Judgment.\n<\/p>\n
            This common judgment will dispose of present Criminal<\/p>\n
Misc. as well as Criminal Misc.M-13657 of 2008 as both the cases<\/p>\n
have arisen out of same facts and relief claimed is also the same.<\/p>\n
Facts have, however, been extracted from the instant petition.<\/p>\n
            In this petition, the petitioner seeks quashing of FIR
\n            Criminal Misc. No. M-5675 of 2008.\n<\/p>\n
                 -2-<\/span><\/p>\n
No.305 dated 6.11.2007, under Sections 420\/269\/270\/271 IPC,<\/p>\n
Police Station City Samana, District Patiala.<\/p>\n
           As per allegations, on 6.11.2007, ASI Bhagwan Dass of<\/p>\n
Police Station City Samana and HC Viney Kumar, No.2208, HC<\/p>\n
Kuldip Singh, No.2728, CD Jaspal Singh No.1079, Constable<\/p>\n
Chamkaur Singh No.497, Constable Balkar Singh No. 2018          were<\/p>\n
travelling in Government vehicle bearing No.PB11-Y-8104 which<\/p>\n
was being driven by OC Shamsher Singh No.849 and were present<\/p>\n
at old Bus Stand for the purpose of March and Checking. Then,<\/p>\n
special informer informed that Shiv Kumar son of Shri Ram Lal,<\/p>\n
caste Aggarwal, resident of Garh Mohalla, Samana who was<\/p>\n
running a shop by the name of Ashwani Refreshment at Chakla<\/p>\n
Bazar, Samana supplied fake Paneer to the public at his shop.<\/p>\n
Because of eating fake Paneer, one can fall sick or dangerous<\/p>\n
disease can spread. His action disclosed offences punishable under<\/p>\n
Sections 420, 269, 270 and 271 IPC. Smt. Usha Dhingra, C.M.O,<\/p>\n
Patiala was requested for sending Food Inspector at the spot. ASI<\/p>\n
Bhagwan Dass sent ruqqa through Constable No.2018 to the Police<\/p>\n
Station for getting a case registered. On the basis of said facts, FIR<\/p>\n
No.305 dated 6.11.2007 under Sections 420\/269\/270\/271 IPC was<\/p>\n
registered at Police Station, City Samana.\n<\/p>\n
            Criminal Misc. No. M-5675 of 2008.\n<\/p>\n
                 -3-<\/span><\/p>\n
          The petitioner filed the present petition for quashing the<\/p>\n
said FIR on the grounds that the allegations against the petitioner<\/p>\n
fall within the ambit of Food Adulteration Act, 1954. It is further<\/p>\n
pleaded that under Section 20 of the said Act, no prosecution can<\/p>\n
be launched without the written consent of the Central Government<\/p>\n
or the State Government or a person authorized by the Government<\/p>\n
in this behalf by general or special order by the Central<\/p>\n
Government or the State Government. It is further pleaded that the<\/p>\n
sample sent for analysis contained 25.32% milk fat of dry matter<\/p>\n
against minimum prescribed standard of 50%. The Paneer<\/p>\n
recovered from the accused at the most can be said to be<\/p>\n
adulterated. So, action can be taken only under the Prevention of<\/p>\n
Food Adulteration Act and FIR under Sections 420, 269, 270 and<\/p>\n
271 IPC cannot be proceeded with. A prayer has been made for<\/p>\n
quashing the said FIR.\n<\/p>\n
          Regarding the same occurrence, complaint No.59 dated<\/p>\n
3.5.2008, under Section 16 of Prevention of Food Adulteration<\/p>\n
Act, 1954 has been filed by the Food Inspector against the accused.<\/p>\n
          Another petition (Criminal Misc.No.M-13657 of 2008 )<\/p>\n
has been filed for quashing the said complaint, Annexure P-1. The<\/p>\n
quashing of the said complaint has been sought on the following
\n             Criminal Misc. No. M-5675 of 2008.\n<\/p>\n
                  -4-<\/span><\/p>\n
grounds:-\n<\/p>\n
            (i) That the petitioner applied for anticipatory bail, in<\/p>\n
            this case, before the learned Sessions Judge, Patiala<\/p>\n
            when the above-said FIR was registered against him and<\/p>\n
            while allowing the same, the learned             learned<\/p>\n
            Additional Sessions Judge, Patiala, in its order dated<\/p>\n
            1.12.2007 has observed that milk fat was found to be<\/p>\n
            less than the minimum prescribed standard and it was<\/p>\n
            not a case of fake Paneer. The learned Court further<\/p>\n
            observed that it is a case of Food Adulteration Act for<\/p>\n
            which complaint lies at the behest of Food Inspector.<\/p>\n
            The offences under IPC are not made out.\n<\/p><\/blockquote>\n
            (ii)That Hon’ble Karnatka High Court in State of<\/p>\n
              Karnatka Versus Shetty Ice Cream Company,<\/p>\n
              Kulai, Mangalore and others has observed that time<\/p>\n
              is belatedly ripe to have re-look at the standards<\/p>\n
              prescribed defining as adulteration with regard to the<\/p>\n
              edibles,unless the product sold is a health hazard.<\/p><\/blockquote>\n
              Merely because it does not conform to the standards<\/p>\n
              of best quality, the proprietors and manufacturers<\/p>\n
              should not be subjected to unnecessary harassment of
\n Criminal Misc. No. M-5675 of 2008.\n<\/p>\n

  prosecution and punishment. There is a change in the<\/p>\n
  mindset of the people to go for food items with less or<\/p>\n
  no fat content. The fat content prescribed for Ice<\/p>\n
  Cream under the Prevention of Food Adulteration Act<\/p>\n
  is too high and may not be desirable diet in the<\/p>\n
  modern times. The second quality Ice Cream with<\/p>\n
  lesser fat content would be advisable medically than<\/p>\n
  an Ice Cream with rich fat content. In the present case<\/p>\n
  also fat content was found to be less in the Paneer and<\/p>\n
  the ratio of the above mentioned case applies in this<\/p>\n
  case also. In the complaint (P-1) in Para 12, it is<\/p>\n
  mentioned that the milk fat contained in the Paneer<\/p>\n
  was 25.32% against the minimum prescribed standard<\/p>\n
  of 50.0% and the contents of the sample are therefore<\/p>\n
  adulterated. It may be mentioned here that at best the<\/p>\n
  fat content was less in the Paneer. In the modern<\/p>\n
  times people prefer products with lesser fat content<\/p>\n
  rather than products with more fat contents. Rather in<\/p>\n
  the present case no raid whatsoever was conducted by<\/p>\n
  the respondent. In para No.3 of the complaint (P-1), it<\/p>\n
  is alleged that respondent raided the shop of the
\n Criminal Misc. No. M-5675 of 2008.\n<\/p>\n
      -6-<\/span><\/p>\n
  petitioner on the complaint of the police to local<\/p>\n
  health authorities. Whereas version of the FIR is that<\/p>\n
  the raid was conducted by the police and the CMO<\/p>\n
  had been informed about the same. It shows that the<\/p>\n
  present complaint (P-1) is false one and has been<\/p>\n
  instituted only when the respondent felt that it was<\/p>\n
  not going to succeed in the present case. In this view<\/p>\n
  of the matter, complaint (P-1) and summoning order<\/p>\n
  (P-3) deserve to be quashed.\n<\/p>\n
(iii)That the Hon’ble Delhi High Court in State (Delhi<\/p>\n
  Admn.) Versus Naresh Chand and others, has held<\/p>\n
  that faulty procedure of taking sample, loss of fat,<\/p>\n
  once loss of fat takes place due to faulty procedure of<\/p>\n
  taking samples, the shop-keeper cannot be convicted.<\/p>\n
  In the present case, what to talk of faulty procedure of<\/p>\n
  taking sample, no sample whatsoever was taken at the<\/p>\n
  time of seizure of alleged fake Paneer. For this reason<\/p>\n
  also, the present complaint and summoning order<\/p>\n
  deserve to be quashed.\n<\/p>\n
(iv)That Hon’ble Patna High Court in Satish Mishra<\/p>\n
  Versus State of Bihar and others, has held that
\n Criminal Misc. No. M-5675 of 2008.\n<\/p>\n
      -7-<\/span><\/p>\n
  Prevention of Food Adulteration Act, 1954, is special<\/p>\n
  statute, is code in itself, by adding sections of IPC,<\/p>\n
  police cannot make out its own case. It has its own set<\/p>\n
  of authorities, which are authorized to conduct<\/p>\n
  investigation,       search,       seizure   and\/or   launch<\/p>\n
  prosecution in respect thereof including enquiry into<\/p>\n
  the matter. If police alleges that the provision of<\/p>\n
  Prevention of Food Adulteration Act is violated then<\/p>\n
  it was the authority of the Food Inspector alone and<\/p>\n
  not the police officer to inspect or seize. So far as the<\/p>\n
  offences alleged under IPC are concerned, none is<\/p>\n
  made out on the facts of the case. The present<\/p>\n
  prosecution as initiated on the basis of the FIR<\/p>\n
  aforesaid and all subsequent acts thereunder are held<\/p>\n
  to be wholly without jurisdiction and are quashed.<\/p>\n
(v)That para No.3 of the complaint (P-1) says that 150<\/p>\n
  kg. Paneer was seized from the shop of the petitioner.<\/p>\n
  Whereas the Act says that the Food Inspector has to<\/p>\n
  purchase the product from the person concerned and<\/p>\n
  there is no question of seizing of the whole Paneer.<\/p>\n
  This shows that complaint (P-1) is false.”\n<\/p>\n
            Criminal Misc. No. M-5675 of 2008.\n<\/p>\n

           Both the petitions have been resisted by the State of<\/p>\n
Punjab.\n<\/p>\n
           I have heard both sides and have gone through the<\/p>\n
record of the case.\n<\/p>\n
           So far as the facts of the case are concerned, the same<\/p>\n
are not in dispute. A raid was conducted at the shop of<\/p>\n
accused\/revisionist. The Food Inspector visited the shop and had<\/p>\n
taken into possession Paneer. Sample of the said Paneer was sent<\/p>\n
for analysis and the same contained 25.32% milk fat of dry matter<\/p>\n
against minimum prescribed standard of 50% and, on that count,<\/p>\n
the Paneer is stated to be adulterated.\n<\/p>\n
           So far as the fact that Paneer is fake one, there is no<\/p>\n
report to this effect on the file. The Patna High Court in the<\/p>\n
authority in case Satish Mishra Versus State of Bihar and<\/p>\n
others, 2007(1) FAC 393 has held that when there is a special<\/p>\n
statute under the Prevention of Food Adulteration Act, 1954 then<\/p>\n
by adding sections of IPC, FIR cannot be launched. Keeping in<\/p>\n
view the fact that Paneer was not found to be fake but was found<\/p>\n
to be not conforming to the prescribed standard, the proceedings<\/p>\n
under the Criminal Act cannot continue. So, FIR No.305 dated<\/p>\n
6.11.2007 under Sections 420\/269\/270\/271 IPC, Police Station,
\n             Criminal Misc. No. M-5675 of 2008.\n<\/p>\n
                  -9-<\/span><\/p>\n
City Samana and further proceedings arising therefrom stand<\/p>\n
quashed.\n<\/p>\n
           So far as complaint No.59 dated 3.5.2008 is concerned,<\/p>\n
the case of the revisionist himself is that the prosecution can<\/p>\n
proceed under the Prevention of Food Adulteration Act. No case<\/p>\n
for quashing the complaint under the said Act is made out. The<\/p>\n
observations made by the learned Additional Sessions Judge while<\/p>\n
deciding the bail application are also to the effect that proceedings<\/p>\n
under the Food Adulteration Act can be initiated. So, in these<\/p>\n
circumstances, the petitioner who has himself taken a stand that<\/p>\n
proceedings under the Food Adulteration Act can only be initiated<\/p>\n
could not seek quashing of proceedings under the Act. Authority in<\/p>\n
case Karnatka Versus Shetty Ice Cream Company (supra) is not<\/p>\n
helpful at this stage of trial. In that ruling, it has been observed that<\/p>\n
time is ripe to have re-look at the standards keeping in view the<\/p>\n
requirement of people but since there is no change in the<\/p>\n
provisions of the Act and unless and until the said Act is amended,<\/p>\n
the said Act has to be implemented in letter and spirit.<\/p>\n
           Authority in case Naresh Chand (supra) is not helpful<\/p>\n
to the accused. Whether the sample was taken by the Food<\/p>\n
Inspector is a matter of evidence. Prima-facie, there is nothing on
\n             Criminal Misc. No. M-5675 of 2008.\n<\/p>\n
                  -10-<\/span><\/p>\n
the file that the sample was not taken in accordance with the<\/p>\n
provisions of the Act.\n<\/p>\n
            So far as submission made by the counsel for the<\/p>\n
petitioner to the effect that sample has to be purchased from the<\/p>\n
petitioner and, on that count, proceedings cannot continue is<\/p>\n
concerned, the same is without any substance. The said matter can<\/p>\n
also be appreciated during the course of trial.<\/p>\n
            So, keeping in view the totality of circumstances,<\/p>\n
petition for quashing complaint No.59 dated 3.5.2008 stands<\/p>\n
declined.\n<\/p>\n
            It is, however, made clear that anything said above shall<\/p>\n
not be taken as an expression of opinion on the merits of the case,<\/p>\n
so far as complaint under the Prevention of Food Adulteration Act<\/p>\n
is concerned.\n<\/p>\n
            A copy of this judment be sent to the learned trial Court<\/p>\n
for strict compliance.<\/p>\n
