drawing the salary of ?4,500\/– per  <\/p>\n
the welfare of the family and his  they ” d<\/p>\n

 Corporation has presented this appeal, for<\/p>\n

4. We have heard ieariiedly-ceii’nsel appearing<\/p>\n
for the Corporation -‘Ll-andglearned counsel for claimants.
\n  of the material available on<\/p>\n
record at\u00abthreadbare;.:inol’ud*ing the impugned judgment<\/p>\n
and award passed hvlbylthes Tribunal, it emerges that, in<\/p>\n
the\ufb02fclaiinantswliave filed a claim petition under<\/p>\n
  M.V. Act. seeking compensation<\/p>\n
 _ against ighefiorporation on account of the death of the<\/p>\n
;doceaseCi*’..in the road traffic accident. To substantiate<\/p>\n
 claimants have produced the documentary<\/p>\n
T evidence like EX.P1–FIR, Ex.P2–Panchanarna, Ex.P3–<\/p>\n
U IMV Report, Ex.P4–Inquest report, Ex.P5–P.M.report and<\/p>\n
A\/\u00bb<\/p>\n
\/<\/p>\n
under section 166 of M.V. Act, having regard to<\/p>\n
genuineness of the claim, in View of the well settledtiavr<\/p>\n
laid down by the Apex Court and this of _<\/p>\n
judgments. Accordingly, exercising the power”1i.nde’r.:o’rder”‘*<\/p>\n
41 Rule 33 of CPC, we treat the:’,_petiticfn’\u00ab’as <\/p>\n
section 166 of 1VI.V. Act and re–d_etermine the rcvoinpensation <\/p>\n
under loss of dependency and conventionai\n<\/p>\n
7. It is not in dis-pyrite t_hat_vdeceas”e~d_ was aged about
\n21 years, working as welder.   the salary of<\/p>\n
    salary certificate. But<\/p>\n
the claimants _\u00bbI::’14’C’;”f,._p’4(\u00a7’.>.\u00bb.’._VE:d..IVi’li.I”1F.”\u00a2Ci the employer to prove the<\/p>\n
same. Therefore,  ail. these factors into consideration,<\/p>\n
 we re\ufb01jassess his ‘income at ?4,000\/- per month. Out of which,<\/p>\n
 ‘E”3()’:3\/o :..detit1,Vcted towards personal and living expenses of<\/p>\n
:the”tdece’a:s”_ed__  he was a bacheior at the time of his death,<\/p>\n
the net income comes to \u20ac2,000\/– per month. The appropriate<\/p>\n
W M ii  ..i’1\\:1u,1tip1ier”applicable to the case in hand is ‘I5’ instead of ‘i8’<\/p>\n
  adopted by the Tribunal, in View of the law laid down by<\/p>\n
  -tile Apex Court in Sarla VerIna’s case reported in 2009 ACJ<\/p>\n
