BASANT, J.\n\n              -------------------------------------------------\n\n                 B.A. NOs. 4047 &amp; 4054 OF  2007\n\n              -------------------------------------------------\n\n              Dated this the  12th    day of July, 2007\n\n\n\n                                 ORDER\n<\/pre>\n<p>      Applications for anticipatory bail.     The petitioners are a<\/p>\n<p>former Controller of Examinations and an Examiner with whom<\/p>\n<p>the work of revaluation was entrusted by the University.   The<\/p>\n<p>crux   of   the   allegations   is   that   there   has   been   fraudulent<\/p>\n<p>manipulations   in   the   revaluation   of   answer   scripts     to   oblige<\/p>\n<p>certain candidates who off springs of  influential persons.   It is<\/p>\n<p>alleged   that   the   Controller   of   Examinations   with   deliberate<\/p>\n<p>design, contrary to the Rules, forwarded the answer scripts for<\/p>\n<p>revaluation   to     the   persons   not   included   in   the   panel   with<\/p>\n<p>fraudulent   intention.     It   is   further   alleged   that   the   answers<\/p>\n<p>concerned were altered and manipulated to  facilitate award of<\/p>\n<p>convenient   marks   to   the   candidates.       One   more   Examiner<\/p>\n<p>faces   similar   allegations   in   the   crime.       That   Examiner   has<\/p>\n<p>already been questioned.   She has not been arrested.\n<\/p>\n<p><span class=\"hidden_text\"> B.A. NOs. 4047 &amp; 4054 OF  2007         -: 2 :-<\/span><\/p>\n<p>       2.    The learned counsel for the petitioners submit that the<\/p>\n<p>petitioners   are   absolutely  innocent   and   that   the   allegations   are<\/p>\n<p>raised   against   them   without   any   bona   fide.     They   apprehend<\/p>\n<p>imminent arrest.\n<\/p>\n<p>       3.   The learned Public Prosecutor, after taking instructions,<\/p>\n<p>submits   that   the   Investigator   has   no   intention   of   immediately<\/p>\n<p>arresting   the   petitioners   at   all.       As   in   the   case   of   the   other<\/p>\n<p>Examiner,   the   petitioners   will   have   to   be   questioned.       The<\/p>\n<p>Investigator   will   take   a   decision   on   the   question   whether   they<\/p>\n<p>are to be arrested or not only after obtaining the report from the<\/p>\n<p>handwriting   expert   of   the   Forensic   Science   Laboratory.       Till<\/p>\n<p>then, the petitioners shall not be arrested, it is submitted.    It is<\/p>\n<p>further   submitted   that   the   petitioners   may   be   directed   to   co-\n<\/p>\n<p>operate   with   the   Investigators   for   the   early   completion   of   the<\/p>\n<p>investigation   in   the   matter.       The   learned   counsel   for   both   the<\/p>\n<p>petitioners submit that the petitioners shall  co-operate  with the<\/p>\n<p>Investigators.       They   shall   appear   before   the  Investigating<\/p>\n<p>Officers as and when directed by the  Investigating  Officer  in<\/p>\n<p>writing   to   do   so   for   examination\/   interrogation,   it   is<\/p>\n<p>submitted.\n<\/p>\n<p>       4.   In these circumstances, I am satisfied that it is not<\/p>\n<p><span class=\"hidden_text\"> B.A. NOs. 4047 &amp; 4054 OF  2007      -: 3 :-<\/span><\/p>\n<p>necessary   to   issue   any   directions   under   Sec.438   of   the<\/p>\n<p>Cr.P.C. now.  I accept the submissions of the learned Public<\/p>\n<p>Prosecutor   that   the   petitioners   shall   not   be   arrested   until<\/p>\n<p>the   report   is   obtained   from   the   expert   of   the   Forensic<\/p>\n<p>Science Laboratory.  When they are required to be arrested<\/p>\n<p>also, notice shall be issued to them specifying the purpose.\n<\/p>\n<p>      5.   These   petitions   are,   in   these   circumstances,<\/p>\n<p>dismissed with the direction that the petitioners shall make<\/p>\n<p>themselves   available   for   interrogation   before   the<\/p>\n<p>Investigating   Officer   as   and   when   directed   by   the<\/p>\n<p>Investigating Officer in writing to do so.\n<\/p>\n<p>      6. Hand over a copy of this order to the learned counsel for<\/p>\n<p>the petitioners.\n<\/p>\n<p>                                                                 Sd\/-\n<\/p>\n<p>                                                     (R.
