The first order<br \/>\n\twas passed on 22nd February 1996 by this Court (Coram :<br \/>\n\tHon&#8217;ble Mr.Justice Rajesh Balia). The order is as under :\n<\/p>\n<p>\u00fdSRule<br \/>\nreturnable on 15.3.96. Meanwhile, operation of order dated 1.2.96<br \/>\nshall remain stayed.  Direct Service permitted.\u00fd\u00fd<\/p>\n<p>It<br \/>\n\tis unfortunate that though the Rule was made returnable on 15th<br \/>\n\tMarch 1996, the matter has remained pending till date and the order<br \/>\n\tdated 01st February 1996 has remained stayed all these<br \/>\n\tdays. In view of that, to allow the operation of order dated 01st<br \/>\n\tFebruary 1996 will not be justified by any far stretched reasons<br \/>\n\talso. Only on the ground that the<br \/>\n\tauthorities have not taken any steps to get the stay granted against<br \/>\n\torder dated 01st February 1996 vacated, the petition is<br \/>\n\tallowed.  Order dated 01st February 1996 is<br \/>\n\tquashed and set aside only on the short ground of delay and latches<br \/>\n\tin getting the stay order not vacated.\n<\/p>\n<p>At<br \/>\n\tthe request of Ms.Krina Calla, learned Assistant Government Pleader,<br \/>\n\tit is clarified that quashing of order dated 01st<br \/>\n\tFebruary 1996 does not preclude the authorities from taking<br \/>\n\tappropriate action against the school, if there are subsisting<br \/>\n\treasons.\n<\/p>\n<p>At<br \/>\n\tthe request of Mr.Niral Mehta, learned advocate appearing for<br \/>\n\tpetitioner, it is also clarified that the observations made<br \/>\n\thereinabove will not be construed to mean that the Court wants the<br \/>\n\tauthorities to take any action against the school, if otherwise not<br \/>\n\twarranted.\n<\/p>\n<p>With<br \/>\n\tthese observations, the petition is allowed. Rule is made absolute<br \/>\n\twith no order as to costs.\n<\/p>\n<p>(Ravi<br \/>\nR.
