JUSTICE AJAI LAMBA\n\n\nPRESENT: -       Mr. Vivek Sethi,              Advocate,      for\n                 the petitioner.\n\n\n\n                            .     .      .\n\nAJAI LAMBA, J (Oral)\n\n<\/pre>\n<p>                 This civil writ petition has been<\/p>\n<p>filed under Article 226\/227 of the Constitution<\/p>\n<p>of India praying for issuance of a writ in the<\/p>\n<p>nature of mandamus, directing the respondents to<\/p>\n<p>decide   representation           dated      3.7.2008    (Annexure<\/p>\n<p>P-7) within a time bound period.\n<\/p>\n<p>                 On    going      through      the    petition,     I<\/p>\n<p>find   that    without    laying         proper    foundation     in<\/p>\n<p>regard to prima facie right of the petitioner,<\/p>\n<p>the prayer has been made.\n<\/p>\n<p>                 The facts, as pleaded, are that the<\/p>\n<p>petitioner     was     recruited      as      Field   Officer     in<br \/>\n CWP No.12810 of 2009                                       [2]<\/p>\n<p>Punjab Films and News Corporation in the year<\/p>\n<p>1979. The said Corporation was wound up in 1992.<\/p>\n<p>The     petitioner           was       offered      either         `golden<\/p>\n<p>handshake or absorption in some other Government<\/p>\n<p>department&#8217;.           The      petitioner       preferred         to   be<\/p>\n<p>absorbed in Government department. The petitioner<\/p>\n<p>claims that he having passed M.A. in History and<\/p>\n<p>possessing       a       Post    Graduate      Diploma      in     Public<\/p>\n<p>Relations, was entitled to a post commensurate to<\/p>\n<p>his qualification.\n<\/p>\n<p>                     Be that as it may, the petitioner<\/p>\n<p>was    given     offer          of     absorption     in         Transport<\/p>\n<p>Department on the post of Clerk w.e.f. 9.4.1992.<\/p>\n<p>It seems that the petitioner accepted the said<\/p>\n<p>offer and is working continuously since then in<\/p>\n<p>Transport Department.\n<\/p>\n<p>                     It has been pleaded that this Court<\/p>\n<p>while dealing with Civil Writ Petition No.17266<\/p>\n<p>of    1995   had         directed      the    respondent-State          to<\/p>\n<p>absorb the persons working in the Scheme that was<\/p>\n<p>under consideration of the Court in that case, on<\/p>\n<p>suitable        posts            commensurate         with          their<\/p>\n<p>qualifications which they possessed at the time<\/p>\n<p>of their retrenchment.\n<\/p>\n<p>                     I          find         that     the           first<\/p>\n<p>representation made by the petitioner is Annexure<\/p>\n<p>P-5 dated 13.7.2004. It thus transpires that the<br \/>\n CWP No.12810 of 2009                                      [3]<\/p>\n<p>petitioner was satisfied with his absorption on<\/p>\n<p>the post of Clerk for 12 years whereafter the<\/p>\n<p>representation was filed.\n<\/p>\n<p>                      Learned counsel has not been able<\/p>\n<p>to show that the petitioner accepted absorption<\/p>\n<p>on     the     post    of    Clerk       under       protest     or    had<\/p>\n<p>protested within a reasonable period of time. The<\/p>\n<p>petition        suffers     from       delay    and    latches.        Such<\/p>\n<p>being       the    position,       I    do     not    find      that   the<\/p>\n<p>petitioner, prima facie, has any right to invoke<\/p>\n<p>the writ jurisdiction.\n<\/p>\n<p>                      The petition is dismissed.<\/p>\n<pre>\n\n                                                         (AJAI LAMBA)\nAugust 21, 2009                                            JUDGE\navin\n\n\n\n\n<\/pre>\n<p>1.
