SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 25\/08\/2010 \n\n \n\n \nC.A.V.\nORDER \n<\/pre>\n<p>\tBy<br \/>\n\tway of this petition under Article 226 of the Constitution of India,<br \/>\n\tthe petitioners have prayed the following reliefs in para 12:-\n<\/p>\n<p> (a)\tThis<br \/>\nHon&#8217;ble Court may be pleased to issue a writ of mandamus and\/or any<br \/>\nother appropriate writ, order or direction in the nature of mandamus<br \/>\nagainst the respondents directing them to seal the plot and the<br \/>\nrespondent authorities be directed to go to the site and stop the<br \/>\nconstruction and to lodge appropriate complaint against the<br \/>\nrespondent Nos.3 &amp; 4 for carrying out illegal construction and<br \/>\nfurther the authorities be directed to put the security at the site<br \/>\nat the costs of the respondent Nos.3 &amp; 3 and not to allow anybody<br \/>\nto enter into the land and to put up further illegal construction at<br \/>\nthe site.\n<\/p>\n<p>(aa)\tThis<br \/>\nHon&#8217;ble Court be pleased to direct the respondent No.2 &#8211; AUDA to<br \/>\nhandover  the possession of the 22 ft. wide land to the present<br \/>\npetitioners   who are the owners of Plot No.H\/6\/10, H\/6\/11 and<br \/>\nH\/6\/13.\n<\/p>\n<p>(aaa)\tBy<br \/>\nappropriate writ, order of direction, this Hon&#8217;ble Court be pleased<br \/>\nto declare that the land which is on the site only 12 ft. as per the<br \/>\nwire fencing is illegal and as prayed for in the petition 22 ft. wide<br \/>\nopen land be handed over to the present petitioners.\n<\/p>\n<p>(b)\tBy<br \/>\nappropriate writ, order or direction, this Hon&#8217;ble Court be pleased<br \/>\nto direct the respondent Nos.1 &amp; 2  to place before th Hon&#8217;ble<br \/>\nCourt whether any plans are approved or not and if not then how such<br \/>\nillegal construction is carried out why no action are taken inspite<br \/>\nof the complaint being made by the petitioners   and for the same<br \/>\nappropriate directions be also issued  by this Hon&#8217;ble Court.\n<\/p>\n<p>(c)\tPending<br \/>\nadmission, hearing and\/or final disposal of this petition, this<br \/>\nHon&#8217;ble Court be pleased to direct the respondent Nos.1 &amp; 2 to<br \/>\nto immediately visit Final<br \/>\nPlot Nos.201 and 202 and to see that with the help of security<br \/>\n and police force the illegal construction is stopped and the<br \/>\nproperty is sealed from all the corners.\n<\/p>\n<p>(d)\tSuch<br \/>\nother and further relief as this Hon&#8217;ble Court may deem just, fit and<br \/>\nexpedient be granted in favour of the petitioners.\n<\/p>\n<p>(e)\tCosts<br \/>\nof this petition be provided for to the petitioner.\n<\/p>\n<p>At<br \/>\n\tthe outset, it is  required to be noted that at the relevant time<br \/>\n\twhen the petition was filed it was the case on behalf of the<br \/>\n\tpetitioners<br \/>\n\tthat respondent Nos.3 and 4 are putting up the construction on the<br \/>\n\tland in question illegally and without obtaining Development<br \/>\n\tPermission and without getting the Plans sanctioned and also on<br \/>\n\tnumber of other grounds. After  the notice of the petition was<br \/>\n\tserved upon the respondents, the respondent Nos.3 and 4 came out<br \/>\n\twith a case that they have obtained Development Permission \/ Revised<br \/>\n\tDevelopment Permission from Ahmedabad Urban Development Authority<br \/>\n\tby Development Permission   <\/p>\n<p>\tdtd.3\/7\/2010  and<br \/>\n\tthe Ahmedabad Urban Development Authority   and the<br \/>\n\tAhmedabad<br \/>\n\tUrban Development Authority   sanctioned the Revised<br \/>\n\tDevelopment<br \/>\n\tPlans submitted by the respondent Nos.3\/1 to 3\/3  submitted vide<br \/>\n\tapplication dtd.8\/3\/2010.\n<\/p>\n<p>Considering<br \/>\n\tthe fact that the  land in question, for which Development<br \/>\n\tPermission was granted by the  Ahmedabad Urban Development Authority<br \/>\n\tand the Revised Development Plans were sanctioned on<br \/>\n\t3\/7\/2010, are not within the local limits and jurisdiction of the<br \/>\n\tAhmedabad<br \/>\n\tUrban Development Authority but are within the local limits and<br \/>\n\tjurisdiction of Ahmedabad Municipal Corporation, the question arose<br \/>\n\twith respect to jurisdiction and authority  of the Ahmedabad Urban<br \/>\n\tDevelopment Authority to sanction the Development<br \/>\n\tPlans and Development<br \/>\n\tPermission<br \/>\n\t with respect to the lands which are not within the local<br \/>\n\tlimits and jurisdiction of the Ahmedabad<br \/>\n\tUrban Development Authority but within the local<br \/>\n\tlimits and jurisdiction of the Ahmedabad<br \/>\n\tMunicipal Corporation and therefore, the question arose with respect<br \/>\n\tto legality and validity of sanctioning of such Development Plans<br \/>\n\tand granting of Development Permission with respect to land in<br \/>\n\tquestion by Ahmedabad<br \/>\n\tUrban Development Authority, more particularly<br \/>\n\tconsidering the Notification issued by the  Ahmedabad<br \/>\n\tUrban Housing and Urban Development, State of Gujarat dtd.14\/2\/2006<br \/>\n\tand the order passed by the Urban Housing and Urban Development<br \/>\n\tDepartment, dtd.14\/12\/2006, by which, with respect to  lands which<br \/>\n\tare included in the local limits and jurisdiction for the<br \/>\n\tCorporation, powers under sections 27 to 39 and 49 of the  Town<br \/>\n\tPlanning and Urban Development Act, are required to be exercised by<br \/>\n\tthe  Ahmedabad<br \/>\n\tMunicipal Corporation  only and not by the Ahmedabad<br \/>\n\tUrban Development Authority.\n<\/p>\n<p>\tHowever,<br \/>\n\tbefore the aforesaid could be considered, suddenly and surprisingly<br \/>\n\tthe petitioners   field Additional Affidavit, affirmed by the<br \/>\n\tpetitioner  No.2 with a request to permit the petitioners to<br \/>\n\twithdraw the present petition, by submitting that the grievance<br \/>\n\tvoiced in the present petition does not survive. In para 3 of the<br \/>\n\tsaid Affidavit  dtd.2\/8\/2010, the petitioners   also requested to<br \/>\n\trelieve their advocates Mr.M.B. Gandhi and Mr.C.M. Gandhi, from the<br \/>\n\tpresent proceedings, as they are discharged from the responsibility<br \/>\n\tof this matter.\n<\/p>\n<p>When<br \/>\n\tMr.M.B. Gandhi and Mr.C.M. Gandhi, learned advocates<br \/>\n\tappeared on behalf of the petitioners, they requested to permit the<br \/>\n\tpetitioners to withdraw the present petition unconditionally,<br \/>\n\thowever, in light of para 3 of the Additional Affidavit dtd.2\/8\/2010<br \/>\n\twhen the petitioners   discharged and relieved Mr.M.B. Gandhi and<br \/>\n\tMr.C.M. Gandhi, as their advocates,  they have no authority to<br \/>\n\tappear on behalf of the petitioners  as advocate of the petitioners<br \/>\n\tand therefore, the petitioners   were directed to remain present and<br \/>\n\tmake a request or they may withdraw para 3 of the Additional<br \/>\n\tAffidavit dtd.2\/8\/2010.\n<\/p>\n<p>In<br \/>\n\tresponse to the above, petitioner  No.2 has personally<br \/>\n\tappeared in the Court and has requested to permit the petitioners to<br \/>\n\twithdraw the present petition as the grievance of the petitioners<br \/>\n\tvoiced in the present petition does not survive.\n<\/p>\n<p>In<br \/>\n\tview of the above, it appears that for some oblique and extraneous<br \/>\n\treasons, the petitioners   are now requesting to permit the<br \/>\n\tpetitioners   to withdraw the present petition, more particularly<br \/>\n\twhen  this Court  was\/is seriously considering the legality and<br \/>\n\tvalidity of the Development<br \/>\n\tPlans and Development Permission dtd.3\/7\/2010 by the Ahmedabad Urban<br \/>\n\tDevelopment Authority<br \/>\n\twith respect to the lands which are not within the local limits and<br \/>\n\tjurisdiction  of the Ahmedabad Urban Development Authority   but<br \/>\n\twhich are within the local limits and jurisdiction of the Ahmedabad<br \/>\n\tMunicipal Corporation. Be that it may. As the<br \/>\n\tpetitioners   are requesting that they may be permitted to withdraw<br \/>\n\tthe present petition unconditionally, this Court has no other<br \/>\n\talternative but to permit the petitioners   to withdraw  the present<br \/>\n\tpetition.\n<\/p>\n<p>In<br \/>\n\tview of the above, petitioners are permitted to withdraw the present<br \/>\n\tpetition  and the present petition is dismissed as withdrawn.<br \/>\n\tHowever, while permitting the petitioners   to withdraw  it is<br \/>\n\tspecifically observed that this Court has not expressed any opinion<br \/>\n\ton merits with respect to legality and validity of the sanction of<br \/>\n\tthe Development<br \/>\n\tPlans and grant of Development Permission on 3\/7\/2010  by the<br \/>\n\tAhmedabad Urban Development Authority with respect to lands in<br \/>\n\tquestion which are admittedly within the local limits and<br \/>\n\tjurisdiction of the Ahmedabad Municipal Corporation  and<br \/>\n\tnot within the Ahmedabad<br \/>\n\tUrban Development  Authority, as though this Court was seriously<br \/>\n\tconsidering the aforesaid question, in the meantime, the petitioners<br \/>\n\t  requested to permit<br \/>\n\tthem to withdraw this petition. However, it is observed and made it<br \/>\n\tclear that by permitting the petitioners   to withdraw the present<br \/>\n\tpetition it may not be construed by anybody this Court has exercised<br \/>\n\tany opinion with respect to legality and validity of the sanctioning<br \/>\n\tof the Development Plans and grant of Development Permission by the<br \/>\n\tAhmedabad Urban Development Authority   on 3\/7\/2010 with respect to<br \/>\n\tthe lands in question, which is admittedly within the local limits<br \/>\n\tand jurisdiction of the Ahmedabad Municipal Corporation<br \/>\n\tand\/or it may not be construed that this Court has expressed any<br \/>\n\topinion on merits with respect to the powers and authority of the<br \/>\n\tAhmedabad<br \/>\n\tUrban Development Authority  to grant Development<br \/>\n\tPermission and\/or to sanction the Development Plans<br \/>\n\twith respect to the land which are included in the local limits and<br \/>\n\tjurisdiction of the Ahmedabad<br \/>\n\tMunicipal Corporation  pursuant to the Notification<br \/>\n\tdtd.14\/2\/2006 and this Court has not decided any of  the aforesaid<br \/>\n\tquestions and all the aforesaid questions are kept open.\n<\/p>\n<p>With<br \/>\n\tthese present petition is dismissed as withdrawn, which cost, which<br \/>\n\tis quantified at Rs.10,000=00 (Rupees Ten Thousand only) to be  paid<br \/>\n\tby the petitioners, as it appears that the petitioners<br \/>\n\thave grossly abused and misused the process of Court  and have tried<br \/>\n\tto settle their personal score, and as the petitioners initially<br \/>\n\tproceeded further with the matter very seriously and fought tooth<br \/>\n\tand nail and thereafter for the reasons best known to the<br \/>\n\tpetitioners, the petitioners are withdrawing the present petition.<br \/>\n\tThe aforesaid amount of cost to be deposited by the petitioners<br \/>\n\twithin a period of two weeks from today and on such deposit, the<br \/>\n\tRegistry is directed to transmit the same to the Gujarat High Court<br \/>\n\tLegal Services Committee. Notice is discharged.
