RAVIKUMAR, J\n           - - - - - - - - - - - - -- - - - - - - - - - - - - - - -\n                   W.P.(C)No. 22812 OF 2010\n           - - - - - - - - - - - - - - - - - - - - - - - - - - - -\n\n          Dated this the 28th day of October, 2010\n\n\n                           J U D G M E N T\n<\/pre>\n<p>            This writ petition has been filed mainly seeking a<\/p>\n<p>prayer for issuance of a writ of mandamus commanding the<\/p>\n<p>first respondent to refer the Industrial Dispute between the<\/p>\n<p>petitioner and the 4th respondent             to the Labour Court for<\/p>\n<p>adjudication forthwith. The contention of the petitioner is that<\/p>\n<p>she was appointed as a sweeper as per Ext.P1 under the 4th<\/p>\n<p>respondent. While so, on 2.3.2005 Ext.P3 charge sheet was<\/p>\n<p>served on her. Pursuant to the same she had submitted Ext.P4<\/p>\n<p>written statement refuting the charges levelled against her.<\/p>\n<p>Dissatisfied with the reply submitted by the petitioner, a<\/p>\n<p>domestic enquiry was conducted.                 On culmination of the<\/p>\n<p>domestic enquiry the petitioner was dismissed from service as<\/p>\n<p>per Ext.P7. After the dismissal the petitioner has submitted<\/p>\n<p>Ext.P8    representation         before     the     second       respondent<\/p>\n<p>requesting him to conciliate on the matter and in case of its<\/p>\n<p>failure, to submit failure report to enable the first respondent<\/p>\n<p>to refer the matter in accordance with the provisions of the<\/p>\n<p>WPC.No.22812\/2010<br \/>\n<span class=\"hidden_text\">                              : 2 :<\/span><\/p>\n<p>Industrial Disputes Act for adjudication. Pursuant to Ext.P8<\/p>\n<p>the 3rd respondent afforded her an opportunity of being heard<\/p>\n<p>on 26.6.2010. Subsequently, Ext.P10 notice was issued by the<\/p>\n<p>second respondent. The grievance of the petitioner is that so<\/p>\n<p>far the second respondent had not taken any step to finalise<\/p>\n<p>the proceedings based on Ext.P8 representation and in case of<\/p>\n<p>failure to bring about a settlement to file a failure report in<\/p>\n<p>terms of section 10(C) of the Industrial Dispute Act 1947 to<\/p>\n<p>enable the first respondent to consider the issue whether the<\/p>\n<p>matter should be referred for adjudication.<\/p>\n<p>      2. I have heard the learned counsel for the petitioner<\/p>\n<p>and also the learned Government Pleader.           The learned<\/p>\n<p>Government Pleader submitted that all concerned parties<\/p>\n<p>were called for a conciliation conference in the year 2006<\/p>\n<p>pursuant to Ext.P10. Thereupon, they had submitted that they<\/p>\n<p>would settle the matter by negotiating in between them.<\/p>\n<p>Thereafter, none approached the second respondent to make<\/p>\n<p>further conciliation in the matter. It was in the absence of any<\/p>\n<p>such further information that the matter got delayed. The<\/p>\n<p>learned counsel for the petitioner submitted that after the<\/p>\n<p>WPC.No.22812\/2010<br \/>\n<span class=\"hidden_text\">                               : 3 :<\/span><\/p>\n<p>institution of this writ petition, the second respondent has<\/p>\n<p>issued a notice calling the petitioner to attend a conciliation<\/p>\n<p>conference.     Taking into account the said subsequent<\/p>\n<p>developments this writ petition is disposed of as hereunder:<\/p>\n<p>      The second respondent shall convene conciliation<\/p>\n<p>conference\/conferences after issuing notice for that behalf to<\/p>\n<p>all parties concerned.     In case of failure to bring about<\/p>\n<p>settlement   in the     conciliation conference, the second<\/p>\n<p>respondent shall submit a failure report in terms of section 10<\/p>\n<p>(C)of the ID Act to enable the first respondent to consider the<\/p>\n<p>question whether it should be referred to the Labour Court for<\/p>\n<p>adjudication, expeditiously, at any rate, within a period of six<\/p>\n<p>weeks from the date of receipt of a copy of this judgment.<\/p>\n<p>                                          Sd\/-\n<\/p>\n<p>                                   (C.T.
