The case of  1:ifroseVeutien&#8217;.ydiseioses that one<\/p>\n<p>Bhimappa Biradar._(deeeaSed}=.had enmity with<\/p>\n<p>1\\\/Iansani*._faIn1&#8217;i&#8217;r and..y4Sir*t&#8217;bi1&#8217;r&#8217;fami1 , since the members of<\/p>\n<p>Sirabur  had caused murder of grand<\/p>\n<p>~fathe1&#8217;_~df  deceased_,____That apart, because of politicai rivalry,<\/p>\n<p> ,er1m1&#8217;ty&#8221;~wa.s&#8221;&#8216;intensified. The members of Mansani and<\/p>\n<p>  Sirabn&#8217;r&#8221;fanIi}uy&#8217;j_ virtually pitted against the deceased and<\/p>\n<p>&#8216;7\u00bb,.,___th.ey weretpreventing the deceased from carrying out any of<\/p>\n<p> .&#8217;_thVte  deeds for the bene\ufb01t of the village.<\/p>\n<p>&amp;\/<\/p>\n<p>3. On 15.09.2001 at about 10.00 am, the deceased<br \/>\nwas sitting on the platform of the Village Well. The  of<\/p>\n<p>the deceased) was getting air blovxm to his the<\/p>\n<p>shop of PW. 11 situate right opposite to <\/p>\n<p>PW.4 [grand daughter of deceased)&#8217; Carlie and&#8217; <\/p>\n<p>deceased that he is wanted  house.  got<br \/>\nup to proceed to his  that Vii&#8217;;\/ianingappa<br \/>\nSannasiddappagol (A11 v*:&#8217;.E1&#8217;ippanna Ningappa<br \/>\nKundaragi (A131   Kundaragi<\/p>\n<p>(A14) Wielding  @_ &#8216; Kristappa Shashappa<\/p>\n<p>Biradar     Jagappa Mallappa Biradar &#8212; A16<\/p>\n<p>Wielding  V&#8221;;&#8217;\\\/:i:a1\u00ab1appa Shirabur \u00ab A17 wielding<\/p>\n<p>chopper and  Shashappa Biradar &#8212; A21 wielding club<\/p>\n<p> frorn  side of the well. The deceased tried to<\/p>\n<p>rt1&#8217;n.v_V.0&#8217;.0&#8217;a.1&#8217;jove accused persons caught hold of the<\/p>\n<p> deceas&#8217;ed.,.._&#8221;I&#8221;ne&#8221;&#8221; deceased sat down irnploring not to assault.<\/p>\n<p>-. A~&#8211;__13 VV&amp;\u00a2A~ 14 assaulted the deceased with axe, the \ufb01ngers<\/p>\n<p>hot&#8217; the &#8216;hand got cut, severe head injury is caused and the<\/p>\n<p>0 &#8220;&#8216;..de&#8221;Ce0ased fell down. The A1, A15, A16 and A21 dragged the<\/p>\n<p>deceased to couple of feet. The A13, A14 8:. A17 again<br \/>\nassaulted the deceased. The above accused threatened the<br \/>\nbystanders with dire consequences, if they intervene to rescue<\/p>\n<p>the deceased. The A2 to A12, A18 to A20, A22 ts<\/p>\n<p>running to the scene and they assaulted <\/p>\n<p>hands and kicked him. All the accu&#8217;se&#8217;d\u00ab pgersopiisdaifteir-ggssaultfg <\/p>\n<p>Went away from the scene<br \/>\nthem. 8 It h V 8 it 2<\/p>\n<p>4. The PW1 to eye\ufb02vivitneisses to the<br \/>\nincident. The PW]. by about  to Babaleshwar<br \/>\nPS. The    duty at some other village.\n<\/p>\n<p>Mie polics&#8217;&#8211;,g8nstab1e.&#8217;.ife}aort_s&#8221;the matter by wireless to the PSI<\/p>\n<p>and ongthe ins&#8217;tr:uct~ihon.&#8217;0f 18, some police constables are<\/p>\n<p>deputed&#8217; to&#8217;thegviliagemtio maintain law and order. The PW.1<\/p>\n<p>  complaint Ex.P.1_5 P.W. 18 registered it as<\/p>\n<p>it  FIR. iP&#8217;i?V.1.8&#8217;viAs&#8217;ited the spot for tracing the accused. All the<\/p>\n<p>:&#8221;.v4.4acjcused were arrested on different dates within a period of<\/p>\n<p> of days. The PW.17\u00bb~CPI, took up further investigation.<\/p>\n<p>it  Voluntaxy instance of A13, A44 8: 191-17, caused<\/p>\n<p>recoveries of the blood stained weapons used for commission<br \/>\nof offence under a rnahazar. The blood stained clothing of the<br \/>\ndeceased and the weapons are sent to the F SL. The EX.P.16&#8211;<br \/>\nserology report and FSL report reveals that the h1&#8217;o?o&#8217;d.stains<\/p>\n<p>found on the articles are stained with human   it <\/p>\n<p>5. The accused are chargedforo comm\ufb01tiiig &#8216;oifen~cesf it<\/p>\n<p>punishable U\/Ss. 143, 147, l48,  ll<br \/>\nr\/w 149 IPC. The charge u   Partlll<br \/>\nis redundant and super\ufb01u_ous&#8217;t~rsincle;._acclus&#8217;e&#8217;d&#8221;are charged<br \/>\nfor commission of the higlherl   same genre.<\/p>\n<p>6.   upon consideration of the<\/p>\n<p>evidence, l:1E\u00a3S&#8221;l.l1P():l.,&#8217;I1&#8243;1Cl:&#8221; thatv.A&#8211;l3, A&#8211;14 &amp; A-1?&#8217; are guilty of<\/p>\n<p>  302 IPC. The presence and<\/p>\n<p>paertliei-paiiloii._goff&#8217;Al-:*1, A45, A&#8211;i6 &amp; A&#8211;2l although held to be<\/p>\n<p>l  proved;.. the  court comes to the conclusion that they did<\/p>\n<p>U  deal any blow and their actions in no way contributed for<\/p>\n<p>  of the deceased. Hence, they are acquitted of the<\/p>\n<p>it  In respect of A-2 to A&#8211;l2, A&#8211;l8 to A&#8211;20 and A22 to<\/p>\n<p>A24, the trial court holds that the prosecution Witnesses do<\/p>\n<p>not attribute any overt acts to them, their presen\u00abcTe&#8217;.,A&#8217;and<\/p>\n<p>participation in the incident is held &#8216;lIe_&#8217;i1ce,4_<\/p>\n<p>acquitted them.\n<\/p>\n<p>7. The   has filed 2006 in respect of<\/p>\n<p>acquittal of  1* for an offence U\/S 302<\/p>\n<p>IPC.   not challenged the acquittal of<\/p>\n<p>remaining    to A&#8211; 12, A\u00bb18 to A-20 and A-22<\/p>\n<p>    ttttt <\/p>\n<p>  B. Naik, learned Senior Counsel<br \/>\nappeja;;~mgr5lrA91 A- 14 82 Ad?&#8217; (Cr1.A. 824\/2006) submitted<\/p>\n<p>the fol.l&#8221;owinVg&#8221;r4easons to assail the order of conviction:<\/p>\n<p>  &#8221; *i)_ l&#8221;lThe FIR allegations do not disclose that A~l7 is in<\/p>\n<p>the company {if}, A-13 to A16 and A~2I_ who<\/p>\n<p>ii)<\/p>\n<p><span class=\"hidden_text\">9<\/span><\/p>\n<p>caused assault on the deceased in the first phase<br \/>\nof the incident. The rest of the accu.s&#8217;ed7.._caIne<\/p>\n<p>together to the scene after the <\/p>\n<p>assault. In the second phaseHof~..ass_a.1i&#8217;lt;&#8221;A:l&#8211;_g1V7&#8211;._<br \/>\nwielding chopper along :WiT.h&#8217;A2 to  it<\/p>\n<p>and A.22 to A24 camezhto   a 0&#8242;<\/p>\n<p>blow with the chopper Vonl&#8217; the 2 0 The<br \/>\nevidence of PW1 to WhoV&#8221;areV&#8221;tlVie eyewitnesses<br \/>\nto the incident.V_hoWeife&#8217;1&#8217;i.:&#8217;indicts that PQ17 was one<br \/>\nof the particip&#8217;ant  the first phase<br \/>\nof assault on,tiie\u00ab  A-1, A13 to<br \/>\nA&amp;6&amp;\ufb01%Lggwag&#8221;+_5<\/p>\n<p> in false implication of<\/p>\n<p>innocent_ person-s___o&#8211;f [the rival group Vindictively in<\/p>\n<p>xVthe rte and as mm\ufb021in.the evnjence.&#8217;The PWV2 my<\/p>\n<p>PW&#8217;6valsVoV~.fai.sel3?l implicate all the accused named<\/p>\n<p> the &#8220;FIR___al.though no overt acts are attributed to<\/p>\n<p> Vtlieni, and there are no corresponding injuries on<\/p>\n<p>  ideiceased to correlate with the manner of<\/p>\n<p>&#8220;&#8216; i ,iii)<\/p>\n<p> stated in the FIR and the evidence.\n<\/p>\n<p>he PW.1 in the cross-examination done on<\/p>\n<p>10.03.2005 at paragraph-2&#8217;7 states that when he<br \/>\nWent to police station to lodge complaint, the PSI<\/p>\n<p>was not present; the Havaldar was present and<\/p>\n<p>%\/<\/p>\n<p>iv)<\/p>\n<p><span class=\"hidden_text\">10<\/span><\/p>\n<p>he (Havaldar) enquired about the incident. PW.1<br \/>\norally tells the Havaldar that &#8220;the r_ne_ral5ers of<\/p>\n<p>&#8220;Mansani and Sirabur family have_;m&#8217;u.rd.ej1*ed4&#8217;~my<\/p>\n<p>father&#8221;. The PW.1 if really hady&#8217;l&#8221;-vyhitriesseci..,4t&#8217;he.._._<br \/>\nincident, he would have &#8220;m.entioned\u00bb &#8216;._the&#8211;f}fa&#8221;r:1ilyj&#8217;. <\/p>\n<p>names of other accused-&#8216; f?&#8221;\\Fv&#8221;.1  l<\/p>\n<p>and concocted the*&#8217;1&#8243;:a_vmesl*of&#8217; the  iwho<br \/>\nnot belong to Mansvariiand lS*irabur  The<br \/>\nPW} has fa1se_l_y ir11&#8242;;&#8217;j&#8217;1iegg&#8217;jAtt$;h{&#8216;js-&#8230;1;};e \u00abaccused persons<br \/>\nbelonging toll&#8217;   vindictively to<br \/>\nharasshwthhemy&#8217;  the persons<br \/>\n  diflereritvvlli\u00e9airiilies like Mansani,<\/p>\n<p>Si}&#8217;abi_ir.:. V. V.    and Saddappagol,<\/p>\n<p>~ &#8221; six\/iantur aijid Korti liavetieen implicated.<\/p>\n<p>llinyjlthel  stated that there is enmity<br \/>\n hhbetyveen&#8217;ihisllfarhily on the one part and Mansani<br \/>\n and Sirabur&#8217; family on the other part. The enmity<br \/>\n other families is not stated at the earliest<\/p>\n<p>V&#8217; &#8216;V gliointfof time.\n<\/p>\n<p>., The FIR is registered around 12 noon and the<\/p>\n<p>&#8220;same is entrusted to PW.14 at 12.15 p.m The FIR<\/p>\n<p>is submitted to the jurisdictional Magistrate at<\/p>\n<p>6.45 pm There is a delay of almost six hours, even<\/p>\n<p>vi)<\/p>\n<p>ll<\/p>\n<p>though the distance between of Babaleshwar RS.<br \/>\nand Bijapur is hardly 20 Kms.\n<\/p>\n<p>PWJ4 states that as he was suffering from<br \/>\ndysentery he went home to go to toilet, after four<br \/>\nhours of entrustment, he went to Bija,&#8217;;&#8217;jur&#8211;VV&#8217;and<\/p>\n<p>handed over the FIR to the  <\/p>\n<p>evidence of PW.14 is quite artifi_c.iall_: <\/p>\n<p>of six hours in forWarding'&#8221;the&#8221;\u00ab._Fcourtm <\/p>\n<p>becomes highly sigriifilcantl&#8221; _<br \/>\nmanipulation and &#8216;false implication accused<br \/>\nwho do not belongllltol family I Mansani and<\/p>\n<p>Sirabur.\n<\/p>\n<p> Thelelx-&#8216;i,de_;tice&#8221;onreeord discloses that the deceased<\/p>\n<p>&#8216;wast aV.V_lnotorieu&#8217;selement in the village, had<\/p>\n<p>incurred&#8217; &#8216;;en&#8217;1nit&#8217;y with several sections of people,<\/p>\n<p> E__:&#8217;lie_ was&#8217;~s.exually harassing the women of the<\/p>\n<p> village__ and there is every possibility that the<\/p>\n<p>it  village-i**s went to the deceased to discuss and warn<\/p>\n<p>v_.-lii_rJf1.Alln the heat of discussion and quarrel the<\/p>\n<p>&#8216;~  incident has taken place. In the circumstances the<\/p>\n<p>V offence would not be U\/s. 302 IPC. At the most, it<br \/>\nmay be U\/S. 304-1 IPC. The conviction of A&#8211;l3, A-<br \/>\n14 3: A-1&#8242;? for offence U\/S. 302 IPC is bad in law.<\/p>\n<p>%\/<\/p>\n<p>1&#8217;)<\/p>\n<p>10. Sri. Ishwar Choudapur, Advocate submitted the<br \/>\nfollowing reasons to justify the acquittal of A&#8211; <\/p>\n<p>and A&#8211;21:\n<\/p>\n<p>1) The FIR anegauohs Z\ufb01lisc-less:  a;*$hve&#8217;t-his J<\/p>\n<p>accused were wielding cluhls-t thejflconie ifannirig<br \/>\nalong with A&#8211;l3, A&#8211; A-&#8220;17;.Vth,e&#8217;;:r hold for<br \/>\nthe deceasedzwho wasvvierarining away; ..A&#8211;l3 and A-<br \/>\n14 assault tl&#8217;1e7aXe on the head.\n<\/p>\n<p>Awl, A&#8211;l5, A&#8211;&#8216;lr6,:and.&#8221;VA-f2  assault with the<br \/>\nclubs they  deceased to some<br \/>\n overt acts of assault with<br \/>\n ;,:_  &#8220;&#8216;l&#8217;hreV&#8217;_,=irersion is arti\ufb01cial and<br \/>\n  A-1, A-is, A&#8211;l6 &amp; A&#8211;2l were<br \/>\n2&#8243;present.VVat:.l:th,e&#8217; assault, they too would have<br \/>\nassau&#8217;lted}.  clubs. Their passive conduct<\/p>\n<p>\u00bb  V _xappear&#8221;s&#8221;to._.brev preposterous.<\/p>\n<p>V  ele\ufb01idence of PW.2 in the cross&#8211;examination<br \/>\n. A  that when the deceased was running,<br \/>\n A13, A14, A~\u00bbl6, A-1&#8242;? and A&#8211;21 caught hold<br \/>\n deceased, he was grappled and made to fall<\/p>\n<p>down. Thereafter A&#8211;13 and A44 assaulted the<br \/>\ndeceased with axe. The evidence of PW.3 with<\/p>\n<p>regard to manner of assault is totally inconsistent<\/p>\n<p>1.4<\/p>\n<p>11. In the light of the evidence and submissions made<br \/>\nat the bar, the \ufb01nding of the trial court that A-1&#8242;? Wasone of<\/p>\n<p>the participants in the first phase of assault &#8220;A-1,<\/p>\n<p>A&#8211;l3, A\u00bb~l4, A&#8211;15, A~l6 and A~21 appears&#8217;1V:&#8221;&#8221;toV&#8217;1o;e that <\/p>\n<p>prevarication and inconsistent with theulearliest &#8216;v.ers1&#8217;o_n  the7.._ &#8216;_j<\/p>\n<p>FIR. The recitals in the FlR_4_&#8221;disclose<br \/>\nchopper comes to the scene   A~l8 to<br \/>\nA~20 and A~22 to A&#8211;24:g_{fter held deait deadly<br \/>\nblows on the deceased_..an_dV.   A16 and A21<\/p>\n<p>Wielding   moral support and<\/p>\n<p>threateniing&#8217;lithe?bysltarideirls. &#8220;lfnellllevidence of PW 1 to PW.6<br \/>\nimplicate 11A~vV17 as &#8216;t-he&#8217;\u00abassailants along with A- 13 8: A-<\/p>\n<p>14 who-caused  deadly Weapon like axe in the<\/p>\n<p>&#8216;firstsVpiiestefef assaultmallong with Aml, A&#8211;15, A~16 3: A&#8211;21. If<\/p>\n<p>  assailant in the first phase of assault,<\/p>\n<p> l_3W&#8211;l &#8220;would.  have omitted to state this glaring fact in the<\/p>\n<p> Merediee, when he names A1, A15, A&#8211;l6 and A~21<\/p>\n<p>1_1against\u00b01whom no overt acts of assault is attributed. In that<\/p>\n<p>%K<\/p>\n<p><span class=\"hidden_text\">15<\/span><\/p>\n<p>View, the order of conviction rendered against A17 does not<\/p>\n<p>appear to be sound and proper.\n<\/p>\n<p>12. It is sterniy argued that the Ami, <\/p>\n<p>A&#8211;21 are falsely implicated, since in the <\/p>\n<p>stated that they were wielding   in}.\n<\/p>\n<p>commission of the offence. The.4overAt&#8221;.a_&#8217;cts  tgoiuthern<br \/>\nare only limited to dragging  andthrefatening the<br \/>\nbystanders. if really&#8217;    &#8220;pdreser1t and<br \/>\nparticipated in Commissioriiof  they too would<br \/>\nhave dealt blows   conduct at the<br \/>\nscene is it is said that there are no<\/p>\n<p>corresponding.&#8217;injuriesAonthe deceased caused by clubs.<\/p>\n<p>~  ., A  :,,,&#8221;j&#8217;\ufb01e.1ogic  above argument may appears to be<\/p>\n<p> o:r1.&#8211;:a deep scrutiny of the evidence we do not<\/p>\n<p> think &#8216;that.._&#8221;the:conduct of A-1, A45, A~16 and AW21 appear to<\/p>\n<p>artiuficiai\ufb01as argued by them. in fact, A1, A15, A16 and<\/p>\n<p> clubs come aiong with A13 and A14. The FSL report and the<\/p>\n<p> report disclose that the blood stained clothing of<\/p>\n<p>A &#8216;:&#8217;..thTe&#8221;deceased on MO 4, M05 and M06 and the blood stains<\/p>\n<p>_\\\/.\n<\/p>\n<p><span class=\"hidden_text\">20<\/span><\/p>\n<p>on items 15 and 16 are stained with &#8220;O&#8221; group blood. The<\/p>\n<p>mahazar witness~wPW 8 has supported the recoveri,e~s_:.&#8221;-I11.&#8217;view<\/p>\n<p>of the FSL and the Serologist reports, it <\/p>\n<p>MO 9 and 10 recovered from A13 an.d___A1&lt;5i? ar&quot;\u00a2.::f&#039;11e.&quot;&#039;one uslecltp <\/p>\n<p>for the commission of offence.\n<\/p>\n<p>20. In the face of<\/p>\n<p>evidence, it is untenable to argue that in a l&#8217;1&#8217;e&#8217;a&#8217;t&#8211; cjuarrel. they <\/p>\n<p>deceased was assaulted and that offenjcet.wo&#8217;uld~  l3lCl4A.l3&#8217;art&#8211;l <\/p>\n<p>IPC.\n<\/p>\n<p>22.
