He has therefore contacted<br \/>\n\tLegal Aid Committee of this Court, who allotted the present advocate<br \/>\n\tto file the above-numbered appeal. Therefore, considerable time has<br \/>\n\tconsumed in preferring the criminal appeal.  It is, therefore,<br \/>\n\tprayed that the delay may be condoned.\n<\/p>\n<p>Having<br \/>\n\theard Mr.R.H.Kapadia, learned advocate for the applicant, appointed<br \/>\n\tby Legal Aid Committee, Gujarat High Court and Mr.L.B.Dabhi,<br \/>\n\tlearned APP, for the respondent &#8211; State of Gujarat, and on<br \/>\n\tpersual of the averments made in the application, which have<br \/>\n\tremained uncontroverted  and considering the celebrated principles<br \/>\n\tgoverning the discretionary exercise of power conferred under<br \/>\n\tSection 5 of the Act, so also  the reported decisions of the Hon&#8217;ble<br \/>\n\tSupreme Court construing Section 5 of the Act liberally, we are of<br \/>\n\tthe considered opinion that delay caused in filing the appeal has<br \/>\n\tbeen aptly and sufficiently explained. The record does not indicate<br \/>\n\tthat there was inaction or negligence on the part of the applicant<br \/>\n\tin prosecuting the appeal. The applicant has never abandoned the<br \/>\n\tlis. The explanation offered for condonation of delay is not only<br \/>\n\tplausible, but acceptable. In the aforesaid view of the matter,<br \/>\n\tsince delay has been sufficiently explained, application deserves to<br \/>\n\tbe allowed by condoning the delay as prayed for.\n<\/p>\n<p>For<br \/>\n\tthe foregoing reasons, the application succeeds and accordingly it<br \/>\n\tis allowed. Delay of 75 days caused in filing the appeal is<br \/>\n\tcondoned.
