Justice K.T.SANKARAN\n\n Dated :05\/01\/2009\n\n O R D E R\n                              K.T.SANKARAN, J.\n                 ------------------------------------------------------\n                        W.P.(C) NO. 310 OF 2009 J\n                 ------------------------------------------------------\n                    Dated this the 5th January, 2009\n\n\n                                   JUDGMENT\n<\/pre>\n<p>       The reliefs prayed for in the Writ Petition are the following:<\/p>\n<p>       &#8220;(i)  to call for the records relating to Exhibit P8 order of<br \/>\n             the 1st respondent and to quash the same to the<br \/>\n             extend it adversely affects him by the issuance of a<br \/>\n             writ of certiorari or other appropriate writ, direction or<br \/>\n             order;\n<\/p>\n<p>       (ii)  to issue a writ of mandamus or other appropriate<br \/>\n             writ direction or order directing the respondents 1 to<br \/>\n             3 to fix the pay of the petitioner, in terms of Exhibits<br \/>\n             P3, P9, P9(a) and P10 orders and grant him all<br \/>\n             consequential benefits including arrears of pay and<br \/>\n             other allowances;\n<\/p>\n<p>       (iii) to issue a writ of mandamus or other appropriate<br \/>\n             writ, direction or order directing the respondents to<br \/>\n             fix the pay of the petitioner in the category of<br \/>\n             Principal     (Professor       Grade)       with     effect from<br \/>\n             6.10.1998 and to pay him all consequential benefits<br \/>\n             including arrears of pay and other allowances from<br \/>\n             6.10.1998 to 25.3.2004;\n<\/p>\n<p>       (iv)  to issue such other writ, direction or order as this<br \/>\n             Honourable Court deems just and proper.&#8221;<\/p>\n<p>       2. Learned Government Pleader as well as Sri.A.N.Rajan Babu,<\/p>\n<p>learned counsel appearing for the third respondent, submitted that the<\/p>\n<p>petitioner can very well challenge Ext.P8 order in a representation before<\/p>\n<p>the Government.\n<\/p>\n<p>W.P.(C) NO. 310 OF 2009<\/p>\n<p>                                       :: 2 ::\n<\/p>\n<\/p>\n<p>       3. In the facts and circumstances of the case, it may not be proper<\/p>\n<p>for this Court to consider all the questions involved in the Writ Petition and<\/p>\n<p>it is only proper if the petitioner challenges Ext.P8 order before the<\/p>\n<p>Government. It is submitted by the learned Government Pleader that if a<\/p>\n<p>representation is filed by the petitioner challenging Ext.P8 order within a<\/p>\n<p>period of one month, the Government will consider the same without<\/p>\n<p>much delay.
