He was informed by the conductor that<br \/>\n\the has instructed the passengers that the bus route No.34\/5 was<br \/>\n\tparked in parking near the wall of City Survey Office and the<br \/>\n\tpassengers were sitting in the said bus, therefore, Manilal was<br \/>\n\tgoing to board the said parked bus. During the said period, the<br \/>\n\tdriver of the bus had driven the bus in excessive speed and<br \/>\n\tnegligently from parking place near City Survey Office to platform<br \/>\n\tNo.2 and hit the front portion of the bus to Manilal and the rear<br \/>\n\tleft wheel of the bus ran-over the body of deceased Manilal. He<br \/>\n\tsustained serious injuries and then succumbed to the injuries on the<br \/>\n\tspot. Same has given rise to the claim petition being MACP No.1081<br \/>\n\tof 2001, demanding compensation of Rs.25 Lacs. The Tribunal at the<br \/>\n\tconclusion of the case, awarded the aforesaid amount. It is under<br \/>\n\tthese circumstances, the present appeal is before this Court.\n<\/p>\n<p>We<br \/>\n\thave gone through the judgment and reasons recorded by the Tribunal.<br \/>\n\tWe have heard Mr.GB Baghel for Mr.Munshaw.\n<\/p>\n<p>The<br \/>\n\tfirst contention raised on behalf of the appellant is that the<br \/>\n\tprospective income have been erroneously assessed and in the<br \/>\n\tsubmission of the learned counsel, it should have been 25% of the<br \/>\n\texisting income whereas the Tribunal has assessed and added 50% in<br \/>\n\tthe said income and, therefore, there is an error.\n<\/p>\n<p>In<br \/>\n\tour view, the said submission deserves to be rejected outright.<br \/>\n\tSince the same is against the settled legal position by now. The<br \/>\n\tprinciples of calculating prospective income is by now well settled<br \/>\n\tand if the formula of treating the income by addition of  50% amount<br \/>\n\tin existing income would be applied and prospective income can be<br \/>\n\tassessed. The Tribunal has assessed in the same manner and,<br \/>\n\ttherefore, there is no error as sought to be canvassed.\n<\/p>\n<p>It<br \/>\n\twas contended by the learned counsel for the appellant that the<br \/>\n\tperson had sustained injury and he was not the deceased when this<br \/>\n\tclaim petition was filed.\n<\/p>\n<p>The<br \/>\n\tsaid submission is also without basis and on the contrary the<br \/>\n\tevidence including the evidence of the eye-witness is otherwise.\n<\/p>\n<p>No<br \/>\n\tother submission is made.
