Justice A.K.BASHEER\n\n Dated :17\/09\/2008\n\n O R D E R\n                   H.L.Dattu, C.J. &amp; A.K.Basheer, J.\n                  ----------------------------------------------\n                       W.P.(C).No.27422 of 2008-S\n                  ----------------------------------------------\n                Dated, this the 17th day of September, 2008\n\n                                JUDGMENT\n<\/pre>\n<p>H.L.Dattu,C.J.\n<\/p>\n<p>               Sri.A.K.Jayasankar, learned counsel, takes notice for the<\/p>\n<p>2nd respondent.\n<\/p>\n<p>               (2) In our view, for the disposal of this writ petition, the<\/p>\n<p>2nd respondent is only the contesting respondent.<\/p>\n<p>               (3) The petitioner is an organization, having its Regional<\/p>\n<p>Office at North Paravur. Petitioner claims that it is engaged in<\/p>\n<p>co-ordinating and safeguarding the interest of every family of each<\/p>\n<p>members of the association.\n<\/p>\n<p>               (4) In the writ petition, it is stated that the 5th respondent<\/p>\n<p>was supplying gas cylinders to the consumers in North Paravur<\/p>\n<p>Municipality and Chennamangalam and Ezhikkara Panchayats. It is the<\/p>\n<p>further grievance of the petitioner, that, the said gas agency has closed<\/p>\n<p>down its business and the 2nd respondent has directed all the consumers<\/p>\n<p>to get supply of gas cylinders from the 6th respondent, whose business<\/p>\n<p>premises is situated at least 13 kilometers away from the 5th respondent&#8217;s<\/p>\n<p>business premises.\n<\/p>\n<p>               (5) In the writ petition that is filed in the style of &#8220;public<\/p>\n<p>interest litigation&#8221;, the petitioner seeks a direction to the 2nd respondent<\/p>\n<p>W.P(C).No.27422 of 2008-S\n<\/p>\n<p>                                           &#8211; 2 &#8211;\n<\/p>\n<p>to make alternative arrangements for supply of gas cylinders to the<\/p>\n<p>consumers      of   North    Paravur     Municipality and Ezhikkara         and<\/p>\n<p>Chennamangalam Panchayats.\n<\/p>\n<p>               (6) Sri.A.K.Jayasankar, learned counsel appearing for the<\/p>\n<p>2nd respondent, on instructions, would submit, that, appropriate<\/p>\n<p>arrangements will be made for supply of gas cylinders to the consumers,<\/p>\n<p>whose needs was catered by the 5th respondent till it closed down its<\/p>\n<p>business, within three weeks from today.\n<\/p>\n<p>               (7) In view of the submission made by Sri.A.K.Jayasankar,<\/p>\n<p>learned counsel appearing for the 2nd respondent, it may not be necessary<\/p>\n<p>for us, at this stage, to issue a direction as is sought for by the petitioner in<\/p>\n<p>the writ petition.\n<\/p>\n<p>               (8) Accordingly, placing on record the submission made by<\/p>\n<p>Sri.A.K.Jayasankar, learned counsel appearing for the 2nd respondent, this<\/p>\n<p>writ petition is disposed of.\n<\/p>\n<p>               Ordered accordingly.<\/p>\n<pre>\n\n\n\n                                                      H.L.Dattu\n                                                     Chief Justice\n\n\n\n\n                                                     A.K.Basheer\nvku\/dk                                                   Judge\n\n<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court The Mekhala Committee vs District Collector on 17 September, 2008 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 27422 of 2008(S) 1.
