{"id":246244,"date":"2011-08-05T00:00:00","date_gmt":"2011-08-04T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/faraz-fatmi-vs-ashok-kumar-yadav-ors-on-5-august-2011-2"},"modified":"2017-04-01T16:54:55","modified_gmt":"2017-04-01T11:24:55","slug":"faraz-fatmi-vs-ashok-kumar-yadav-ors-on-5-august-2011-2","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/faraz-fatmi-vs-ashok-kumar-yadav-ors-on-5-august-2011-2","title":{"rendered":"Faraz Fatmi vs Ashok Kumar Yadav &amp; Ors on 5 August, 2011"},"content":{"rendered":"<div class=\"docsource_main\">Patna High Court &#8211; Orders<\/div>\n<div class=\"doc_title\">Faraz Fatmi vs Ashok Kumar Yadav &amp; Ors on 5 August, 2011<\/div>\n<pre>                  IN THE HIGH COURT OF JUDICATURE AT PATNA\n                                 E P No 3 of 2011\n                                   Faraz Fatmi\n                                      Versus\n                             Ashok Kumar Yadav &amp; Ors\n                                     -----------\n<\/pre>\n<p>10   05.08.2011                     Proposed issues have been filed on behalf of the<\/p>\n<p>                      Election petitioner and respondent No 1 who is the main contesting<\/p>\n<p>                      respondent.\n<\/p>\n<p>                                    Having heard the parties, in my view, the issues have to<\/p>\n<p>                      be reframed as under :\n<\/p>\n<blockquote><p>                                    (1)            Whether the election petition, as framed<\/p>\n<p>                                                   and filed, is maintainable in law.<\/p>\n<p>                                    (2)            Whether the pleadings in the election<\/p>\n<p>                                                   petition being vague and frivolous, the<\/p>\n<p>                                                   election petition is fit to be dismissed in<\/p>\n<p>                                                   terms of the principles enshrined in<\/p>\n<p>                                                   Order 7 Rule 11 of the Code of Civil<\/p>\n<p>                                                   Procedure.\n<\/p><\/blockquote>\n<blockquote><p>                                    (3)            Whether the election petition is fit to be<\/p>\n<p>                                                   dismissed in terms of Section 86 of the<\/p>\n<p>                                                   Representation of People&#8217;s Act, 1951<\/p>\n<p>                                                   for   non-compliance      of   mandatory<\/p>\n<p>                                                   provisions contained in Section 83 (1)<\/p>\n<\/blockquote>\n<blockquote><p>                                                   (a) and 83 (1) (c) read with Rule 94A of<\/p>\n<p>                                                   the Conduct of Election Rules, 1961.<\/p>\n<p>                                    (4)            Whether illegalities and irregularities<\/p>\n<p>                                                   have been committed in the process of<br \/>\n<span class=\"hidden_text\">                                   2<\/span><br \/>\n                                         counting of ballot papers, as alleged in<\/p>\n<p>                                         the election petition. If so, can it be said<\/p>\n<p>                                         that it has materially affected the results<\/p>\n<p>                                         of the election and if so whether it is a<\/p>\n<p>                                         case in which recounting be ordered and<\/p>\n<p>                                         results declared thereupon.<\/p>\n<\/blockquote>\n<p>                        List of documents have been furnished by both the<\/p>\n<p>          parties. Let the Registry call for the same.<\/p>\n<p>                        List of witnesses have been furnished by both the<\/p>\n<p>          parties. Mr Mangalam for the contesting respondent points out that<\/p>\n<p>          the election petitioner has submitted incomplete list of witnesses,<\/p>\n<p>          inasmuch as he has stated without giving name, parentage and other<\/p>\n<p>          details, that all counting agents be requisitioned.       This is highly<\/p>\n<p>          improbable.\n<\/p>\n<p>                        Let full particulars be supplied by 16th of August, 2011.<\/p>\n<p>                        Election petitioner is directed to file deposition as<\/p>\n<p>          examination-in-chief of his witnesses on affidavit after serving copy<\/p>\n<p>          on the other side within three weeks.\n<\/p>\n<p>                        The registry to put up this matter on the appropriate day<\/p>\n<p>          immediately after documents are received so that witnesses can be<\/p>\n<p>          summoned for cross-examination.\n<\/p>\n<\/p>\n<pre>M.E.H.\/                               (Navaniti Prasad Singh)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
