No.20930 of 2010\n        RAJESH KUMAR @ CHITKABRA, son of Late Ramdeo Das\n                               Versus\n                      THE STATE OF BIHAR\n                              -----------\n<\/pre>\n<p>4\/   25.10.2010            Heard learned Counsel for the petitioner and the<\/p>\n<p>                  State.\n<\/p>\n<p>                           The petitioner seeks bail in a case instituted for<\/p>\n<p>                  the offence 302\/34 of the Indian Penal Code and 27 of<\/p>\n<p>                  the Arms Act.\n<\/p>\n<p>                           It has been submitted that the petitioners are not<\/p>\n<p>                  named in the First Information Report and subsequently<\/p>\n<p>                  some witnesses stated that the deceased had been called<\/p>\n<p>                  away by the petitioners thereafter he was shot dead. The<\/p>\n<p>                  petitioner Satyendra Yadav name has transpired in the<\/p>\n<p>                  confessional statement of the co-accused that he was the<\/p>\n<p>                  person who shot dead the deceased.\n<\/p>\n<p>                           Considering that    there is no direct material<\/p>\n<p>                  against the petitioners and also that the petitioners have<\/p>\n<p>                  no criminal antecedent, let the petitioners above named,<br \/>\n<span class=\"hidden_text\">                    2<\/span><\/p>\n<p>be released on bail on furnishing bail bond of Rs.5,000\/-<\/p>\n<p>(Five thousand) each with two sureties of the like<\/p>\n<p>amount each or any other surety to be fixed by the court<\/p>\n<p>concerned to the satisfaction of            Chief Judicial<\/p>\n<p>Magistrate, Gaya in connection with Chandauti P. S.<\/p>\n<p>Case No.149 of 2009, subject to the conditions, (i) That<\/p>\n<p>one of the bailor will be a close relative of the petitioners<\/p>\n<p>who will give an affidavit giving genealogy as to how he<\/p>\n<p>is related with the petitioners and the other bailor shall be<\/p>\n<p>the brother\/wife\/son of the petitioners. The bailor will<\/p>\n<p>undertake to furnish information to the Court about any<\/p>\n<p>change in address of the petitioners. (ii) That the bailor<\/p>\n<p>shall also state on affidavit that he will inform the court<\/p>\n<p>concerned if the petitioners are implicated in any other<\/p>\n<p>case of similar nature after their release in the present<\/p>\n<p>case and thereafter the court below will be at liberty to<\/p>\n<p>initiate the proceeding for cancellation of bail on ground<\/p>\n<p>of misuse, (iii) That the petitioners will give an<\/p>\n<p>undertaking that they will receive the police papers on<\/p>\n<p>the given date and be present on date fixed for charge<\/p>\n<p>and if they fail to do so on two given dates and delays<\/p>\n<p>the trial in any manner, their bail will be liable to be<br \/>\n<span class=\"hidden_text\">                                3<\/span><\/p>\n<p>            cancelled for reasons of misuse, and (iv) That the<\/p>\n<p>            petitioners will be well represented on each date if they<\/p>\n<p>            fail to do so on two consecutive dates, their bail will be<\/p>\n<p>            liable to be cancelled.\n<\/p>\n<\/p>\n<pre>Ashwini\/-                                 ( Anjana Prakash, J. )\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Rajesh Kumar @ Chitkabra vs The State Of Bihar on 25 October, 2010 IN THE HIGH COURT OF JUDICATURE AT PATNA Cr.Misc.
