It has been submitted<br \/>\nby learned Advocate Mr. Shah for the applicant that the order passed<br \/>\nby the Deputy Collector is in violation of the provisions contained<br \/>\nin the Mamlatdar&#8217;s Court Act and<br \/>\ntherefore deserves to be stayed pending this Civil Revision<br \/>\nApplication. According to Mr. Shah, the applicant is not in a<br \/>\nposition to farm his land as the respondents have caused obstruction<br \/>\nby putting Pala preventing the natural flow of water. Mr. Shah also<br \/>\nsubmitted that he has a strong prima facie case and is likely<br \/>\nto succeed in the revision application and therefore the interim<br \/>\nrelief as prayed for is required to be granted. However, Mr. Dakshesh<br \/>\nMehta for the respondents, challenging the maintainability of the<br \/>\npresent C.R.A., has submitted that the order passed by the Deputy<br \/>\nCollector being just and proper, it should not be stayed, which<br \/>\notherwise would amount to confirming the order passed by the<br \/>\nMamlatdar and allowing the present C.R.A. at admission stage.\n<\/p>\n<p>3.\tHaving regard to the<br \/>\nsubmissions made by the learned advocates for the parties and the<br \/>\nimpugned order passed by the Deputy collector, it appears that the<br \/>\nDeputy Collector, while allowing the revision application filed by<br \/>\nthe respondents against the order of Mamlatdar, has observed that<br \/>\nsince there is a &#8220;Voklu&#8221; on the southern side of the suit<br \/>\nland in question, with the consent of the parties, the water could be<br \/>\nflown by putting some channel. Having regard to the said order, it<br \/>\nappears that the Deputy collector has made out a new case inasmuch as<br \/>\nthe land of the respondents is situated on the eastern side of the<br \/>\napplicant&#8217;s land and not on the southern side and therefore the<br \/>\nquestion of consent of parties would not arise. Under the<br \/>\ncircumstances, the implementation of the said order of Deputy<br \/>\nCollector is required to be stayed, none the less, that would not<br \/>\ntantamount to reviving the order passed by the Mamlatdar.
