Khalil,\n                 resident of Village Umari Lakhnaour, P.S. -\n                 District Madhubani...............................Respondents\n                                   -----------\n<\/pre>\n<p>2   28.06.2011         Heard   learned   counsel   for   the<\/p>\n<p>                 petitioner as well as learned counsel for<\/p>\n<p>                 the State.\n<\/p>\n<p>                       Petitioner claims for a direction to<\/p>\n<p>                 the respondents to appoint him as Physical<\/p>\n<p>                 Trained Teacher on the basis of his ranking<\/p>\n<p>                 in the provisional panel as contained in<\/p>\n<p>                 Annexure-3.\n<\/p>\n<p>                       However, in the counter affidavit it<\/p>\n<p>                 is stated that after the provisional panel<\/p>\n<p>                 was prepared and notice was issued in the<\/p>\n<p>                 newspaper for the candidates to appear in<\/p>\n<p>                 the counselling for preparation of final<\/p>\n<p>                 panel, petitioner did not   appear in the<\/p>\n<p>                 counselling pursuant to the notice issued<\/p>\n<p>                 in the newspaper. Hence, in the final list,<br \/>\n<span class=\"hidden_text\">                   2<\/span><\/p>\n<p>     name of the petitioner was not included.<\/p>\n<p>     This fact is not denied by the petitioner.<\/p>\n<p>           In the circumstance, this Court does<\/p>\n<p>     not find any merit in this application. The<\/p>\n<p>     same is dismissed.\n<\/p>\n<\/p>\n<p>                      (J. N.
