BASANT, J.\n\n            ````````````````````````````````````````````````````\n                    B.A. No. 1218 OF 2008 B\n            ````````````````````````````````````````````````````\n           Dated this the 28th day of February, 2008\n\n                              O R D E R\n<\/pre>\n<p>            Application for regular bail.          Petitioner, a young<\/p>\n<p>man aged about 22 years, faces allegations for offences of<\/p>\n<p>theft, rape, abduction, etc. The crux of the allegations is that<\/p>\n<p>the de facto complainant had employed a girl, whose date of<\/p>\n<p>birth is 15.12.1991. While she was in employment of the de<\/p>\n<p>facto complainant, she was found missing. Cash, ornaments,<\/p>\n<p>etc. which were available in the house of the de facto<\/p>\n<p>complainant were also found missing. A crime was registered<\/p>\n<p>under the caption &#8220;woman missing&#8221;. It turned out that the said<\/p>\n<p>girl and the petitioner had gone together. The ornaments,<\/p>\n<p>cash, etc., which the said girl took away from the house, were<\/p>\n<p>sold\/utilised to purchase a scooter for the petitioner. The girl<\/p>\n<p>and the petitioner, after so eloping, had also indulged in<\/p>\n<p>sexual activity.\n<\/p>\n<p>      2.    Investigation is in progress. Both the petitioner and<\/p>\n<p>the said girl had come back and surrendered on 6.2.08. The<\/p>\n<p>BA.1218\/08<br \/>\n<span class=\"hidden_text\">                              : 2 :<\/span><\/p>\n<p>petitioner was arrested and he continues in custody. The girl<\/p>\n<p>being a minor is proceeded against separately, it is submitted.<\/p>\n<p>      3.   The learned counsel for the petitioner submits that<\/p>\n<p>even if the entire allegations were accepted, the petitioner is<\/p>\n<p>not guilty of any offence. The allegations of rape, etc. have<\/p>\n<p>been raised unnecessarily against the petitioner.        Even<\/p>\n<p>admittedly it was a case of consensual sexual intercourse.<\/p>\n<p>The alleged victim has no grievance. She has crossed the<\/p>\n<p>age of consent also. In these circumstances, the investigator<\/p>\n<p>now does not press the allegation of rape.<\/p>\n<p>      4.   The learned counsel for the petitioner submits that<\/p>\n<p>even about the allegation of theft, the petitioner had no<\/p>\n<p>culpable responsibility. He had not committed the crime at all.<\/p>\n<p>He has no role took play in the alleged commission of theft by<\/p>\n<p>the said girl. In these circumstances, the petitioner, who has<\/p>\n<p>remained in custody from 6.2.08, may be enlarged on bail, it<\/p>\n<p>is prayed.\n<\/p>\n<p>      5.   The    learned   Public  Prosecutor    refutes   the<\/p>\n<p>contentions raised and submits that the State has no objection<\/p>\n<p>BA.1218\/08<br \/>\n<span class=\"hidden_text\">                                : 3 :<\/span><\/p>\n<p>against grant of regular bail to the petitioner, who has<\/p>\n<p>remained in custody from 6.2.08, subject to appropriate<\/p>\n<p>conditions. I am satisfied, in these circumstances, that the<\/p>\n<p>petitioner can now be enlarged on bail.\n<\/p>\n<p>      6.   In the result, this petition is allowed. The petitioner<\/p>\n<p>shall be released on bail on the following terms and<\/p>\n<p>conditions:\n<\/p>\n<p>      i)   The petitioner shall execute a bond for Rs.50,000\/-<\/p>\n<p>(Rupees fifty thousand only) with two solvent sureties each for<\/p>\n<p>the like sum to the satisfaction of the learned Magistrate.<\/p>\n<p>      ii)  The petitioner shall make himself available for<\/p>\n<p>interrogation before the investigating officer between 10 a.m<\/p>\n<p>and 12 noon on all Mondays and Fridays, for a period of three<\/p>\n<p>months from the date of his release and thereafter as and<\/p>\n<p>when directed by the investigating officer in writing to do so.<\/p>\n<p>                                              (R.BASANT, JUDGE)<br \/>\naks<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Vinesh vs State Of Kerala on 28 February, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM Bail Appl No. 1218 of 2008() 1.
