Of India Press on 24 November, 2009<\/div>\n<pre>        CENTRAL INFORMATION COMMISSION\n     Room No. 308, B-Wing, August Kranti Bhawan, Bhikaji Cama Place, New Delhi-110066\n\n\n                      File No.CIC\/WB\/A\/2008\/01200\/LS\n                  Dr. Vishnu Swarup Vs Govt. of India Press\n\n                                                   Dated : 24.11.2009\n       Vide this Commission's decision dated 27.2.2009, the CPIO\nwas directed to allow appellant Dr. Vishnu Sawrup to carry out the\ninspection of relevant records and also to provide him copies of\ncertain documents as per his request, in 04 weeks time. The appellant\nfiled a non-compliance complaint before this Commission. Hence,\nnotice was issued to the CPIO to explain why penal action should not\nbe taken against him.\n2.    Heard on 24.11.2009. Appellant not present. The public\nauthority is represented by Shri P.N. Srivastava, Manager, GIP,\nAligarh, holding additional charge of CPIO. He would submit that\nthe remaining information has since been provided to the appellant\nand produces letter dated 12.9.2009 of Shri Anil Kumar, Dy. Director\n(Admn) in this regard. This is perused\n                             DECISION\n3.     It is noted that the CPIO has taken about 08 months in\ncomplying with this Commission's order, as against the prescribed\ntime of one month. This is not approved of. This Commission would\nhave liked to proceed against the CPIO but, Shri Srivastava states that\nthe old CPIO has since been transferred out and he (Shri Srivastava)\nhas joined as CPIO only recently. He also pleads that it took quite\nsome time to retrieve the relevant documents from the Ministry of\nUrban Development.\n4.     The explanation given by Shri Srivastava is not entirely\nsatisfactory. However, since he has joined as CPIO only recently, he\ncan not be personally held responsible for the delay. In the given\nfacts it would be appropriate to 'reprimand' Shri S.R. Bhadra former\nCPIO, for delayed implementation of the Commission's order.\n5.
