The facts in brief are that, the \n\nhelper in tea shop. "_"_v\u00bbQn,d'aec0unt of the injuries sustained in the\n\n  appellant. filed the Claim petition before the\n\n '"E'i'i-t_)nuna1, seeking Con;Znsat.ion of Rs.O5.00 lakhs\n\n!\n\nL\n\n\n\nagainst the respondents. The said claim petition had<\/pre>\n
come up for Consideration before the Tribunal on 19″‘
\nSeptember 2005. The Tribunal, after considering the<\/p>\n
relevant material available on file and after appreCi_a~t_io1i<\/p>\n
of oral and documentary evidence, <\/p>\n
petition in part, awarding a sum’ of  <\/p>\n
interest at 8% per annum, from the ~r;latfe._o’f <\/p>\n
the date of deposit.  aggriev.e_dl’l.:Vb\u00a7i._:”t\u00bbhe*’; said-if<\/p>\n

 V .not:VaW.aii’ding any eompensation towards loss of future<\/p>\n
ineorne.  though the Doctor has assessed the<\/p>\n
 disabivllity in respect of the whole body at 24%. Further,<\/p>\n
 hesubmitted that, no compensation is awarded towards<\/p>\n
loss of income during treatment period and that the<\/p>\n
compensation awarded towards loss of arnenities.
\nmedical expenses a.nd conveyance, nourishing food and<\/p>\n
attendant charges is also on the lower side. Therepfore,<\/p>\n
he submitted that the impugned <\/p>\n
passed by the Tribunal is liable  <\/p>\n
accordingly.\n<\/p>\n

” We have heard the learned counsel for<\/p>\n
 appella.nt and learned unsel for Insurance Company.<\/p>\n

7. After hearing the leai-med counsel for the
\nparties and after going through the original records
\navailable on file, the only point that arises for our
\nconsideration is as to:\n<\/p>\n
“Whether the compensation awarded  _._ if <\/p>\n
Tribunal tsjust and reasonable ?\n<\/p>\n
It is not in dispute that on accou”‘maof the it<\/p>\n
occurred on 20–l2–2003, the  <\/p>\n
frontal EDH and AC?’ haae’~..fracture’ <\/p>\n
comp,oundf”‘frQntalV delpresseri fracture! laceration over
\neye lid,’ uabrasion~-.ovei’–.___r’i’ght side of forehead, abrasion<\/p>\n
over’ the right forearm near the wrist, lacerated Wound<\/p>\n
 over puosterioi” aspect of left forearm, moderate head<\/p>\n
  first instance, he was inpatient in MS.<\/p>\n
Ramaiafi -ll’-.:I’*’ospii.a11, shifted to Nil\\\/[HANS and thereafter to<\/p>\n
 Victoria’. Hospital. The Doctor has assessed the<\/p>\n
‘ .perri\u00a7anent disability at l6% in respect of right eye, -4.9\/o<\/p>\n
“____M____W__M_.,_..\u00bb<\/p>\n
 -~~in respect of left eye aid 4% in respect of decreased<\/p>\n
:\n<\/p>\n

J<\/p>\n
sleep and irritability, arriving at the total permanent
\ndisability” in respect of whole body at 24%. Thisaspect<\/p>\n
of the matter has not been considered iiillq\ufb01roper<\/p>\n
perspective by the Tribunal. Undoubtedly’; <\/p>\n
of the disability, the appe1lar3’t”‘has ato   of l<\/p>\n
income in future. The Tribun__al–_Vhas ‘erred’.i1:1.7nVot_u<\/p>\n
awarding any amount towards. loss’–oi”vvfu’::ure income. V<\/p>\n
The total body disability asses’s–.edlV–byA Doctor appears to
\nbe little exaggerated.   the facts and<\/p>\n
circumstances”\u00aby:.o:f’ the Ca–se,”‘w.e–:_”assess the total body<\/p>\n
disabiillity   taking the monthly
\nincome. of .\u00bbat Rs.3,000\/~, adopting the<\/p>\n
correct rriultiplie.r   and total body disability at<\/p>\n
  we award ‘a’f”sun1 of Rs.86,400\/– {i.e. Rs.3,000\/M x<\/p>\n
    11.00] towards loss of future income.<\/p>\n
8.  Tribunal has erred in awarding a sum of<\/p>\n
 Rs.u10,tGQO\/- towards loss of amenities, without taking<\/p>\n

to MS. Ramaiah Hospitai, NIMHANS and there\u00e9i,:t’t’c>r t.o<\/p>\n
Victoria Hospital, totally for more than a  <\/p>\n
Doctor has assessed the permanent  .24’fc$.. <\/p>\n
which the appellant has to endtgre <\/p>\n
life. Therefore, having regard t.o’7a.1I”these”as,peet_s, <\/p>\n
deem it fit to award a sum  litowfards loss
\nof amenities on aeeiourit  “”dis’abiiity as against
\nRs. 10,000 \/ – awarded.AbyhTribL1r;a1’iix’; 1 ” <\/p>\n
 The  erred in awarding only a sum<\/p>\n
of Rs.8,t”)O(i\/’\u00ab Vtowardsexmedical expenses, conveyance,<\/p>\n
 1’10:1_iYiE\u00a7-hiilg foo’d;v~–and attendant charges. The same is<\/p>\n
 ivnac\u00a5eq.1,iat,e~having regard to the nature of injuries<\/p>\n
sustained-‘i.a;nd the duration and nature of treatment<\/p>\n
 undergone by appellant. Therefore. we award a sum of<\/p>\n
 Rs.43_\u00ab3.O0O\/– towa1’ds medical expenses and conveyance.<\/p>\n
  nourishing food and at\u00e9fndant charges.<\/p>\n

10. Further. the Tribunal has erred in not
\nawarding any amount towards loss of income during the<\/p>\n
period of treatment. Admittedly, the appel1ant..’w_as_V_inv<\/p>\n

Rs.3,000\/-, we award a sum  <\/p>\n
of income during the period ofpptreatmlent.  it  <\/p>\n
