>inside the forest during night and for that purpose<\/p>\n<p>the shed was destroyed by setting fire and the<\/p>\n<p>delay in filing the final report was on account of<\/p>\n<p>the willingness expressed by the petitioners under<\/p>\n<p>Annexure-R2(A) and Annexure-R2(B) to compound the<\/p>\n<p>offence and by Annexure-R2(C), their prayer was<\/p>\n<p><span class=\"hidden_text\">CRMC 4081\/10             5<\/span><\/p>\n<p>allowed and they were permitted to compound the<\/p>\n<p>offence and it was found out only later that they<\/p>\n<p>did not remit the amount and in such circumstances,<\/p>\n<p>the case cannot be quashed.\n<\/p>\n<p>    5. Learned Public Prosecutor made available the<\/p>\n<p>case diary. On a perusal of the case diary, it is<\/p>\n<p>absolutely   clear that   there  is  no   material,<\/p>\n<p>whatsoever,   to  point  out  the   guilt  of  the<\/p>\n<p>petitioners. The case diary only shows that on<\/p>\n<p>getting a report that temporary shed was found<\/p>\n<p>destroyed by fire, Assistant Wild Life Warden was<\/p>\n<p>directed to conduct an enquiry to find out who set<\/p>\n<p>fire to the shed. After four months, a report is<\/p>\n<p>seen filed to the effect that enquiry revealed that<\/p>\n<p>petitioners set fire to the shed. It also does not<\/p>\n<p>disclose from what source the said opinion was<\/p>\n<p>gathered or how the said conclusion was arrived at.<\/p>\n<p>It is further seen from the records that thereafter<\/p>\n<p>also no statement was recorded from any witness.<\/p>\n<p>Annexure-A9 report submitted by the Forest Range<\/p>\n<p><span class=\"hidden_text\">CRMC 4081\/10              6<\/span><\/p>\n<p>Officer, Flying Squad Range, Perumbavoor shows that<\/p>\n<p>a vigilance enquiry was conducted and based on the<\/p>\n<p>vigilance enquiry, a detailed investigation was<\/p>\n<p>directed to be undertaken. The case diary shows<\/p>\n<p>that    no   such  enquiry  or   investigation   was<\/p>\n<p>conducted. Based on all these materials available<\/p>\n<p>in the case diary, even if petitioners are to be<\/p>\n<p>tried, they cannot be convicted by any court as<\/p>\n<p>there   is   no  material  against  them.  In  such<\/p>\n<p>circumstances, it is not in the interest of justice<\/p>\n<p>to continue the prosecution, as ultimately, there<\/p>\n<p>is no likelihood of a conviction at all.<\/p>\n<p>     Petition is allowed.
