WITH MR\nASHISH M DAGLI for Applicant:1, \nMS MINI NAIR APP for Respondent(s)\n: 1, \n=======================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 14\/09\/2010\n \n\nORAL\nORDER<\/pre>\n<p>The<br \/>\n\tpresent application has been filed by the applicant-accused under<br \/>\n\tSection 439 of Criminal Procedure Code for regular bail.\n<\/p>\n<p>The<br \/>\n\tapplicant-accused is charged with having committed offences<br \/>\n\tunder Sections 143, 147, 148, 149 and 307 of the Indian Penal Code,<br \/>\n\tunder Sections 25(1)(b) and 27 of the Arms Act and under Section 135<br \/>\n\tof the Bombay Police Act, for which, FIR being I-C.R.No.57\/2010 has<br \/>\n\tbeen lodged at Savli Police Station.\n<\/p>\n<p>Learned<br \/>\n\tSenior Counsel, Mr.Y.S. Lakhani for Mr.Ashish Dagli for the<br \/>\n\tapplicant referred to the papers and submitted that earlier in the<br \/>\n\tCompany known as Thermax Co., there was some problem, for which,<br \/>\n\tcomplaint was filed. Thereafter, the present complaint has been<br \/>\n\tfiled for the alleged offence by one of the workers. However, he<br \/>\n\tsubmitted that other co-accused i.e. Shashi Shetty (Contractor) has<br \/>\n\tbeen granted anticipatory bail as per the order passed in Criminal<br \/>\n\tMisc. Application No.9454\/2010 dated 23.08.2010.\n<\/p>\n<p>Learned<br \/>\n\tA.P.P., Ms.Mini Nair resisted the present application and submitted<br \/>\n\tthat the present applicant had fired in the air and there are<br \/>\n\teyewitnesses and, therefore, as the chargesheet is not filed, the<br \/>\n\tpresent application may not be entertained.\n<\/p>\n<p>Having<br \/>\n\theard learned<br \/>\n\tcounsel appearing for the respective parties and<br \/>\n\thaving perused the papers and considering the nature of offence,<br \/>\n\tmanner in which it is alleged to have been committed, role<br \/>\n\tattributed, the present application deserves to be allowed.\n<\/p>\n<p>Accordingly,<br \/>\n\tpresent application stands allowed. The applicant is ordered to be<br \/>\n\treleased on regular bail in connection with I-C.R.No.57\/2010<br \/>\n\tregistered with Savli Police Station on his executing a bond of<br \/>\n\tRs.5,000\/- (Rupees Five Thousand Only) with one solvent surety of<br \/>\n\tthe like amount to the satisfaction of the lower Court and subject<br \/>\n\tto the conditions that he shall:\n<\/p>\n<p>(a)\tnot<br \/>\ntake undue advantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot<br \/>\nto try to tamper or pressurize the prosecution witnesses or<br \/>\ncomplainant in any manner.\n<\/p>\n<p>(c)\tnot<br \/>\nact in any manner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain<br \/>\nlaw and order and should cooperate the investigating officers.\n<\/p>\n<p>(e)\tfurnish<br \/>\nthe address of his residence to the Investigating Officer and also to<br \/>\nthe Court at the time of execution of the bond and shall not change<br \/>\nhis residence without prior permission of the Court.\n<\/p>\n<p>(f)\tsurrender<br \/>\nhis passport, if any, to the lower Court, within a week.\n<\/p>\n<p>(g)\tmark<br \/>\nhis presence before concerned Police Station 1st day of<br \/>\nevery calender month between 11:00 AM and 2:00 PM till the<br \/>\nchargesheet is filed.\n<\/p>\n<p>If<br \/>\n\tbreach of any of the above conditions is committed, the concerned<br \/>\n\tSessions Judge will be free to issue warrant or take appropriate<br \/>\n\taction in the matter.\n<\/p>\n<p>Bail<br \/>\n\tbefore the lower Court having jurisdiction to try the case. It would<br \/>\n\tbe open to the trial Court concerned to give time to furnish the<br \/>\n\tsolvency certificate if prayed for.\n<\/p>\n<p>Rule<br \/>\n\tis made absolute to the aforesaid extent.
