It is also stated in the application that the<br \/>\nconvict&#8217;s parents are residing in a hut constructed in the fields.\n<\/p>\n<p>2.\t RULE.\n<\/p>\n<p> Mr.Kartik Pandya,  learned Additional Public Prosecutor waives<br \/>\nservice of rule on  behalf of the respondent-State.\n<\/p>\n<p>3.\tThe<br \/>\napplicant- appellant- original accused has been convicted for the<br \/>\noffences punishable under sections 302 and 498-C of the Indian Penal<br \/>\nCode to suffer imprisonment for life with fine of Rs.500\/-, in<br \/>\ndefault to further undergo imprisonment for 1 month   as awarded by<br \/>\nthe learned Judge, Fast Track Court,<br \/>\nDeesa, Banaskantha in<br \/>\nSessions Case No.172 of 2005.\n<\/p>\n<p>4.\tThe learned<br \/>\nAPP has made available the Jail record and invited attention of the<br \/>\nCourt to the Jail remarks.  The convict  had enjoyed temporary bail<br \/>\nonce and furlough once. On each occasion the convict had reported<br \/>\nbelatedly by one day.  However, said late reporting is regularised.<br \/>\nNothing adverse is noticed from the Jail remarks.\n<\/p>\n<p>5\tTaking into<br \/>\nconsideration the contents of the application and the record of the<br \/>\nconvict, the convict is ordered to be released on  temporary<br \/>\nbail for 30 (thirty) days from the date of his release on his<br \/>\nexecuting a personal bond of Rs.5000\/- (Rupees five thousand only) to<br \/>\nthe satisfaction of the Jail authorities.\n<\/p>\n<p>6.\tThe<br \/>\napplicant shall surrender himself to the Jail authorities on expiry<br \/>\nof the above temporary bail period.\tThe application is allowed.
