NO: 1135 OF 2005\n        -----------------------------------------------------------------------------------\n                      Dated this the 18th August, 2009.\n\n                                        JUDGMENT\n<\/pre>\n<p>PIUS C.KURIAKOSE, J.\n<\/p>\n<p>      This is an appeal by the requistioning authority and they are<\/p>\n<p>aggrieved by the refixation of land value. Land Acquisition Officer<\/p>\n<p>fixed land value at the rate of Rs.735\/- per Are which was refixed by<\/p>\n<p>the reference court to Rs.4800\/- per Are.<\/p>\n<p>      2.    Having regard to the submissions addressed by Mr.<\/p>\n<p>V.J.Joseph, learned counsel for the appellant,                                       Shri. Philip<\/p>\n<p>M.Varghese, learned counsel for respondents 1 to 7 and Smt.<\/p>\n<p>P.N.Sumangala, learned Government Pleader for respondent No: 10<\/p>\n<p>and having regard to a reappraisal of the evidence available on<\/p>\n<p>records, we are of the view that the enhancement granted under<\/p>\n<p>the impugned judgment is excessive. On a better assessment of<\/p>\n<p>the evidence,         we feel that the market value of the acquired<\/p>\n<p>property can be refixed at Rs. 2205 per are. Accordingly we set<\/p>\n<p>aside the judgment under appeal and the market value of the land<\/p>\n<p>under acquisition is refixed to Rs.2205 per Are.                                 Appeal stands<\/p>\n<p>allowed to that extent. It is needless to mention that the claimants<\/p>\n<p><span class=\"hidden_text\">L.A.A. 1135\/2005               2<\/span><\/p>\n<p>will be entitled to all statutory benefits on the enhanced<\/p>\n<p>compensation by virtue of our refixation under this judgment.<\/p>\n<p>                                           PIUS C.KURIAKOSE<br \/>\n                                                  Judge<\/p>\n<p>                                        K.
