DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 24\/03\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p>Learned APP waives service of Rule.\n<\/p>\n<p>\tThis<br \/>\napplication is filed under Section 439 of the Code of Criminal<br \/>\nProcedure in connection with first information report registered at<br \/>\nC.R.No.I-16 of 2005 with Shamlaji police station for the offences<br \/>\npunishable under Sections 406, 408, 465, 467, 471A, 420, 120B and 114<br \/>\nof the Indian Penal Code.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties and perused the record.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case and considering the nature of<br \/>\nallegations and  role attributed to the applicant, and other<br \/>\nco-accused have already been enlarged on bail, on the ground of<br \/>\nparity,  without discussing the evidence in detail, prima facie, this<br \/>\nCourt is of the opinion that this is a fit case to exercise the<br \/>\ndiscretion to enlarge the applicant on bail.\n<\/p>\n<p>\tHence,<br \/>\nthe application is allowed and the applicant is ordered to be<br \/>\nreleased on bail in connection with  first information report<br \/>\nregistered at C.R.No.I-16 of 2005 with Shamlaji Police Station on his<br \/>\nexecuting a bond of Rs.5,000\/- (Rupees five thousand only) with one<br \/>\nsurety of the like amount to the satisfaction of the trial court and<br \/>\nsubject to the conditions that he shall<\/p>\n<p> i.\tnot<br \/>\ntake undue advantage of his liberty or misuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\this presence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10 a.m. And 3 p.m for three months only;\n<\/p>\n<p>furnish<br \/>\n\tthe present  address of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter. Bail bond to be executed before the lower court<br \/>\nhaving jurisdiction to try the case.\tAt the trial, the trial court<br \/>\nshall not be influenced by the observations of preliminary nature,<br \/>\nqua the evidence at this stage, made by this Court while enlarging<br \/>\nthe applicant on bail.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent.
