This Revision Petition coming on for Hearing this day, the<\/p>\n
  made the follewingz<\/p>\n
-3-<\/span><\/p>\n
trial court dismissed the eviction petition only on the ground
\nthat, the petitione:r’s husband being. the lessee, he
\nwithin the de\ufb01nition of the ‘landlord’ and the  is
\nnot maintainahle. In this regard. the trial   \ufb02
\nde\ufb01nitions of Section 3(1)) and (13 of    T
\nAct and held that, the de\ufb01nitzion
\n3 clause {h} of the Rent Control
\nHowever, the word   is’  in the
\nde\ufb01nition of ‘landlord’ undet  (is) of the Act. On
\nthe interpretation’ot’VL;t&1e  in both the Acts,
\nthe trial couitt  cannot be a landlord

6. Tlieenly    ‘ 5 for consideration is,

\nT eegjnagr section 21(1)(1) and (9) of the Karnataka Rent Control Act<\/p>\n
3  \u00e9xgainst the petitioner, interalia, aiieging that the petitioner herein<\/p>\n
hm sublet the premises, the said HRC came to be dismissed with<\/p>\n

an observation that, the petitioner herein though is a lessee has a<\/p>\n
right to sublease. The relationship between the petitioner and<\/p>\n
the respondent as a lessee and sub-lessee is not contested by the<\/p>\n
respondent and it has also come on record that, the le.ssts_* Qf the<\/p>\n
petitioner had failed to prove that the sub-lease to eje’ <\/p>\n
by the petitioner is in violation of   pf  <\/p>\n

\nor a. person to whom the collection of rents orfees ,  ~
\nin a public market, car’!-stand or slaughter :we2\u00e9e –\u00ab  ‘-

Under the Karnataka Rent Act 199\u00a7;eV  A’ <\/p>\n
under Section 3(c), which made  .\n<\/p>\n

\n52 of the Indian Easements Ac\u00a2,1832
\n(Central Act 5 of 1882) has been<\/p>\n

9. The eic\ufb01mtloza of ‘tenant’ under Section 3(n) of the Act<\/p>\n
includes the sub-tenant. The de\ufb01nition of the ‘landlord’ is not<\/p>\n
-7.\n<\/p>\n
restricted only to the owner of the piemkism, but also the person,<\/p>\n
who for the time being. is receiving or who is entitled to <\/p>\n
the tent of any premises. It is not in dispute that.   _
\nherein is mceiving the rent of the premises from _:
\nThe Karnataka Rent Contno1Act

10. ‘r1ie\u00ab  is intended to balance the<\/p>\n
interest of    and tenant and also stimulates<\/p>\n

\n   ‘.l;’s.3.500\/– per month in an area covered under
\n   Municipal Corporation Act and Rs.2,.OO0[~ in<\/p>\n
  of any other ama and commemial building having an area
\n  _1_”nothe\u00a7\u00a3eeeding 14 square meters, were only protected. Under the
\nV.  V  —   ‘4 Rent Control Act, larger protection and contzol was
\n ‘provided to the tenants. The landIord’s right is to seek eviction<\/p>\n
was restricted. However. the Karnataka Rent Act liberalized the<\/p>\n

\nregxrvery of possession of any premises shall be made by
\ngrief Court, Dis\ufb01ic1..Ji1dge or High Court in favour cg’ the<\/p>\n
tenant, save as provided in sub-\n<\/p>\n
‘  V ‘eectiion {Z}; V ., _<\/p>\n
    envisaged to protect the tenants against
\n  bntif the landiezd ful\ufb01lls the requixetnent of subsection
\n   entitled for eviction of the tenant. If Section 27 sub-<\/p>\n
‘   (1) is mad \ufb01n consonance with the de\ufb01nition of ‘latldloxwd’<\/p>\n
V   _u_:e.nd ‘tenant’, it do indicate that the landlord can evict the tenant<\/p>\n
only if he ful\ufb01lls the requirement under ciauses of Section 2. If<\/p>\n
the subwtenont. who is tenant. as de\ufb01ned under Section 3(n} of<\/p>\n
-9.\n<\/p>\n
the Act is to be evicted, necessarily for a sub~te-nant, the tenant of<\/p>\n
sub–tenant would come Within the meaning of <\/p>\n
intention and the purpose of the legislation is <\/p>\n
right of tenant of sub-tenant nude; the \u00ab.  <\/p>\n
Construction of provisions must slfba-serve. fvtlie elt\ufb01e ‘<\/p>\n
Act The fact that the de\ufb01nition e’of_’1an\u00a3I1o_\u00a7d’ in  ,<\/p>\n
excludes the lessee of s11b–1essec  tl 1e   ‘landloni’.
\nWhen the definition   theH pVIA’evisions of
\nKarnataka Rent Canto} Ac;  of sub-tenant as
\nlandlord, it  heia gag; the:::ieeiaaf;1\u00a3,Tb’f su.h~teI1a11t is not
\nlandloxd  Rent Act. In my
\nopinion,     in the matter of
\nintcxpmte\ufb02c\ufb01z of  ef ‘landknd’ and rejecting the<\/p>\n
petition of tI1’e”‘peti:io_z’;e1′ o_1\u00bb’1′ ground that, she is not a landlord<\/p>\n
”  3 clause (e) of the Act, if the lessee.<\/p>\n
  and collect rent from the subdessee, such<\/p>\n
   as an empty formality without having
\n  seek evic\ufb01on. Since, the trial court has not
\n  the matter on merit, I feel that the matter requixes<\/p>\n
  on the question of requirement under Section<\/p>\n
  I A   e  ee1eei.V27(‘2)(i) and (:3 of the Act.<\/p>\n
Accordingly. the Revision Pc\ufb01tion is allowed. The order of<\/p>\n
the trial court is set aside. The matter is remitted to the trial<\/p>\n
