No.5358 of 2007 (K)\n              ---------------------------------\n             Dated, this the 17th day of August, 2010\n\n                           J U D G M E N T\n<\/pre>\n<p>      According to the petitioner, she is working as Part Time<\/p>\n<p>Sweeper in the Veterinary Dispensary at Panthadivila, Manamboor in<\/p>\n<p>Thiruvananthapuram District since 01\/09\/2002.             In this writ<\/p>\n<p>petition, what is claimed by the petitioner is the benefit of<\/p>\n<p>regularisation in terms of the provisions contained in GO(P)<\/p>\n<p>No.501\/2005\/Fin. dated 25\/11\/2005, pointing out the fact that<\/p>\n<p>even going by the averments in the counter affidavit, the sweeping<\/p>\n<p>area is more than 100 sq.m.\n<\/p>\n<p>      2.    If as stated by the petitioner, she is entitled to the<\/p>\n<p>benefit of regularistion in terms of the Government Order referred<\/p>\n<p>to above, there is no reason why the Authorities shall not initiate<\/p>\n<p>necessary action as provided in the Government Order referred to<\/p>\n<p>above and in the light of the subsequent clarifications.<\/p>\n<p>      3.    Therefore, I direct the 3rd respondent to get the sweeping<\/p>\n<p>area measured in terms of the guidelines laid down in GO(P)<\/p>\n<p>WP(C) No.5358\/2007<br \/>\n<span class=\"hidden_text\">                                    -2-<\/span><\/p>\n<p>No.501\/2005\/Fin. dated 25\/11\/2005 and on that basis submit a<\/p>\n<p>proposal to the 2nd respondent for onward transmission to the 1st<\/p>\n<p>respondent for obtaining orders on the claim of the petitioner for<\/p>\n<p>regularisation of her services as a Part Time Sweeper in the<\/p>\n<p>Veterinary Dispensary, where she is working.<\/p>\n<p>     4.     The petitioner shall produce a copy of this judgment<\/p>\n<p>before the 3rd respondent, who shall initiate necessary action in this<\/p>\n<p>regard, that if the petitioner is eligible, the proposal shall be<\/p>\n<p>submitted as expeditiously as possible, at any rate, within four<\/p>\n<p>weeks of production of a copy of this judgment, and the 2nd<\/p>\n<p>respondent shall place the matter before the 1st respondent without<\/p>\n<p>any delay and the 1st respondent shall pass orders thereon as<\/p>\n<p>expeditiously as possible, at any rate, within three months of its<\/p>\n<p>receipt.\n<\/p>\n<p>     It is also directed that until the aforesaid process is completed,<\/p>\n<p>the petitioner is entitled to have the benefit of interim order dated<\/p>\n<p>19\/02\/2007 staying the termination of the petitioner&#8217;s service.<\/p>\n<p>     This writ petition is disposed of as above.\n<\/p>\n<\/p>\n<p>                                    (ANTONY DOMINIC, JUDGE)<br \/>\njg<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Kerala High Court Lathika.G vs The State Of Kerala on 17 August, 2010 IN THE HIGH COURT OF KERALA AT ERNAKULAM WP(C).No. 5358 of 2007(K) 1.
