M. SAHAI)<\/p>\n<p>1.\tThe<br \/>\nshort question that arises for consideration in this Letters Patent<br \/>\nAppeal is, &#8220;whether the Labour Court can award interest in<br \/>\nproceedings under Section 33C(1) of the Industrial Disputes Act, 1947<br \/>\n(for short, &#8216;the ID Act&#8217;) or not?&#8221;\n<\/p>\n<p>2.\tThe<br \/>\nbrief facts of the case are that, the appellant-petitioner was<br \/>\nworking as Traffic Controller in S.T. Depot, at Bagasara.  On<br \/>\n1.8.1997, a settlement was arrived at and an amount of Rs.33,617\/-<br \/>\nwas to be paid to the appellant by the respondent. The appellant<br \/>\nattained the age of superannuation on 31.7.2003.\n<\/p>\n<p>3.\tThe<br \/>\naforesaid amount under the settlement was not paid to the appellant,<br \/>\ntherefore, the appellant filed a recovery application in the year<br \/>\n2007 under Section 33C(1) of the ID Act.  The Labour Court, by its<br \/>\norder dated 5.11.2009 allowed the application and directed the<br \/>\nrespondent to pay the amount of Rs.33,617\/-, but did not direct<br \/>\npayment of any interest due to delay in paying the amount under the<br \/>\nsettlement which was claimed by the appellant at the rate of 18% per<br \/>\nannum.\n<\/p>\n<p>4.\tThe<br \/>\nlearned counsel for the appellant has vehemently urged that the<br \/>\namount fell due was not paid to the appellant in pursuance of the<br \/>\nsettlement on 1.8.1997 and an order was passed by the Labour Court on<br \/>\n5.11.2009. Therefore, the appellant was entitled for interest at the<br \/>\nrate of 18% per annum for the delay in payment of the amount for more<br \/>\nthan 12 years. For appreciating the argument of the learned counsel<br \/>\nfor the appellant, it is necessary to extract Section 33C(1) of the<br \/>\nID Act as below:\n<\/p>\n<p>&#8220;33C.\n<\/p>\n<p>Recovery of money due from an employer.&#8211; (1) Where any money is<br \/>\ndue to a workman from an employer under a settlement or an award or<br \/>\nunder the provisions of Chapter VA or Chapter VB the workman himself<br \/>\nor any other person authorised by him in writing in this behalf, or,<br \/>\nin the case of the death of the workman, his assignee or heirs may,<br \/>\nwithout prejudice to any other mode of recovery, make an application<br \/>\nto the appropriate Government for the recovery of the money due to<br \/>\nhim, and if the appropriate Government is satisfied that any money is<br \/>\nso due, it shall issue certificate for that amount to the Collector<br \/>\nwho shall proceed to recover the same in the same manner as an arrear<br \/>\nof land revenue:\n<\/p>\n<p>\tProvided<br \/>\nthat every such application shall be made within one year from the<br \/>\ndate on which the money became due to the workman from the employer:\n<\/p>\n<p>\tProvided<br \/>\nfurther that any such application may be entertained after the expiry<br \/>\nof the said period of one year, if the appropriate Government is<br \/>\nsatisfied that the applicant had sufficient cause for not making the<br \/>\napplication within the said period.&#8221;\n<\/p>\n<p>5.\tThe<br \/>\naforesaid provision authorises the workman to recover the amount from<br \/>\nthe employer which is due to him under a settlement or an award,<br \/>\nprovided the application is made within one year from the date on<br \/>\nwhich the money became due to the workman from the employer. Before<br \/>\nthe Labour Court it has been contended by the respondents in the<br \/>\nwritten statement  that they came to know about the amount due only<br \/>\non 8.1.2007. The amount payable to the appellant was Rs.45,073\/- and<br \/>\nout of which, an amount of Rs.23,507\/- was paid to the applicant by<br \/>\nthe respondent. Therefore, only an amount of Rs. 21,530\/- was to be<br \/>\npaid by the respondent to the appellant. It was also mentioned that<br \/>\nthere was shortage of funds and the moment the fund is received, the<br \/>\namount shall be paid to the appellant. However, subsequently, the<br \/>\nrespondent had informed the appellant that the total amount to be<br \/>\npaid was Rs.58,470\/- and the admitted amount which was liable to be<br \/>\npaid to the appellant at the time of passing of the order by the<br \/>\nLabour Court was Rs.29,517\/- as per the details mentioned in the<br \/>\norder of the Labour Court.  Therefore, the Labour Court directed the<br \/>\nrespondent to pay an amount of Rs.29,517\/- within 30 days.\n<\/p>\n<p>6.\tWe<br \/>\nhave examined the provision of Section 33C(1) of the ID Act.  We do<br \/>\nnot find that the Labour Court, under Section 33C(1) has been<br \/>\nconferred the power to award interest on the amount due. In absence<br \/>\nof any statutory provision and the Labour Court had no jurisdiction<br \/>\nto award any interest to the appellant. Whenever a Legislature<br \/>\nintended that the amount due to a workman be paid along with interest<br \/>\nto avoid delay, in such a situation, the Legislature always takes<br \/>\ncare to incorporate such provision with regard to payment of interest<br \/>\nin the Statute itself.  But, in Section 33C(1) of the ID Act, there<br \/>\nis no provision for payment of any interest. Therefore, we are of the<br \/>\nconsidered opinion that the view taken by the Labour Court and the<br \/>\nlearned Single Judge  is perfectly in accordance with law and<br \/>\ninterest could not be awarded even if the amount is paid after<br \/>\nunreasonable delay<\/p>\n<p>7.<br \/>\n\tHowever, we are of the opinion  that if the amount of Rs.29,517\/-<br \/>\nhas not yet been paid to the appellant by the respondent, it shall be<br \/>\npaid to the appellant within a period of two months from today.\n<\/p>\n<p>8.\tSubject<br \/>\nto the aforesaid observations and directions, this Letters Patent<br \/>\nAppeal is dismissed.
