Justice K.T.SANKARAN\n\n Dated :26\/08\/2009\n\n O R D E R\n                           K.T.SANKARAN, J.\n              ------------------------------------------------------\n                       B.A. NO. 4690 OF 2009\n              ------------------------------------------------------\n                  Dated this the 26th August, 2009\n\n\n                                 O R D E R\n<\/pre>\n<p>       This is an application for anticipatory bail under Section 438 of<\/p>\n<p>the Code of Criminal Procedure. The petitioner is the accused in<\/p>\n<p>Crime No.21 of 2009 of Manjeri Excise Range.<\/p>\n<p>       2. The offence alleged against the petitioner is under Section<\/p>\n<p>8(1) of the Abkari Act.\n<\/p>\n<\/p>\n<p>       3. I have perused the case diary. The mahazar shows that on<\/p>\n<p>5.8.2009, when the Excise party was on patrol duty, they seized 2.4<\/p>\n<p>litres of arrack as abandoned by a person who ran away when the<\/p>\n<p>Excise party saw him.          In the mahazar, it is recorded that the<\/p>\n<p>witnesses disclosed the name and other details of the petitioner.<\/p>\n<p>The case diary does not show that the aforesaid persons were<\/p>\n<p>questioned.     No such statement is seen recorded from those<\/p>\n<p>witnesses.\n<\/p>\n<\/p>\n<p>       4.  Taking into account the facts and circumstances of the<\/p>\n<p>B.A. NO. 4690 OF 2009<\/p>\n<p>                                     :: 2 ::\n<\/p>\n<p>case, the nature of the offence and other circumstances, I am of<\/p>\n<p>the view that anticipatory bail can be granted to the petitioner. There<\/p>\n<p>will be a direction that in the event of the arrest of the petitioner, the<\/p>\n<p>officer in charge of the police station shall release him on bail on his<\/p>\n<p>executing bond for Rs.25,000\/- with two solvent sureties for the like<\/p>\n<p>amount to the satisfaction of the officer concerned, subject to the<\/p>\n<p>following conditions:\n<\/p>\n<\/p>\n<blockquote><p>       a)    The petitioner shall report before the investigating<br \/>\n             officer between 9 A.M.        and 11 A.M. on alternate<br \/>\n             Mondays, till the final report is filed or until further<br \/>\n             orders;\n<\/p><\/blockquote>\n<blockquote><p>       b)    The petitioner shall appear before the investigating<br \/>\n             officer for interrogation as and when required;\n<\/p><\/blockquote>\n<blockquote><p>       c)    The petitioner shall not try to influence the prosecution<br \/>\n             witnesses or tamper with the evidence;\n<\/p><\/blockquote>\n<blockquote><p>       d)    The petitioner shall not commit any offence or indulge in<br \/>\n             any prejudicial activity while on bail;\n<\/p><\/blockquote>\n<blockquote><p>       e)    In case of breach of any of the conditions mentioned<br \/>\n             above, the bail shall be liable to be cancelled.\n<\/p><\/blockquote>\n<blockquote><p>       The Bail Application is allowed to the extent indicated above.<\/p><\/blockquote>\n<p>                                                    (K.T.SANKARAN)<br \/>\n                                                            Judge<br \/>\nahz\/<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Vimal Kumar vs State Of Kerala on 26 August, 2009 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl..No. 4690 of 2009() 1.
