The<br \/>\nsaid order was challenged before the Sessions Court, Godhra in<br \/>\nCriminal Appeal No. 19 of 2006 under Section 394 of the Code of<br \/>\nCriminal Procedure, which had set aside conviction and impugned order<br \/>\nis challenged in present revision.\n<\/p>\n<p>3.\tOn<br \/>\nhaving heard the learned APP and learned advocate Ms. Sneha Joshi and<br \/>\non perusal of the material evidence and judgments of both the Courts<br \/>\nbelow, this Court is of the opinion that for the reasons to be<br \/>\nfollowed hereinafter, present revision application requires<br \/>\ndismissal.\n<\/p>\n<p>3.1\tFirst<br \/>\nand foremost, the learned APP is unable to point any aspect of<br \/>\nillegality or incorrectness in the order of Sessions Court during the<br \/>\nhearing of present revision application.\n<\/p>\n<p>3.2\tA<br \/>\nmere look at the reasons given by the learned Sessions Judge go to<br \/>\nsuggest that for want of requisite evidence, it has not been able to<br \/>\nsustain the order of the learned Magistrate. While discussing in<br \/>\ndetail the order of the learned Magistrate. Learned Sessions Court<br \/>\nhas correctly held that neither the statements of the labourers have<br \/>\nbeen recorded nor the witnesses have been examined to substantiate<br \/>\nthe violation of the provisions of the Minimum Wages Act and<br \/>\ntherefore, it was not feasible to conclude whether the minimum wages<br \/>\nhad been paid to the labourer or not. From the cumulative facts and<br \/>\nevidence before the Court, it came to the conclusion that prosecution<br \/>\nfailed to adduce requisite  proof of the violation of the provision<br \/>\nof Minimum Wages Act and accordingly quashed order of conviction.\n<\/p>\n<p>4.\tFrom<br \/>\nthe submission sand the forgoing discussion, this Court  is of the<br \/>\nopinion that cogent and convincing reasons have                      <\/p>\n<p>                                               been given on the<br \/>\norder of the learned Sessions Judge while  arriving at a just<br \/>\ndecision, which does not call for any interference. Since, it cannot<br \/>\nbe said that the findings arrived at are in any manner perverse or<br \/>\ncontrary to the provisions of the law,this revision is dismissed<br \/>\nupholding the order of the Sessions Court. Amount paid by way of fine<br \/>\nbe refunded to the accused.
