        The writ petition is filed seeking the<\/p>\n
following reliefs.\n<\/p>\n<\/p>\n
        i)   Call for the records relating to I.A<\/p>\n
No. 1123\/2008 in O.S No.85\/1999 of the Sub Court,<\/p>\n
Pala and set aside Ext.P6 order passed therein and<\/p>\n
allow the application for amendment.<\/p>\n
        ii)    Issue such   other  writ, order or<\/p>\n
direction which this Hon’ble Court deems fit in the<\/p>\n
nature and circumstances of the case.<\/p>\n

          2.     Petitioner is the plaintiff in O.S<\/p>\n
No.85\/1999 on the file of the Sub Court, Pala.<\/p>\n
Suit    is   one    for  partition    after   treating  a<\/p>\n
partition deed and also a sale deed as null and<\/p>\n
void.    When the suit came up in the list for trial,<\/p>\n
petitioner moved an application for carrying out<\/p>\n
some corrections in the plaint and also another<\/p>\n
petition for removal of the case from the list.<\/p>\n
Both petitions were dismissed.        An application for<\/p>\n
restoration of the suit moved before the trial<\/p>\n
court    not     being   entertained    the   petitioner,<\/p>\n
preferred an appeal.         In the appeal the order<\/p>\n
dismissing the suit for default was set aside<\/p>\n
directing       its restoration.         Pursuant to the<\/p>\n
restoration of the suit, petitioner moved another<\/p>\n
application for amendment of the plaint which was<\/p>\n
canvassed earlier before dismissal of the suit for<\/p>\n
default.    That application being objected to by the<\/p>\n
defendants, the learned Munsiff after hearing both<\/p>\n

sides     passed     Ext.P6  order    disallowing  that<\/p>\n
petition.      The amendment petition was disallowed<\/p>\n
for the reason that the decision in the earlier<\/p>\n
petition before the dismissal of the suit for<\/p>\n
default would constitute resjudicate barring the<\/p>\n
entertainabiltiy of the petition filed for that<\/p>\n
relief after restoration of the suit.         Propriety<\/p>\n
and correctness of that decision is challenged in<\/p>\n
the    writ     petition   invoking    the  supervisory<\/p>\n
jurisdiction vested with this court under Article<\/p>\n
227 of the Constitution of India.\n<\/p>\n<\/p>\n
          3.     I heard the learned counsel on both<\/p>\n
sides.     Reiterating the objections raised before<\/p>\n
the court below which was found appealing to the<\/p>\n
court below the learned counsel for the respondents<\/p>\n
submitted that Ext.P6 order does not call for any<\/p>\n
interference.       On the other hand learned counsel<\/p>\n
for    the    petitioner   submitted    that   a  fresh<\/p>\n

application was filed in view of the fact that the<\/p>\n
earlier    application    was   dismissed.     Challenge<\/p>\n
against the dismissal of the earlier application<\/p>\n
could not be pursued due to the dismissal of the<\/p>\n
suit for default.       After having heard the counsel<\/p>\n
on both sides and taking note of the facts and<\/p>\n
circumstances       presented,    I     find,  technical<\/p>\n
objections should not debar a party from claiming<\/p>\n
reliefs which are otherwise entertainable before a<\/p>\n
court     of     law.       After     all,   courts   as<\/p>\n
instrumentalities of justice, should        not  bar the<\/p>\n
relief on technical objections.             Procedure is<\/p>\n
after all handmaid of justice and it has to bend<\/p>\n
and    mould      depending   upon     the   facts   and<\/p>\n
circumstances involved in the case.          True, there<\/p>\n
was some delay on the part of the petitioner \/<\/p>\n
plaintiff in applying for the amendment.       But after<\/p>\n
going through the amendment application, I find<\/p>\n
what is sought for is only correction in the date<\/p>\n

and number of the deeds which probably might have<\/p>\n
occurred while drafting the plaint.        Having regard<\/p>\n
to the totality of the facts and circumstances<\/p>\n
presented, I find disallowing of the amendment<\/p>\n
application     in    view  of  the   dismissal  of  the<\/p>\n
previous application      may work out injustice.    The<\/p>\n
petitioner \/ plaintiff could have moved a review<\/p>\n
petition for annulling the order passed in the<\/p>\n
previous petition on restoration of the suit.        But<\/p>\n
for the reason that petitioner has filed a fresh<\/p>\n
petition without filing a review it cannot be taken<\/p>\n
as a circumstance to hold that the relief claimed<\/p>\n
is barred by resjudicate without appreciating and<\/p>\n
examining     the   circumstances   surrounding  in  the<\/p>\n
filing of the fresh petition.         So much so, I find<\/p>\n
Ext.P6 order passed by the court below is liable to<\/p>\n
be set aside, and I do so.           The injury that is<\/p>\n
likely    to   be    suffered by    the  respondents  in<\/p>\n
permitting an amendment filed belatedly has also to<\/p>\n

be taken into consideration.        The amendment sought<\/p>\n
for by the plaintiff can be granted only on terms.<\/p>\n
As a condition precedent in allowing the petition<\/p>\n
for amendment petitioner          shall pay a sum of<\/p>\n
Rs.500\/-     to    the   counsel    appearing  for   the<\/p>\n
respondents      before this court within a week, and<\/p>\n
file a memo evidencing such payment.         If cost is<\/p>\n
not paid within the time limit stipulated, the<\/p>\n
amendment petition shall stand dismissed without<\/p>\n
any   further      orders.     Subject   to   the  above<\/p>\n
directions, the writ petition is disposed.<\/p>\n
          Post after two weeks for report.\n<\/p>\n<\/p>\n
