Justice K.T.SANKARAN\n\n Dated :06\/10\/2010\n\n O R D E R\n                 K.T.SANKARAN, J.\n          ------------------------------\n             W.P.(C).No.22108  OF 2010\n          ------------------------------\n      Dated this the 6th day of October, 2010\n\n\n                     JUDGMENT\n<\/pre>\n<p>    The case of the petitioner is that      she was<\/p>\n<p>appointed as LPSA with effect from 25.7.2007 in an<\/p>\n<p>additional division post. The appointment of the<\/p>\n<p>petitioner was not approved on the ground that<\/p>\n<p>there was a ban imposed by the Government for<\/p>\n<p>sanctioning additional division.  It is stated that<\/p>\n<p>the Manager filed Ext.P2 appeal before the District<\/p>\n<p>Educational Officer and the same is pending. While<\/p>\n<p>so, it is stated, the Manager appointed respondents<\/p>\n<p>4 and 5, Sharanya M. Nair and Shameer, as LPSA in<\/p>\n<p>the school.   The contention of the petitioner is<\/p>\n<p>that without recognizing the appointment of the<\/p>\n<p>petitioner, the Manager should not have appointed<\/p>\n<p>respondents 5 and 6.   It is also stated that the<\/p>\n<p>appointments of respondents 5 and 6 have not been<\/p>\n<p>approved.  The petitioner was not allowed to sign<\/p>\n<p>in the attendance register by the Headmistress.<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.22108 OF 2010     2<\/span><\/p>\n<p>    2. The reliefs prayed for by the petitioner in<\/p>\n<p>the Writ Petition are the following:<\/p>\n<blockquote><p>     &#8220;a.  Issue   a  writ  of  mandamus  or  any   other<br \/>\n         appropriate writ order or direction directing<br \/>\n         the   4th  respondent  to   execute  the   bond<br \/>\n         stipulated in Ext.P6 and further direct to<br \/>\n         resubmit the proposal before the 3rd respondent<br \/>\n         and the 3rd respondent may be directed to<br \/>\n         approve the appointment of the petitioner with<br \/>\n         effect    from  25.7.2007   onwards  with   all<br \/>\n         consequential benefits. Or<\/p>\n<p>     b.  Issue  a  writ   of  certiorari  or  any  other<br \/>\n         appropriate writ order or direction quashing<br \/>\n         the appointment orders issued in favour of the<br \/>\n         5th &amp; 6th respondents from 1.6.2010 onwards and<br \/>\n         direct   the  4th  respondent  to  appoint  the<br \/>\n         petitioner in any one of the vacancies and<br \/>\n         forward the proposal for approval before the<br \/>\n         3rd respondent.\n<\/p><\/blockquote>\n<blockquote><p>     c.  Issue such other orders as this Hon&#8217;ble Court<br \/>\n         may deem fit to grant.&#8221;\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>    3. It is submitted that GO(P) No.10\/10\/G.Edn.<\/p>\n<\/blockquote>\n<p>dated 12.1.2010 issued by the Government is under<\/p>\n<p>challenge in a batch of Writ Petitions.          Therefore,<\/p>\n<p>at this stage, a writ of mandamus cannot be issued<\/p>\n<p>directing    the   Manager    to   execute   the   bond  as<\/p>\n<p>provided in GO(P) No.10\/10.\n<\/p>\n<\/p>\n<p>    4.    Learned    counsel    for   the   5th  respondent<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.22108 OF 2010  3<\/span><\/p>\n<p>submitted that appointment of the 5th respondent is<\/p>\n<p>legal and valid.\n<\/p>\n<\/p>\n<p>    5. Since Ext.P2 appeal is pending before the<\/p>\n<p>District Educational     Officer,  Tirur. The  learned<\/p>\n<p>counsel for the petitioner submitted that for the<\/p>\n<p>time being, the petitioner would be satisfied, if<\/p>\n<p>the District Educational      Officer  is directed  to<\/p>\n<p>dispose   of   Ext.P2   appeal.  The  petitioner  also<\/p>\n<p>submits that an opportunity may be afforded to make<\/p>\n<p>representation    before   the   District  Educational<\/p>\n<p>Officer. The request is just and reasonable.<\/p>\n<p>    In the facts and circumstances of the case, the<\/p>\n<p>Writ Petition is disposed of as follows:<\/p>\n<blockquote><p>     a)   The District Educational Officer shall<\/p>\n<p>          dispose of Ext.P2 appeal filed by the<\/p>\n<p>          Manager, as expeditiously as possible<\/p>\n<p>          and at any rate within a period of two<\/p>\n<p>          months from the date of receipt of a<\/p>\n<p>          copy of this judgment, after affording<\/p>\n<p><span class=\"hidden_text\">W.P.(C).No.22108 OF 2010   4<\/span><\/p>\n<p>          an opportunity of being heard to the<\/p>\n<p>          petitioner, the Manager and respondents<\/p>\n<p>          5 and 6.\n<\/p><\/blockquote>\n<blockquote>\n<\/blockquote>\n<blockquote><p>     b)   The petitioner shall produce a copy of<\/p>\n<p>          the Writ Petition and copy of Ext.P7<\/p>\n<p>          which    was    produced   along    with<\/p>\n<p>          I.A.No.10028    of  2010,   before   the<\/p>\n<p>          District    Educational   Officer.
