1.\t\tThe
\n  basis of the present petition is  non-implementation of the order
\ndated 11.5.2009 passed by this court in Special Civil  Application
\nNo.3746 of 2009 and allied matters.\n<\/p>\n
2.\t\tThis
\ncourt, after hearing both the sides, had  passed order on 19.7.2010
\nas under:\n<\/p>\n
“Leave
\n\tto correct the cause title of respondent Nos. 2 and  3.\n<\/p>\n
It
\n\tis undisputed position that the Division Bench of this Court vide
\n\torder dated 09.07.2010 in LPA No. 646\/10 with CA No.3411\/10 has
\n\tgranted stay qua the appointment made after 1989 and therefore, the
\n\tcase of the petitioner would not stand covered since the appointment
\n\tas per the petitioner is prior to 1989.\n<\/p>\n
At
\n\tthis stage, Mr.Pandya, learned AGP states that the order of the
\n\tlearned Single Judge dated 11.05.2009 qua the petitioner shall be
\n\tcomplied with including that of making calculation and disbursement
\n\tof the amount within a period of 2 months from the today with
\n\tinterest at the rate of 8% p.a. from the date on which the
\n\tpetitioner was entitled as per the order of the learned Single Judge
\n\ttill payment is made.  He further states under the instruction of
\n\tShri Sunil Soni, Under Secretary, Health Department that if this
\n\tCourt finds it proper, interest may be recovered from the salary of
\n\tthe erring officer.\n<\/p>\n
Keeping
\n\taside the aspects of ordering recovery from the salary of the erring
\n\tofficer for the present, it is directed that the monetary benefits
\n\tof the pay-scale as ordered by the learned Single Judge vide order
\n\tdated 11.05.2009 shall be paid to the petitioner within a period of
\n\t2 months as declared before this Court, failing which, the
\n\trespondent No.3 shall remain personally present.  S.O. to
\n\t20.09.2010.”\n<\/p>\n
Thereafter,
\ntime was also taken and ultimately, on 18.10.2010, following order
\nwas passed:\n<\/p>\n
\t“It
\nappears that in spite of the earlier direction issued by this court
\nvide order dated 19.7.2010, the payment has not been made.\n<\/p>\n
\tMr Mahesh
\nSoni, Deputy Secretary and In-charge Joint Secretary, Health and
\nFamily Welfare Department states that the proposal is yet to be
\nforwarded.\n<\/p>\n
\tWe find that
\nsuch non-compliance would also further aggravate the contempt. It may
\nbe recorded that  earlier direction is also issued to the Secretary,
\nFinance Department.  Therefore, it will be  the duty of both the
\nrespondent Nos. 1 and 2 to comply with the order.\n<\/p>\n
\tS.O.\n<\/p>\n
 to 21st October,
\n2010.  Secretary, Health & Family Welfare Department is directed
\nto remain personally present on that day as to why action should not
\nbe taken.  Mr Soni, Deputy Secretary shall communicate this order.”\n<\/p>\n
3.\t\tToday,
\npursuant to the earlier order passed by this court, Mr  Rajesh
\nKishor, Principal Secretary, Health & Family Welfare Department,
\nGovernment of Gujarat is present and affidavit-in-reply has been
\nfiled whereby apart from tendering unconditional apology, it has been
\ninter alia stated
\n that vide Government Resolution dated  20th
\nOctober, 2010, the amount is sanctioned and copy of the said
\nResolution
\nis produced on record.\n<\/p>\n
4.\t\tMr P K Jani,
\nlearned Government Pleader submits that, upon undergoing certain
\nformalities by the petitioner and other similarly situated persons of
\nfurnishing details, the amount shall be disbursed.  Mr B.S.
\nBrahmbhatt, learned Advocate for the petitioner states that all the
\nrespective petitioners shall submit the details within two weeks.\n<\/p>\n
5.\t\tIn above view
\nof the matter, the petitioner shall furnish the details within two
\nweeks from today and the said details shall be verified and upon such
\ndetails were found  genuine, the amount shall be disbursed.  The
\nprocess  of the  verification and the disbursement shall be completed
\nwithin four weeks from the date of submission of the details.\n<\/p>\n
6.\t\tIn
\nview of the above, the present proceedings would no more survive.
\nMisc. Civil Application  is disposed of accordingly with liberty to
\nthe  petitioner, in the event of any of the directions is not
\ncomplied with.  Notice is discharged.\n<\/p>\n
