Justice M.SASIDHARAN NAMBIAR\n\n Dated :25\/02\/2010\n\n O R D E R\n           M.SASIDHARAN NAMBIAR,J.\n\n            ------------------------------------------\n             W.P.C.NO.4856 OF 2010\n            ------------------------------------------\n            Dated 25th February 2010\n\n\n                         JUDGMENT\n<\/pre>\n<p>          Challenging the order passed under<\/p>\n<p>Section 138 of Code of Criminal Procedure<\/p>\n<p>Crl.R.P.135\/2007 was filed before Additional<\/p>\n<p>Sessions court, Thiruvananthapuram. By Ext.P4<\/p>\n<p>order dated 22\/6\/2009, learned Sessions Judge<\/p>\n<p>allowed  the     revision              and         directed   Sub<\/p>\n<p>Divisional Magistrate, Thiruvananthapuram to<\/p>\n<p>dispose M.C.62\/2006, after setting aside the<\/p>\n<p>impugned order passed on 17\/11\/2007, under<\/p>\n<p>Section 138 of Code of Criminal Procedure, in<\/p>\n<p>accordance  with         law        after           affording  an<\/p>\n<p>opportunity to the parties to adduce evidence<\/p>\n<p>following  the        procedure                provided     under<\/p>\n<p>Sections 133 to 143 of Code of Criminal<\/p>\n<p>Procedure. This petition is filed                           under<\/p>\n<p>Wpc 4856\/10<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>Section 227 of Constitution of India for a<\/p>\n<p>direction     to  the  first  respondent Sub<\/p>\n<p>Divisional     Magistrate, Thiruvananthapuram<\/p>\n<p>to dispose of M.C.62\/2006 as directed in<\/p>\n<p>Ext.P4 judgment contending that final order<\/p>\n<p>is not     passed.\n<\/p>\n<p>           2. Learned counsel appearing for<\/p>\n<p>the     petitioner   and  learned  Government<\/p>\n<p>Pleader     were heard.\n<\/p>\n<p>           3. Learned    Government   Pleader<\/p>\n<p>submitted that the case now stands posted<\/p>\n<p>to 1\/3\/2010 and final order will be passed<\/p>\n<p>within     three  months.
