The same is<br \/>\n\tallowed. The amendment shall be carried out during the course of the<br \/>\n\tday.\n<\/p>\n<p>Mr.Dagli<br \/>\n\tinvites attention of this Court to the fact that after the recovery<br \/>\n\tcertificate was issued on 17th January 2002, before it<br \/>\n\tcould be executed, the petitioner learnt that the respondent<br \/>\n\tno.2-Prantij Taluka Sahakari Kharid Vechan Sangh Ltd. was disposing<br \/>\n\tof its property. On legal advice available, the petitioner filed<br \/>\n\tLavad Suit No.705 of 2004 before the Board of Nominees praying for<br \/>\n\tan injunction against the respondent no.2-Prantij Taluka Sahakari<br \/>\n\tKharid Vechan Sangh Ltd., not to transfer the land belonging to<br \/>\n\trespondent no.2. The Board of Nominees was pleased to grant<br \/>\n\tinjunction as prayed for.\n<\/p>\n<p>\t\t\t\tThe petitioner<br \/>\n\t\tthereafter obtained proclamation on 21st April 2008 and<br \/>\n\t\tthe auction was fixed on 28th May 2008. As the<br \/>\n\t\tpetitioner knew the bona fides of respondent no.2, it apprehended<br \/>\n\t\tthat the respondent no.2 will stall the auction proceedings by any<br \/>\n\t\tmeans, hence the  petitioner approached this Court by way of<br \/>\n\t\tSpecial Civil Application No.7888 of 2008, praying that the<br \/>\n\t\trespondent no.2 be restrained from stalling the auction<br \/>\n\t\tproceedings. However, the Court was of the opinion that the<br \/>\n\t\tapprehension of the petitioner is not well-placed and hence, the<br \/>\n\t\tpetition was withdrawn.\n<\/p>\n<p>The<br \/>\n\tapprehensions of the petitioner came true and on 28th May<br \/>\n\t2008 when the officials of the petitioner reached the place of<br \/>\n\trespondent no.2 where the auction was to be held, it was learnt that<br \/>\n\trespondent no.1-Special Recovery Officer  Mr.H.A. Lodhawala has not<br \/>\n\tcome. On inquiry, it was learnt that respondent no.1-Special<br \/>\n\tRecovery Officer Mr.H.A. Lodhawala on the basis of an opinion sought<br \/>\n\tfor by him for no valid reasons, from an advocate of his choice<br \/>\n\tdecided to postpone the matter. The opinion was to the effect that<br \/>\n\tduring the pendency of Lavad Suit No.705 of 2004, wherein the Board<br \/>\n\tof Nominees has injuncted respondent no.2 from disposing of its<br \/>\n\tproperty, an auction cannot be held.\n<\/p>\n<p>On<br \/>\n\tthe face of it, the action of the respondent no.1 is found to be not<br \/>\n\tonly devoid of any bona fides but also motivated by extraneous<br \/>\n\treasons. Hence, respondent no.1-Mr.H.A. Lodhawala is directed to<br \/>\n\tremain personally present before this Court with all the necessary<br \/>\n\tpapers pertaining to this case on 23rd June 2008, failing<br \/>\n\twhich the Court will be constrained to pass necessary coercive<br \/>\n\torders.\n<\/p>\n<p>\t\t\tTaking into<br \/>\n\tconsideration the fact that postponement of auction was his personal<br \/>\n\tdecision,  it is directed that respondent no.1 shall make his own<br \/>\n\tarrangement to represent his case and the office of the Government<br \/>\n\tPleader shall not render any legal assistance to him. It is further<br \/>\n\tdirected that the respondent no.1 shall not claim any &#8216;on duty&#8217;<br \/>\n\tprivileges while attending this Court i.e. Travel Allowance (T.A.)<br \/>\n\tand Dearness Allowance (D.A.).\n<\/p>\n<p>A<br \/>\n\tcopy of this order be made available to Ms.Krina Calla so as to<br \/>\n\tenable her to communicate the same to the concerned Collector, who<br \/>\n\tis the appointing authority of the respondent no.1.\n<\/p>\n<p>\t\t\tDirect Service is<br \/>\n\tpermitted, today.\n<\/p>\n<p>(Ravi<br \/>\nR.
