{"id":246505,"date":"2010-07-05T00:00:00","date_gmt":"2010-07-04T18:30:00","guid":{"rendered":"https:\/\/www.legalindia.com\/judgments\/ram-baran-vs-d-d-c-and-ors-on-5-july-2010"},"modified":"2016-10-12T14:27:56","modified_gmt":"2016-10-12T08:57:56","slug":"ram-baran-vs-d-d-c-and-ors-on-5-july-2010","status":"publish","type":"post","link":"https:\/\/www.legalindia.com\/judgments\/ram-baran-vs-d-d-c-and-ors-on-5-july-2010","title":{"rendered":"Ram Baran vs D.D.C And Ors on 5 July, 2010"},"content":{"rendered":"<div class=\"docsource_main\">Allahabad High Court<\/div>\n<div class=\"doc_title\">Ram Baran vs D.D.C And Ors on 5 July, 2010<\/div>\n<pre>Reserved\n\nCourt No. - 10\n\nCase :- CONSOLIDATION No. - 5983 of 1984\n\nPetitioner :- Ram Baran\nRespondent :- D.D.C And Ors\nPetitioner Counsel :- A.S.Chaudhry\nRespondent Counsel :- C.S.C,P.V.Chaudhary\n\nHon'ble Yogendra Kumar Sangal,J.\n<\/pre>\n<p>This writ petition has been filed by the petitioner Ram Baran to<br \/>\nissue writ of certiorari quashing the order dated 29.11.1984 passed<br \/>\nby learned Deputy Director of Consolidation, Faizabad contained<br \/>\nin Annexure-6 of the writ petition.\n<\/p>\n<p>Heard learned counsel for the parties, learned standing counsel for<br \/>\nthe State respondent No. 1 and perused the record.\n<\/p>\n<p>During the consolidation operation in the Village Mohassinpur,<br \/>\nPargana Haveli Avadh, Tehsil District Faizabad, CH Map 23 was<br \/>\ndistributed showing the petitioner&#8217;s original plots No. 165, 441 and\n<\/p>\n<p>178. Assistant Consolidation Officer proposed three chaks of the<br \/>\npetitioner, first at Plot No. 441\/2; second at Plot No. 178 and 179<br \/>\nand third at Plot No. 165, 164, 189 and 166. Case of the petitioner<br \/>\nwas that in the east Plot No. 165 after chak-road his tube-well and<br \/>\nhouse lies. As there was deficiency in the valuation of 10 annas so<br \/>\nhe raised objections which were decided by the consolidation<br \/>\nofficer.\n<\/p>\n<p>Against the order of consolidation officer, no appeal was filed by<br \/>\nthe petitioner but other tenure holders filed three separate appeals<br \/>\nnumbered as 789, 790 and 817. One Appeal No. 817 filed by<br \/>\nopposite party No. 2 Bhagirathi (now dead) and represented<br \/>\nthrough respondent No. 4 relates to the land of petitioner to Plot<br \/>\nNo. 165. This appeal was partly allowed by the Settlement Officer<br \/>\nof Consolidation (for short, &#8216;S.O.C.&#8217;). Appeal No. 790 was<br \/>\ndismissed and Appeal No. 789 was allowed in toto. As petitioner<br \/>\nwas not affected by the order in the appeal, he has not filed any<br \/>\nrevision but three revisions numbered as 1535 filed by Dukhi,<br \/>\n1591 filed by Gurudeen and 1617 filed by Bhagirathi against the<br \/>\nappellate courts order. Learned Deputy Director of Consolidation<br \/>\n(for short, &#8216;D.D.C.&#8217;) respondent No. 1 as per arguments of learned<br \/>\ncounsel for the petitioner, without assigning any reason amended<br \/>\n the chak of the petitioner as shown by Red and Green lines in<br \/>\nAnnexure-4 of the petition. Area shown by Red lines was of his<br \/>\nchak No. 160 upto the stage of learned S.O.C. whereas the Green<br \/>\nline area shows position of the chak of the petitioner allotted by<br \/>\nthe respondent No. 1. Learned D.D.C. has taken out 12 biswas and<br \/>\n12 biswansis land from the land of the chak of the petitioner from<br \/>\nhis original Plot No. 165. This land was just in front of the house<br \/>\nof the petitioner and the same was allotted to the respondent No. 2<br \/>\nBhagirathi to give cause of further litigation. Spot was not<br \/>\ninspected by the learned D.D.C. before passing the impugned<br \/>\norder and no reason has been assigned to disturb the chak of the<br \/>\npetitioner so he prayed for its quashing. Counter affidavit was filed<br \/>\nby the respondent No. 2 Bhagirathi supporting the order of learned<br \/>\nD.D.C. and denying the correctness of the facts given in the writ<br \/>\npetition. A rejoinder affidavit was also filed by the petitioner.\n<\/p>\n<p>Learned counsel for the respondents argued that respondent No. 2<br \/>\nBhagirathi (since deceased) in his counter-affidavit had stated that<br \/>\nhe had placed his grievance before the appellate authority against<br \/>\nthe order of consolidation officer saying that since beginning it<br \/>\nwas his case that portion of land lying in front of his house of the<br \/>\nland of Plot No. 165 should be allotted to him.\n<\/p>\n<p>It was further argued that it was the case of respondent No. 2<br \/>\nbefore learned D.D.C. that the land of Shiv Narayan son of<br \/>\nBhagirathi is also there near the land of Plot No. 165, it will be<br \/>\nmore convenient for both of them if part of the land of Plot No.<br \/>\n165 is allotted in his chak. So taking into consideration the<br \/>\ngrievance of the respondent No. 2 after taking out only 12 biswas<br \/>\nand 12 biswansis land from the Plot No. 165 having total area of<br \/>\nmore than 8 bigha, this adjustment was made by the learned<br \/>\nD.D.C. under the provisions of Section 19 of the U.P.<br \/>\nConsolidation and Holdings Act. It was further argued by the<br \/>\nlearned counsel for the respondents that minor change has been<br \/>\nmade in the chak of petitioner that is small portion of the land<br \/>\nhaving an area of 12 biswas and 12 biswansis was taken and in lieu<br \/>\nof that petitioner has been allotted the remaining land of Plot No.<br \/>\n165 which is his original land and thus, the petitioner still retains<br \/>\nalmost the entire area of Plot No. 165 having an area of more than<br \/>\n8 bigha. Learned counsel for the petitioner had not denied the<br \/>\ncorrectness of this fact that except this land of 12 biswas and 12<br \/>\nbiswansis rest land of Plot No. 165 is allotted in his chak. It was<br \/>\nfurther contended that the order of learned D.D.C. cannot be said<br \/>\nwithout any reason. Annexure-4 of the writ petition filed by the<br \/>\npetitioner itself shows that taking some area from the land of Plot<br \/>\n No. 165 from one side the adjacent land was allotted to the<br \/>\npetitioner of the other side and no measure change has been made.\n<\/p>\n<p>Although petitioner had claimed that the portion of the land<br \/>\nallotted to the respondent No. 2 by learned D.D.C. is in front of his<br \/>\nresidential house but correctness of the same was challenged by<br \/>\nthe respondent in his affidavit. Nothing on record was pointed out<br \/>\non behalf of the petitioner to support his this plea during the course<br \/>\nof arguments. Moreover record shows that except this small<br \/>\nportion of the land of Plot No. 165 rest total land of this plot is<br \/>\nallotted to the petitioner which satisfied his need that his chak<br \/>\nshould be nearby his residential house and source of irrigation of<br \/>\nthe land.\n<\/p>\n<p>It is correct that spot inspection was not made by learned D.D.C.<br \/>\nbefore making the aforesaid arrangement but it was in discretion of<br \/>\nthe learned D.D.C. whether spot inspection was to be made or not.<br \/>\nIf he was satisfied from the record of the case and he has not seen<br \/>\nthe necessity of making the spot inspection, it will not materially<br \/>\naffect his impugned findings. There is no provision in the<br \/>\nConsolidation and Holdings Act or Rule where the local inspection<br \/>\nis mandatory for the learned D.D.C. Respondent No. 2 in his<br \/>\ncounter affidavit had claimed that the main door of his house is<br \/>\ntowards the land which was allotted to him by the learned D.D.C.,<br \/>\nnot denied on behalf of the petitioner. Allotment of small strip of<br \/>\nland to him from the Plot No. 165 did not materially affect and<br \/>\nprejudice in any way to the petitioner in the facts and<br \/>\ncircumstances of the case. In passing the impugned order every<br \/>\naspect of the matter and the relevant record was seen by the<br \/>\nlearned D.D.C. What irreparable injury he will suffer by the<br \/>\nallotment of this strip of land to the respondent No. 2 not<br \/>\nsufficiently explained. Petitioner should not expect under the<br \/>\nprovisions of law that every inch of the land of original plot should<br \/>\nbe allotted to him. In allotment of the plots in consolidation<br \/>\nproceedings both the parties can never be satisfied by the<br \/>\nauthorities. Court is to see whether provision of Section 19 of the<br \/>\nAct has been complied or not keeping case of both the parties in its<br \/>\nmind.\n<\/p>\n<p>Grievance of both the parties were taken into consideration by the<br \/>\nfinal authority in the consolidation proceedings i.e. respondent No.<br \/>\n1 learned D.D.C. in case of allotments of the chaks. In<br \/>\nconsolidation proceedings dispute for generation are to be settled.<br \/>\nFrom the facts and circumstances of the case, I am also of the view<br \/>\nthat no substantial injury will be caused to the petitioner by<br \/>\nallotment of this small portion of the land of Plot No. 165 to the<br \/>\n respondent No. 2. Petition is devoid on merit and has no force,<br \/>\ntherefore, no interference in writ jurisdiction is required in the<br \/>\nmatter. Accordingly the same is hereby dismissed.
