Ad-interim<br \/>\n\trelief was granted in terms of paragraph 8 (C) of the petition.\n<\/p>\n<p>During<br \/>\n\tthe pendency of this petition, a settlement was arrived at between<br \/>\n\tthe parties.  Ms. Kiran D. Pandey, learned advocate appearing for<br \/>\n\tthe petitioner places a communication dated 12.07.2010 issued by Mr.<br \/>\n\tV. S. Hazare, Legal Adviser of the petitioner Corporation stating<br \/>\n\tthat if the respondent workman is prepared to forgo 50% of the<br \/>\n\tamount as per the award passed by the Industrial Tribunal, the<br \/>\n\tpetitioner Corporation is ready to settle the matter with the<br \/>\n\trespondent workman.  Pursuant to this communication, a letter dated<br \/>\n\t14.08.2010 is written by the respondent workman to the General<br \/>\n\tManager (Administration) wherein he has shown his willingness that<br \/>\n\tif the petitioner Corporation is agreeable to pay 50% of the awarded<br \/>\n\tamount and places this fact before the Court in a pending petition,<br \/>\n\the is ready to settle the issue.  Both these letters are taken on<br \/>\n\trecord.  Learned advocates appearing for the petitioner as well as<br \/>\n\trespondent are agreeable to the above settlement arrived at between<br \/>\n\tthe parties and if the award passed by the Labour Court is modified<br \/>\n\tin the above terms, the same is acceptable to the parties.\n<\/p>\n<p>In<br \/>\n\tthe above view of the matter, the award passed by the Industrial<br \/>\n\tTribunal on 09.09.2009 is modified to the above extent whereby the<br \/>\n\trespondent workman is eligible to 50% of the amount as indicated in<br \/>\n\tthe award of the Industrial Tribunal.\n<\/p>\n<p>This<br \/>\n\tpetition is accordingly disposed of.
