PATTANAIK (J)\n\nCITATION:\n 1996 AIR 1656\t\t  1996 SCALE  (3)1\n\n\nACT:\n\n\n\nHEADNOTE:\n\n\n\nJUDGMENT:\n<\/pre>\n<p>\t\t\t O R D E R<br \/>\n     Leave granted.\n<\/p>\n<p>     We have  heard learned  counsel  on  both\tsides.\tThis<br \/>\nappeal by  special leave  arises from  the order of the High<br \/>\nCourt of  Allahabad, made on December 2, 1993 in Civil Misc.<br \/>\nWrit Petition  No.29951 of  1993. The  admitted position  is<br \/>\nthat before  departmental enquiry  was initiated against the<br \/>\nrespondent  for\t  embezzlement\tof   Rs.2,47,479\/-,  on\t hit<br \/>\nattaining the  age of  superannuation on  March 31, 1987, he<br \/>\nwas  allowed   to  retire  from\t service.  The\tdepartmental<br \/>\nproceedings thereafter\twere initiated\tagainst him.  F.I.R.<br \/>\nwas lodged and investigation is stated to be in progress. No<br \/>\nsuch rule to continue the proceedings after retirement as is<br \/>\nin vogue  in some State or Central Service Pension Rules, is<br \/>\nin operation.  So the  action  of  departmental\t proceedings<br \/>\ncannot be  continued. There  would be  no impediment to have<br \/>\nthe investigation into the offences continued. However, when<br \/>\npension was  not paid to him it came to be challenged in the<br \/>\nHigh Court  in the  above writ petition which the High Court<br \/>\nhas allowed  it and  has directed  to pay  the pension. Thus<br \/>\nthis appeal by special leave.\n<\/p>\n<p>     The only  provision brought to our notice is Rule 351-A<br \/>\nwhich reads as under:\n<\/p>\n<blockquote><p>     &#8220;The Governor  reserves to\t himself<br \/>\n     the   right   of\twithholding   or<br \/>\n     withdrawing a  pension or\tany part<br \/>\n     of it, whether permanently or for a<br \/>\n     specified period  and the\tright of<br \/>\n     ordering  the   recovery\tfrom   a<br \/>\n     pension of\t the whole  part of  any<br \/>\n     pecuniary\t  loss\t   caused     to<br \/>\n     Government,  if  the  pensioner  is<br \/>\n     found in  departmental or\tjudicial<br \/>\n     proceedings to  have been guilty of<br \/>\n     grave  mis-conduct,   or  to   have<br \/>\n     caused pecuniary loss to Government<br \/>\n     by misconduct or negligence, during<br \/>\n     his  service,   including\t service<br \/>\n     rendered  on   re-employment  after<br \/>\n     retirement:\n<\/p><\/blockquote>\n<blockquote><p>     Provided that\n<\/p><\/blockquote>\n<blockquote><p>     a) such  departmental  proceedings,<br \/>\n     if not instituted while the officer<br \/>\n     was   on\t duty\teither\t  before<br \/>\n     retirement or during re-employment-\n<\/p><\/blockquote>\n<blockquote><p>\t  i)  shall  not  be  instituted<br \/>\n\t       save with the sanction of<br \/>\n\t       the Governor,\n<\/p><\/blockquote>\n<blockquote><p>\t  ii) shall  be in respect of an<br \/>\n\t       event  which  took  place<br \/>\n\t       not more\t than four years<br \/>\n\t       before the institution of<br \/>\n\t       such proceedings, and\n<\/p><\/blockquote>\n<blockquote><p>\t  iii)\tshall  be  conducted  by<br \/>\n\t       such  authority\t and  in<br \/>\n\t       such place  or places  as<br \/>\n\t       the Governor  may  direct<br \/>\n\t       and  in\taccordance  with<br \/>\n\t       the procedure  applicable<br \/>\n\t       to proceedings  on  which<br \/>\n\t       an  order   of  dismissal<br \/>\n\t       from service may be made.\n<\/p><\/blockquote>\n<blockquote><p>     b)\t judicial  proceedings,\t if  not<br \/>\n     instituted while the officer was on<br \/>\n     duty either  before  retirement  or<br \/>\n     during  re-employment,  shall  have<br \/>\n     been instituted  in accordance with<br \/>\n     sub-clause (ii) of clause (a) and\n<\/p><\/blockquote>\n<blockquote><p>     c) the  Public Service  Commission,<br \/>\n     U.P.,  shall  be  consulted  before<br \/>\n     final orders are passed.<br \/>\n     Explanation &#8211;  For the  purpose  of<br \/>\n     this article &#8211;\n<\/p><\/blockquote>\n<blockquote><p>     a) departmental  proceedings  shall<br \/>\n     be deemed\tto have\t been instituted<br \/>\n     when the charges framed against the<br \/>\n     pensioner are  issued to him, or if<br \/>\n     the officer  has been  placed under<br \/>\n     suspension from an earlier date, on<br \/>\n     such date; and\n<\/p><\/blockquote>\n<blockquote><p>\t  i) in\t the  case  of\tcriminal<br \/>\n\t       proceedings, on\tthe date<br \/>\n\t       on which\t a complaint  is<br \/>\n\t       made, or\t a charge  sheet<br \/>\n\t       is   submitted,\t  to   a<br \/>\n\t       criminal court; and\n<\/p><\/blockquote>\n<blockquote><p>\t  ii)  in   the\t case  of  civil<br \/>\n\t       proceedings, on\tthe date<br \/>\n\t       on which\t the  plaint  is<br \/>\n\t       presented or, as the case<br \/>\n\t       may be, an application is<br \/>\n\t       made, to a civil court.<br \/>\n     Note:- As\tsoon as\t proceedings  of<br \/>\n\t  the nature referred to in this<br \/>\n\t  article  are\t instituted  the<br \/>\n\t  authority   which   institutes<br \/>\n\t  such proceedings shall without<br \/>\n\t  delay intimate the fact to the<br \/>\n\t  Audit Officer concerned.&#8221;<\/p><\/blockquote>\n<p>     A reading\tthereof clearly\t indicates that the Governor<br \/>\nreserves to  himself the  power and  right  to\twithhold  or<br \/>\nwithdraw pension  or a\tpart thereof, whether permanently or<br \/>\nfor a  specified period.  Equally, he  has  right  to  order<br \/>\nrecovery from  pension of the whole or part of any pecuniary<br \/>\nloss caused to Government when it is found in a departmental<br \/>\nor judicial  proceedings that  the delinquent  was guilty of<br \/>\ngrave  misconduct  or  has  caused  pecuniary  loss  to\t the<br \/>\nGovernment by  his misconduct  or negligence  while  he\t was<br \/>\ncontinuing in  service\tincluding  the\tperiod\tof  his\t re-<br \/>\nemployment after  retirement. But  the conditions  precedent<br \/>\nare that  the departmental  proceedings should\tbe initiated<br \/>\nonly either  before retirement\tor during  re-employment and<br \/>\nthe same  shall not  be instituted  without the sanction  of<br \/>\nthe Governor.  It should be in respect of an event which may<br \/>\nhave  taken   place  not   more\t than  4  years\t before\t the<br \/>\ninstitution of such proceedings.\n<\/p>\n<p>     Explanation to the rule purports to give the meaning to<br \/>\nthe words  &#8216;commencement of  departmental  proceedings&#8217;.  It<br \/>\nsays that  departmental proceedings  shall be deemed to have<br \/>\nbeen  instituted   when\t the   charges\tframed\tagainst\t the<br \/>\npensioner are  issued to  him, or  if the  officer has\tbeen<br \/>\nplaced under suspension from an earlier date, from such date<br \/>\nthe date  of suspension\t and the proceedings shall be deemed<br \/>\nto have been instituted in the case of criminal proceedings,<br \/>\non the\tdate on which complaint is made or a charge-sheet is<br \/>\nsubmitted to  a criminal  court; and  in the  case of  civil<br \/>\nproceedings, on\t the date  on which  the plaint is presented<br \/>\nor, as\tthe case may be, an application is made to the civil<br \/>\nCourt. As  soon as the proceedings of the nature referred in<br \/>\nthe articles  are instituted, the authority which institutes<br \/>\nsuch proceedings  shall without\t delay intimate\t the fact to<br \/>\nthe audit officer of the concerned.\n<\/p>\n<p>     It would  thus be seen that proceedings are required to<br \/>\nbe  instituted\t against   a   delinquent   officer   before<br \/>\nretirement. There  is no  specific  provision  allowing\t the<br \/>\nofficer to continue in service nor any order passed to allow<br \/>\nhim  to\t continue  on  re-employment  till  the\t enquiry  is<br \/>\ncompleted, without  allowing him  to  retire  from  service.<br \/>\nEqually, there\tis no  provision  that\tthe  proceedings  be<br \/>\ninitiated as  disciplinary measure  and the action initiated<br \/>\nearlier would remain unabated after retirement. If Rule 351-<br \/>\nA is  to be  operative in respect of pending proceedings, by<br \/>\nnecessary implication,\tprior sanction\tof the\tGovernor  to<br \/>\ncontinue the  proceedings against  him is  required. On\t the<br \/>\nother hand, the rule also would indicate that if the officer<br \/>\ncaused pecuniary  loss or committed embezzlement etc. due to<br \/>\nmisconduct  or\tnegligence  or\tdereliction  of\t duty,\tthen<br \/>\nproceedings  should  also  be  instituted  after  retirement<br \/>\nagainst the  officer as\t expeditiously as  possible. But the<br \/>\nevents of  misconduct etc.  which may  have resulted  in the<br \/>\nloss to\t the Government or embezzlement, i.e., the cause for<br \/>\nthe institution\t of proceedings, should not have taken place<br \/>\nmore than  four years  before the  date\t of  institution  of<br \/>\nproceedings. In\t other words,  the departmental\t proceedings<br \/>\nmust be\t instituted before lapse of four years from the date<br \/>\non which  the event  of misconduct  etc.  had  taken  place.<br \/>\nAdmittedly, in\tthis case  the officer\thad retired on March<br \/>\n31, 1987  and the  proceedings were  initiated on  April 21,<br \/>\n1991. Obviously,  the event  of\t embezzlement  which  caused<br \/>\npecuniary loss\tto the\tState took place prior to four years<br \/>\nfrom the  date of his retirement. Under these circumstances,<br \/>\nthe State  had disabled itself by their deliberate omissions<br \/>\nto  take  appropriate  action  against\tthe  respondent\t and<br \/>\nallowed the  officer to\t escape from  the provisions of Rule<br \/>\n351-A of  the Rules. This order does not preclude proceeding<br \/>\nwith the  investigation into  the offence  and taking action<br \/>\nthereon.\n<\/p>\n<p>     The appeal is accordingly dismissed.
