KRISHNAN, J.\n                   ...........................................\n                    M.A.C.A.NO.106 OF 2010\n                  .............................................\n          Dated this the 22nd day of December, 2010.\n\n                         J U D G M E N T\n<\/pre>\n<p>      This is an appeal preferred against the award of the<\/p>\n<p>Claims Tribunal, Pathanamthitta in OP(MV)No.1384\/2002.<\/p>\n<p>The point that arises for determination in the appeal is<\/p>\n<p>regarding liability of the insurance company. The claimant,<\/p>\n<p>a pillion rider, sustained injuries in a road accident and the<\/p>\n<p>Tribunal has awarded him a compensation of Rs.75,650\/=<\/p>\n<p>and directed the insurance company to pay the amount. It is<\/p>\n<p>against that decision, the insurance company has come up in<\/p>\n<p>appeal.\n<\/p>\n<p>      2. The contention of the insurance company is to the<\/p>\n<p>effect that the vehicle is covered only by an act only policy<\/p>\n<p>and additional premium of ` 63\/= has been collected for<\/p>\n<p>personal accident coverage of two persons in accordance<\/p>\n<p>with the endorsement IT 64.\n<\/p>\n<p>       3. The learned counsel for the respondents would<\/p>\n<p>contend before me that since additional premium is received,<\/p>\n<p>it covers the risk of the pillion rider and so there is nothing<\/p>\n<p><span class=\"hidden_text\">                              : 2 :<\/span><br \/>\nM.A.C.A.NO.106 OF 2010<\/p>\n<p>to interfere with the decision of the Tribunal.<\/p>\n<p>      4. The law is fairly well settled on the question of act<\/p>\n<p>only policy. By virtue of the authoritative pronouncement of<\/p>\n<p>the Supreme Court in <a href=\"\/doc\/423517\/\">United India Insurance Co. Ltd. v.<\/p>\n<p>Tilak Singh<\/a> [2006 (2) KLT 884] status of the pillion rider is<\/p>\n<p>that of a gratuitous passenger not covered by the policy and<\/p>\n<p>therefore he is not liable to be indemnified by the insurance<\/p>\n<p>company. In the case of package policies, Insurance<\/p>\n<p>Regulatory and Development Authority issued a clarificatory<\/p>\n<p>circular   dated 16.11.2009 wherein       after analysing the<\/p>\n<p>condition it was    clarified that the person carried in two<\/p>\n<p>wheelers and the persons travelling in private vehicles are<\/p>\n<p>covered under the terms and conditions of the standard motor<\/p>\n<p>package policy. So if the vehicle is covered by a package<\/p>\n<p>policy, then no additional premium is necessary. In the light<\/p>\n<p>of Tilak Singh&#8217;s case in order to have coverage to a pillion<\/p>\n<p>rider unless additional premium is paid, insurance company<\/p>\n<p>cannot be saddled with the liability.\n<\/p>\n<p>      5. Here is a case where the insurance company       has<\/p>\n<p>taken a sum of ` 63\/= as personal accident coverage for two<\/p>\n<p><span class=\"hidden_text\">                              : 3 :<\/span><br \/>\nM.A.C.A.NO.106 OF 2010<\/p>\n<p>persons   and it   can also be seen that it is    done under<\/p>\n<p>endorsements. It is contended that in order to attract the<\/p>\n<p>endorsement in the policy, either there must be death or<\/p>\n<p>100% disability for the person. So the contract of insurance<\/p>\n<p>envisages a specific situation for the coverage of    personal<\/p>\n<p>accidents. I am not going deep in to that reason as these<\/p>\n<p>conditions are not produced before the Tribunal.        Parties<\/p>\n<p>are to be given an opportunity to explain or challenge the<\/p>\n<p>correctness of the same.\n<\/p>\n<p>      6. So without expressing anything       on  merit   with<\/p>\n<p>respect to the same, I send back the case to the Tribunal<\/p>\n<p>with a direction to the insurance company to produce the<\/p>\n<p>conditions on which they rely for non liability and also permit<\/p>\n<p>the other parties to adduce evidence in support of their<\/p>\n<p>respective contentions and let the matter be disposed of     in<\/p>\n<p>accordance with law. The claimant has entered appearance<\/p>\n<p>before the court, so junction of the owner is absolutely<\/p>\n<p>necessary. Therefore the insurance company is directed to<\/p>\n<p>take out notice to the owner as well so as to have a full<\/p>\n<p>fledged trial and dispose of the matter in accordance with<\/p>\n<p><span class=\"hidden_text\">                              : 4 :<\/span><br \/>\nM.A.C.A.NO.106 OF 2010<\/p>\n<p>law.   I make it clear that the question of quantum cannot be<\/p>\n<p>re-agitaged and it has reached conclusiveness. Parties are<\/p>\n<p>directed to appear before the Tribunal on 28.1.2011.<\/p>\n<p>     Disposed of accordingly.\n<\/p>\n<\/p>\n<p>                                   M.N.
