SHAH\n\t\t\n\t\n\n \n\nDate\n: 08\/04\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\t\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, the petitioners have prayed for an appropriate writ, order<br \/>\nand\/or direction, quashing and setting aside the order dated<br \/>\n29\/09\/2010 passed by Gujarat Revenue Tribunal, Ahmedabad in Revision<br \/>\nApplication No. TEN\/BS\/49\/2000, by which, Gujarat Revenue Tribunal,<br \/>\nAhmedabad has dismissed the said Revision Application preferred by<br \/>\nthe petitioners confirming the order dated 29\/06\/2000 passed by the<br \/>\nDeputy Collector, Valsad in Tenancy Appeal No.56\/1999.\n<\/p>\n<p>2.\t\tIt<br \/>\nappears that there were two different proceedings initiated by the<br \/>\npetitioners u\/s.70-B of the Bombay Tenancy Act. It appears that the<br \/>\nproceedings u\/s.70-B of the Bombay Tenancy Act were with respect to 5<br \/>\nGunthas of land out of land bearing Survey No.105\/2 situated at<br \/>\nVillage: Ashura, Taluka: Dharampur, District: Valsad and another<br \/>\nproceedings u\/s.70-B were initiated with respect to land bearing<br \/>\nSurvey No.105\/2, Block No.153 admeasuring 2 Hector 12 RA and 46 PRA<br \/>\nof the land.\n<\/p>\n<p>\t\tIt<br \/>\nappears that land with respect to 5 Gunthas out of land bearing<br \/>\nSurvey No.105\/2, which was given to the respective petitioners and an<br \/>\norder was passed u\/s.70-B of the Bombay Tenancy Act and necessary<br \/>\nmutation entry is also made bearing mutation entry No.996, which came<br \/>\nto be certified on 8\/12\/1978. The present proceedings arise out of<br \/>\norder passed by the authorities below with respect to proceedings<br \/>\nu\/s.70-B of the Bombay Tenancy Act with respect to remaining land out<br \/>\nof land bearing Survey No.105\/2, Block No.153, Mamlatdar and ALT,<br \/>\nDharampur  held in favour of the petitioners and declared the<br \/>\npetitioners as tenants with respect to land bearing Survey No.105\/2,<br \/>\nBlock No.153, which came to be set aside by Deputy Collector, Valsad<br \/>\nvide order dated 29\/06\/2000 passed in Tenancy Appeal No.56\/1999,<br \/>\nwhich came to be confirmed by the Gujarat Revenue Tribunal by<br \/>\nimpugned judgement and order.\n<\/p>\n<p>3.\t\tMr.Kinariwala,<br \/>\nlearned advocate appearing on behalf of the petitioners has<br \/>\nvehemently submitted that under the guise of aforesaid two orders<br \/>\npassed by Deputy Collector, Valsad as well as the Tribunal, private<br \/>\nrespondents are likely to disturb the possession of the land bearing<br \/>\nSurvey No.105\/2, for which an order was passed u\/s.70-B of the Bombay<br \/>\nTenancy Act, which were given to the petitioners for huts\/residences<br \/>\nand, therefore, it is requested to consider the same with suitable<br \/>\nobservations.\n<\/p>\n<p>4.\t\tMr.Sanjanwala,<br \/>\nlearned advocate appearing on behalf of the respondent No.7 has<br \/>\nsubmitted that apprehension on the part of the petitioners is not<br \/>\nwell founded. He has under the instruction from Mr.Salim Kusam Shaikh\n<\/p>\n<p>&#8211; son of the respondent No.7, stated at the bar that possession<br \/>\nof the petitioners with respect to 5 Gunthas of land out of land<br \/>\nbearing Survey No.105\/2 for which an order was passed u\/s.70-B of the<br \/>\nBombay Tenancy Act and for which, mutation entry No.996 was made, the<br \/>\npossession of the petitioners shall not be disturbed and private<br \/>\nrespondents shall not claim any right, title and interest in the<br \/>\naforesaid 5 Gunthas of land out of land bearing Survey No.105\/2.\n<\/p>\n<p>5.\t\tIn<br \/>\nview of the above, the present petition is disposed  of by confirming<br \/>\nthe orders passed by both the authorities below and considering the<br \/>\nstatement made by learned advocate appearing on behalf of respondent<br \/>\nNo.7 as recorded hereinabove and it is ordered that private<br \/>\nrespondents herein shall not have any right, title and interest in<br \/>\nthe aforesaid 5 Gunthas of land out of land bearing Survey No.105\/2<br \/>\nsituated at Village: Ashura, Taluka; Dharampur, District: Valsad, for<br \/>\nwhich, an order was passed u\/s.70-B of Bombay Tenancy Act, for which,<br \/>\nthe aforesaid mutation entry No.996 is made and certified on<br \/>\n08\/12\/1976.
