SENIOR COUNSEL WIT MR\nAPURVA R KAPADIA for Respondent(s) :\n2, \n========================================= \n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 23\/09\/2011 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>As<br \/>\n\tthe hearing of this Petition has not concluded and a request is made<br \/>\n\tby learned Advocate Mr. I.H.Syed for the Petitioner that he has some<br \/>\n\tdifficulty and he is attending the matter at Delhi High Court, the<br \/>\n\tmatter is adjourned to 27th September, 2011.  However,<br \/>\n\tlearned Advocate Mr. Syed has requested that the matter before the<br \/>\n\tSessions Court is kept for framing the charge and therefore the same<br \/>\n\tmay be postponed.\n<\/p>\n<p>However,<br \/>\n\tlearned Public Prosecutor Mr. P.K.Jani for  Respondent No.1-State of<br \/>\n\tGujarat has strongly objected giving details of the entire matter as<br \/>\n\tthere is another Application, which is pending and therefore it<br \/>\n\tshould not be stalled.\n<\/p>\n<p>Learned<br \/>\n\tSenior Counsel Mr. P.C.Kavina appearing with learned Advocate Mr.<br \/>\n\tApurva Kapadia for Respondent No.2-Original Complainant has also<br \/>\n\tstrongly objected stating that the complainant should not be made to<br \/>\n\tsuffer in this fight or the litigation after 21 years.\n<\/p>\n<p>However,<br \/>\n\tconsidering the fact that the matter is part heard and with<br \/>\n\tassurance of all the learned Counsels, the matter is posted for 27th<br \/>\n\tSeptember, 2011 in the second sitting with a clear understanding and<br \/>\n\tassurance that the arguments will be concluded on that day.\n<\/p>\n<p>It<br \/>\n\tis in these circumstances, it is directed that the Sessions Case<br \/>\n\tNo.35 of 2001 before the Sessions Court at Jam Khambhaliya may not<br \/>\n\tbe proceeded regarding framing of the charge upto 30th<br \/>\n\tSeptember, 2011.\n<\/p>\n<p>The<br \/>\n\tRegistrar General is requested to convey by Fax or any other mode<br \/>\n\tabout this order for postponement of framing of charge in the<br \/>\n\taforesaid Sessions Case No.35 of 2001 to the Sessions Court at Jam<br \/>\n\tKhambhaliya.\n<\/p>\n<p>(Rajesh<br \/>\nH.
