The   petitioners    in    these     writ petitions have<\/p>\n<p>approached this court on an earlier occasion seeking release of<\/p>\n<p>the transport of &#8220;Granite Slabs&#8221; detained under Section 47(2) of<\/p>\n<p>the Kerala Value Added Tax Act, 2003 (KVAT Act). This court<\/p>\n<p>issued directions to the competent authority entrusted with the<\/p>\n<p>power of adjudication under Section 47(6) to conduct a physical<\/p>\n<p>verification and to take measurement of the goods, in the<\/p>\n<p>presence of the petitioner, if necessary with the aid of an expert,<\/p>\n<p>and to finalise the adjudication on the basis of the result of such<\/p>\n<p>measurement.\n<\/p>\n<p>      2.   In compliance with the directions contained in the<\/p>\n<p>judgment, measurement was conducted with assistance of an<\/p>\n<p>expert from the &#8216;Kerala State Nirmithi Kendra&#8217; and the penalty<\/p>\n<p>proceedings was finalised based on the report of such<\/p>\n<p>measurement. It is revealed that the quantity of &#8216;Granite Slabs&#8217;<\/p>\n<p>which was originally alleged in the notices issued under Section<\/p>\n<p>47(2), has been considerably reduced as per the said<\/p>\n<p>measurement.     Consequently penalty is imposed only on the<\/p>\n<p>W.P.(C).32528 &amp; 32575\/09         2<\/p>\n<p>basis of the quantity of goods arrived through the fresh<\/p>\n<p>measurement.\n<\/p>\n<p>      3.    According to the petitioner, even the measurement<\/p>\n<p>taken as above was not conducted in a proper manner and each<\/p>\n<p>and every slabs contained in the transport was not measured<\/p>\n<p>independently. It is also contended that the expert in question<\/p>\n<p>has not conducted the measurement following the common trade<\/p>\n<p>practice prevalent in the business parlance.<\/p>\n<p>      4.    I am not inclined to entertain these writ petitions and<\/p>\n<p>to consider merits of the contention raised above or to adjudicate<\/p>\n<p>upon such contentions, because an effective remedy by way of<\/p>\n<p>appeal is provided against the orders imposing penalty under<\/p>\n<p>Section 47(6), as per the statute. Hence I am of the opinion that<\/p>\n<p>the petitioners can be given with opportunity to challenge the<\/p>\n<p>impugned orders before the appropriate appellate authority. It<\/p>\n<p>is for the petitioners to substantiate their claims through proper<\/p>\n<p>evidence before the appellate authority, with respect to the<\/p>\n<p>correctness of the measurement.\n<\/p>\n<p>      5.    In the result the writ petitions are dismissed without<\/p>\n<p>prejudice to rights of the petitioners to approach the appellate<\/p>\n<p>authority against the impugned orders of penalty.
