Justice T.R.RAMACHANDRAN NAIR\n\n Dated :06\/03\/2009\n\n O R D E R\n               T.R.RAMACHANDRAN NAIR,J.\n                      -------------------------\n                 W.P ( C) No.4219 of 2009\n                     --------------------------\n              Dated this the 6th March,2009\n\n                       J U D G M E N T\n<\/pre>\n<p>      The main relief sought for in the writ petition is one<\/p>\n<p>relating to the order passed by the 2nd respondent<\/p>\n<p>rejecting the application for Leave Without Allowances<\/p>\n<p>submitted by the petitioner. Petitioner is a specialist in<\/p>\n<p>Gynaecology working as       Assistant Surgeon    at Public<\/p>\n<p>Health Centre in Mandakada since 19.7.2007.             She<\/p>\n<p>entered service on 11.9.1997.          She is a residing at<\/p>\n<p>Manjery with her husband, mother and two minor<\/p>\n<p>children. Her husband is a practising Lawyer at Manjeri.<\/p>\n<p>The District Hospital, Manjeri is only at a distance of one<\/p>\n<p>kilo metre away from the petitioner&#8217;s residence.    As she<\/p>\n<p>was finding it inconvenient for attending the duties at<\/p>\n<p>Mankada, she was submitting various applications<\/p>\n<p>seeking for transfer to the the District Hospital, Manjeri.<\/p>\n<p>This is evidenced by Exhibits P1 and P2. Since there was<\/p>\n<p>no response     to the representations, she filed an<\/p>\n<p>W.P ( C) No.4219 of 2009<br \/>\n<span class=\"hidden_text\">                                   2<\/span><\/p>\n<p>application for Leave Without Allowances for two year<\/p>\n<p>period from 11.12.2008, as per Exhibit-P3 especially since<\/p>\n<p>her mother aged 81 was laid up. That was rejected by<\/p>\n<p>Exhibit-P4. It is submitted that the petitioner has rejoined<\/p>\n<p>duty at Mankada.\n<\/p>\n<p>      Learned counsel for the petitioner submitted that<\/p>\n<p>subsequently she came to understand          that there is a<\/p>\n<p>vacancy in the District Hospital, Manjeri and accordingly,<\/p>\n<p>the petitioner has already filed a representation on<\/p>\n<p>22.1.2009 to the Director of Health Services through the<\/p>\n<p>District Medical Officer and the same has already been<\/p>\n<p>forwarded by the District Medical Officer as per Covering<\/p>\n<p>letter dated      22.1.2009 itself. If a transfer is ordered<\/p>\n<p>accordingly, the petitioner will be benefitted. It is therefore<\/p>\n<p>prayed that the authorities may be directed to favourably<\/p>\n<p>consider her request before filling up the vacancy. Learned<\/p>\n<p>counsel for the petitioner also submitted that the petitioner<\/p>\n<p>may be allowed to move the District Medical Officer for<\/p>\n<p>granting appropriate leave for the period she could not<\/p>\n<p>attend duties at Mankada. If such an application is<\/p>\n<p>W.P ( C) No.4219 of 2009<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>submitted, the 2nd respondent will consider the same and<\/p>\n<p>take appropriate action as enjoined by the Rules in the<\/p>\n<p>matter.\n<\/p>\n<p>      In that view of the matter, the Director of Health<\/p>\n<p>Services will consider the request of the petitioner dated<\/p>\n<p>22.1.2009 for a transfer and posting to District Hospital,<\/p>\n<p>Manjeri in accordance with the guidelines.
