DISTRICT JUDGE, ALLAHABAD AND OTHERS\n\nDATE OF JUDGMENT23\/07\/1981\n\nBENCH:\nPATHAK, R.S.\nBENCH:\nPATHAK, R.S.\nKOSHAL, A.D.\n\nCITATION:\n 1981 AIR 1724\t\t  1982 SCR  (1)\t 77\n 1981 SCC  (3) 483\t  1981 SCALE  (3)1092\n CITATOR INFO :\n D\t    1988 SC  30\t (5)\n\n\nACT:\n     Landlord and  tenant-Prescribed authority\tallowing the\nlandlord to recover his building tenanted, but the appellate\nauthority modifying  the order of part recovery only and the\nsaid order  becomes final  due\tto  successive\tfailures  in\nappeal by  the tenant  including in  the  Supreme  Court-Any\napplication to re-open the issue due to the subsequent event\ni.e. the death of the landlord is not maintainable.\n\n\n\nHEADNOTE:\n     In February  1965, Bungalow No. 16-D, Beli Road (now 26\nB.K.  Banerjee\t Road),\t Allahabad   was  allotted   to\t the\nappellant.  On\t an  application  made\tin  April  1975\t the\nprescribed  authority\tallowed,  on  24th  May,  1976,\t the\napplication directing  the release  of the  bungalow to\t the\nlandlord. On  appeal the  appellate authority  by its  order\ndated 25th  March, 1977 modified the order by releasing only\na portion of the building and by permitting the appellant to\ncontinue in  the remaining  portion with  a direction to the\nprescribed authority to divide the bungalow accordingly. The\nsaid order  dated 25th\tMarch, 1977  became final, since the\nwrit petition  challenging the\tsaid order was dismissed. On\nthe death  of the  landlord  the  appellant  filed  a  fresh\napplication before  the prescribed  authority not to proceed\nwith the  partition scheme.  Since the\tprescribed authority\nrefused to take note of this subsequent event, the issue has\ncome up before this Court by way of special leave.\n     Dismissing the appeal, the Court\n^\n     HELD: 1.  The order  dated\t 25th  March,  1977  of\t the\nappellate authority  releasing a  portion of the premises in\nfavour of  the third  respondent and  leaving the  remaining\nportion in  the tenancy\t of the\t appellant acquired finality\nwhen the  proceedings taken  against  it  by  the  appellant\nfailed. The prescribed authority was bound to give effect to\nthat final order and was not acting outside its jurisdiction\nor contrary to law. [79 C-D]\n     2. It is true that subsequent events must be taken into\naccount by  a statutory\t authority or court when considering\nproceeding  arising   out  of\ta  landlord's  petition\t for\nejectment of  a tenant\ton  the\t ground\t of  the  landlord's\npersonal need. But in the present case the order for release\nof a  portion of  the accommodation acquired finality before\nthe death  of the  landlord and the controversy concluded by\nit could not be reopened now. [79 E-F]\n     3. The  present appeal  being limited  to the  question\nwhich  arose   before  the   prescribed\t authority   on\t the\napplication of\tthe  appellant\tafter  the  proceedings\t for\nrelease had  acquired finality,\t it is\tnot open even to the\nSupreme Court,\tto reopen the proceeding for release. Writ No. 8736 of 1978.\n<\/p>\n<p>     R.K. Garg,\t Manoj Swarup  and Miss Lalita Kohli for the<br \/>\nAppellant.\n<\/p>\n<p>     Yogeshwar\tPrasad,\t  and  Mrs  Rani  Chhabra,  for\t the<br \/>\nRespondent.\n<\/p>\n<p>     The Judgment of the Court was delivered by<br \/>\n     PATHAK, J.\t The appeal  by special\t leave\tis  directed<br \/>\nagainst a  judgment of the Allahabad High Court dismissing a<br \/>\ntenant&#8217;s  writ\t petition   arising   out   of\t proceedings<br \/>\nconsequential upon an order of ejectment.\n<\/p>\n<p>     The bungalow,  16-D, Beli Road, Allahabad, was owned by<br \/>\nRaj Kumar  Sinha, father  of the  third respondent,  Kailash<br \/>\nShanker Sinha.\tIn February  1965, the bungalow was allotted<br \/>\nto  the\t  appellant,  Syed   Asadullah\tKazmi,\tand  he\t was<br \/>\naccordingly treated  as the  tenant of\tthe premises. At the<br \/>\ntime, Raj  Kumar Sinha, with his family, including the third<br \/>\nrespondent, occupied  another  house  at  14-D,\t Beli  Road,<br \/>\nAllahabad. In October 1973, the third respondent applied for<br \/>\nthe release  of the bungalow 16-D, Beli Road, Allahabad, now<br \/>\ndescribed as  26, B.K. Banerjee Road, Allahabad. The attempt<br \/>\nfailed. A  fresh application was made in April, 1975. It was<br \/>\nallowed by  the Prescribed Authority on 24th May, 1976 after<br \/>\noverruling  an\t objection  filed   by\tthe  appellant.\t The<br \/>\nappellant appealed  and the appellate authority by its order<br \/>\ndated 25th  March, 1977 modified the order of the Prescribed<br \/>\nAuthority inasmuch  as a  portion only\tof the\tbuilding was<br \/>\nreleased in favour of the third respondent and the appellant<br \/>\nwas permitted  to continue in the remaining portion, and the<br \/>\nPrescribed Authority  was directed  to divide  the  bungalow<br \/>\naccordingly. The appellant filed a writ petition in the High<br \/>\nCourt against  the order of the Appellate Authority, but the<br \/>\nwrit  petition\twas  dismissed.\t Against  its  dismissal  he<br \/>\napplied in this Court for special leave to appeal and on 3rd<br \/>\nJanuary, 1978, that petition was also dismissed.\n<\/p>\n<p>     To give  effect  to  the  direction  of  the  Appellate<br \/>\nAuthority,  the\t Prescribed  Authority\tmeanwhile  initiated<br \/>\nproceedings for demar-\n<\/p>\n<p><span class=\"hidden_text\">79<\/span><\/p>\n<p>cation of  the premises and a partition scheme was prepared.<br \/>\nDuring the  preparation of  the partition  scheme, Raj Kumar<br \/>\nSinha,\tthe   third  respondent&#8217;s   father,  died.  On\t22nd<br \/>\nSeptember, 1978,  the appellant\t filed an application before<br \/>\nthe Prescribed\tAuthority bringing the fact of this death to<br \/>\nits notice  and praying that the partition scheme should not<br \/>\nbe  prepared.\tThe  Prescribed\t  Authority   rejected\t the<br \/>\napplication. Appeal  by the  appellant was  dismissed by the<br \/>\nAppellate Authority  on the ground that the order dated 25th<br \/>\nMarch, 1977  directing a division of the premises had become<br \/>\nfinal and  the\tcontroversy  could  not\t be  re-opened.\t The<br \/>\nappellant then\tfiled a writ petition before the High Court,<br \/>\nand the\t High Court  has maintained  the view  taken by\t the<br \/>\nAppellate Authority  and dismissed  the writ petition by its<br \/>\njudgment dated 25th November, 1978.\n<\/p>\n<p>     We are  of\t opinion  that\tthe  High  Court  is  right.<br \/>\nPlainly, the  order dated  25th March, 1977 of the Appellate<br \/>\nAuthority releasing  a portion\tof the premises in favour of<br \/>\nthe third  respondent and  leaving the\tremaining portion in<br \/>\nthe tenancy  of the  appellant acquired\t finality  when\t the<br \/>\nproceeding taken  against it  by the  appellant failed.\t The<br \/>\norder having  become final,  the  Prescribed  Authority\t was<br \/>\nbound to  give effect  to it.  In doing\t so, the  Prescribed<br \/>\nAuthority  was\t not  acting  outside  its  jurisdiction  or<br \/>\ncontrary to  law. The  application moved  by  the  appellant<br \/>\nbefore the  Prescribed Authority  requesting it to take into<br \/>\naccount the  death of  Raj  Kumar  Sinha  was  misconceived,<br \/>\nbecause it  did not  lie with  the Prescribed  Authority  to<br \/>\nreopen proceedings which had been taken to the highest Court<br \/>\nand had become final. It is true that subsequent events must<br \/>\nbe taken into account by a statutory authority or court when<br \/>\nconsidering proceedings\t arising out  of landlord&#8217;s petition<br \/>\nfor ejectment  of a  tenant on\tthe ground of the landlord&#8217;s<br \/>\npersonal need.\tBut in\tthe  present  case,  the  order\t for<br \/>\nrelease of  a portion of the accommodation required finality<br \/>\nbefore the  death of  Raj Kumar\t Sinha and  the\t controversy<br \/>\nconcluded by it could not be reopened,<br \/>\n     The appellant  has\t vehemently  urged  that  being\t the<br \/>\nhighest court  of the  land it\tis open\t to us to reopen the<br \/>\nproceeding for release initiated by the third respondent. We<br \/>\ndo not\tthink we  can. The  present appeal is limited to the<br \/>\nquestion which\tarose before the Prescribed Authority on the<br \/>\napplication of\tthe  appellant\tafter  the  proceedings\t for<br \/>\nrelease had acquired finality and we must be confined to the<br \/>\nconsideration of  that question alone. We cannot reopen that<br \/>\nwhich has  become  final  after\t this  court  dismissed\t the<br \/>\nspecial leave  petition of  the appellant.  We may point out<br \/>\nthat we have been referred to s. 24 of the U.P. Urban<br \/>\n<span class=\"hidden_text\">80<\/span><br \/>\nBuilding Act,  1972 in\tsupport of  the contention  that the<br \/>\nPrescribed  Authority\tretains\t  control   over   ejectment<br \/>\nproceedings, but we are not impressed by that contention.\n<\/p>\n<p>     The appeal fails and is dismissed with costs.\n<\/p>\n<pre>S.
