JADHAV &amp; ORS.\n\n\tVs.\n\nRESPONDENT:\nUNION OF INDIA &amp; ORS.\n\nDATE OF JUDGMENT:\t12\/03\/1999\n\nBENCH:\nK.Venkataswami, Syed Shah Mohammed Quadri\n\n\n\n\nJUDGMENT:\n<\/pre>\n<p>J  U  D\t G  M  E  N  T<\/p>\n<p>QUADRI,J.\n<\/p>\n<p>\tLeave is granted.\n<\/p>\n<p>      The  appellants filed these appeals against the common<br \/>\njudgment  and order of the Central Administrative  Tribunal,<br \/>\nMumbai Bench, Mumbai in Original Applications Nos.425\/92 and<br \/>\n259\/93\tdated December 6, 1995 by seeking permission of this<br \/>\nCourt\tas  they  were\tnot   parties  to   those   original<br \/>\napplications.\tThe  grievance\tof the\tappellants  is\tthat<br \/>\nwithout\t impleading  them in the said original\tapplications<br \/>\nthe  judgment  of the Tribunal passed in their favour in  OA<br \/>\nNo.823\/87  on July 11, 1991, was upset.\t The appellants were<br \/>\nrecruited  as  Inspectors  (O.G.)  in  the  Central   Excise<br \/>\nDepartment  of\tMumbai\tduring\tthe   period  1973  to\t1977<br \/>\n(hereinafter  referred to as `direct recruits&#8217;).  They filed<br \/>\nO.A.   No.823\/87 before the Central Administrative  Tribunal<br \/>\npraying\t that  the respondents therein be directed  to\tgive<br \/>\nthem  seniority\t on the basis of continuous officiation\t and<br \/>\nother consequential benefits.  Their application was allowed<br \/>\nby  the\t Tribunal on 11.7.1991.\t For a similar relief  other<br \/>\ndirect\trecruits also filed OA No.425\/92 on April 27,  1992.<br \/>\nYet another batch of direct recruits approached the Tribunal<br \/>\nfor  similar relief by filing O.A.  No.259\/93 in March 1993.<br \/>\nWhile  so the department challenged in this Court, by filing<br \/>\nSpecial\t Leave\tPetition, the said judgment of\tthe  Central<br \/>\nAdministrative\tTribunal in O.A.  No.823\/87 dated 11.7.1991.<br \/>\nThe  Special  Leave Petition was dismissed by this Court  on<br \/>\n9.3.1993.   It\tis  also  on record that  persons  who\twere<br \/>\npromoted  from\tthe lower post as Inspectors in the  Central<br \/>\nExcise\tDepartment,  Mumbai  (hereinafter referred  as\t`the<br \/>\npromotees&#8217;)  and who were permitted to intervene in the said<br \/>\nOriginal  Applications Nos.  425\/92 and 259\/93, filed before<br \/>\nthe  Tribunal Review Petition No.18\/93 seeking review of the<br \/>\nsaid  judgment\tof  the\t Tribunal dated\t 11.7.1991  in\tO.A.<br \/>\nNo.823\/87.   The  Review  Petition  was\t also  dismissed  on<br \/>\nOctober\t 20,  1993.   In  the meanwhile,  the  Collector  of<br \/>\nCentral\t Excise, Bombay-I notionally re-fixed the  seniority<br \/>\nof  the\t appellants in the cadre of Inspectors on  11.1.1993<br \/>\nand  they  were\t also  granted\tconsequential  promotion  as<br \/>\nSuperintendent\tof  Central  Excise by order issued  by\t the<br \/>\nCentral Excise Department on 7.4.1994.\tHowever, on December<br \/>\n6,  1995,  another  Bench  of  the  Central   Administrative<br \/>\nTribunal,  disagreeing with the judgment in the case of\t the<br \/>\npetitioners  in\t O.A.  No.823\/87 dated 11.7.1991,  dismissed<br \/>\nO.A.   No.259\/93  and O.A.  No.425\/92 on 27.4.1992.   It  is<br \/>\nthat  judgment and order of the Tribunal that is assailed as<br \/>\naffecting   the\t  rights   of\t the   appellants.     Mr.B.<br \/>\nParthasarthy,  learned counsel appearing for the appellants,<br \/>\nsubmitted  that\t the observations made by the Tribunal\twith<br \/>\nregard\tto  its\t earlier  judgment,  in\t the  case  of\t the<br \/>\nappellants,  in\t O.A.\tNo.823\/87 dated\t 11.7.1991,  in\t the<br \/>\njudgment  under appeal will prejudice the appellants&#8217; rights<br \/>\nand therefore those observations have to be set aside.\tShri<br \/>\nA.S.Nambiar,  learned  senior  counsel\t appearing  for\t the<br \/>\nrespondents,  supported the judgment under appeal on various<br \/>\ngrounds.   We are not inclined to go into the merits of\t the<br \/>\ncase  as  it is beyond the scope of these  appeals.   Merely<br \/>\nbecause\t the  Tribunal\thas, in the judgment  under  appeal,<br \/>\ntaken  a  view\tdifferent from that taken  in  its  judgment<br \/>\npassed\tin  O.A.  No.823\/87 dated 11.7.1991, the  appellants<br \/>\ncannot\tbe allowed to question the same.  However, so far as<br \/>\nthe  grievance\tof the appellants is concerned, there is  no<br \/>\ndispute\t that  the order of the Tribunal dated 11.7.1991  in<br \/>\nO.A.   No.823\/87  has  attained finality  as  the  challenge<br \/>\nagainst\t that  judgment failed before this Court in view  of<br \/>\nthe  dismissal of the Special Leave Petition on 9.3.1993  as<br \/>\nalso  before the Tribunal in view of the rejection of Review<br \/>\nPetition  No.18\t of  1993  filed   by  the  promotees,\t the<br \/>\nintervenors, in the cases under appeal, on October 20, 1993.<br \/>\nThe  department\t has already implemented the said  order  of<br \/>\nJuly  11,  1991\t and given all\tconsequential  benefits\t and<br \/>\npromotion  to  the  appellants.\t Further, a perusal  of\t the<br \/>\njudgment   under  appeal  shows\t  that\tthe  promotees\talso<br \/>\nreconciled  themselves\tto the position arising out  of\t the<br \/>\njudgment  dated\t 11.7.1991 in O.A.  No.823\/87 insofar as  it<br \/>\nrelates\t to  the  appellants  as   is  evident\tfrom   their<br \/>\ncontention  before the Tribunal that nothing further  should<br \/>\nbe  done to prejudice the seniority of the promotees who had<br \/>\nalready suffered on account of the seniority assigned in the<br \/>\ncase  of the appellants.  Having regard to this position, it<br \/>\nis  obvious  that the order under appeal cannot\t affect\t the<br \/>\nsettled rights of the appellants.  We are also informed that<br \/>\nagainst\t the  impugned judgment dated December 6,  1995\t and<br \/>\nagainst\t  the  order  dated   October  20,  1993   rejecting<br \/>\nR.P.No.18\/93 filed in the said O.A.  No.823\/87 Special Leave<br \/>\nPetition  c Nos.17103-17104\/96 and 20044-20045\/96 were\talso<br \/>\ndismissed  by  this  Court.   The appeals  are\tdisposed  of<br \/>\naccordingly  with the above clarification.
