BASANT, J.\n                  - - - - - - - - - - - - - - - - - - - - - -\n                  Crl.M.C.No. 3464 of 2007\n                  - - - - - - - - - - - - - - - - - - - - - -\n           Dated this the 16th day of November, 2007\n\n                               O R D E R\n<\/pre>\n<p>      The petitioner faces indictment in a prosecution for the<\/p>\n<p>offence punishable under Section 420 I.P.C. Investigation is now<\/p>\n<p>complete. Final report has been filed. Sessions case has been<\/p>\n<p>registered. Co-accused have been tried, found not guilty and<\/p>\n<p>acquitted. The petitioner was not available for trial before the<\/p>\n<p>learned Sessions Judge. The case against him has been split up<\/p>\n<p>and later been transferred to the list of long pending cases. The<\/p>\n<p>warrant of arrest issued by the learned Sessions Judge is chasing<\/p>\n<p>the petitioner. It is in these circumstances that the petitioner has<\/p>\n<p>come to this Court with this petition under Section 482 Cr.P.C<\/p>\n<p>      2. According to the petitioner he is absolutely innocent.<\/p>\n<p>His failure\/omission to appear earlier was not wilful, but was due<\/p>\n<p>to reasons beyond his control. He is willing to surrender before<\/p>\n<p>the learned Sessions Judge and seek bail.                But he apprehends<\/p>\n<p>Crl.M.C.No. 3464 of 2007<br \/>\n<span class=\"hidden_text\">                                    2<\/span><\/p>\n<p>that his application for bail may not be considered by the learned<\/p>\n<p>Judge on merits, in accordance with law and expeditiously. In these<\/p>\n<p>circumstances it is prayed that appropriate directions may be issued<\/p>\n<p>to the learned Sessions Judge to release the petitioner on bail on the<\/p>\n<p>date of surrender itself.\n<\/p>\n<p>     3. It is certainly for the petitioner to appear before the learned<\/p>\n<p>Sessions Judge and explain to the learned Judge the circumstances<\/p>\n<p>under which he could not earlier appear before the learned Judge. I<\/p>\n<p>have no reason to assume that the learned Sessions Judge would not<\/p>\n<p>consider the application for bail to be filed by the petitioner when he<\/p>\n<p>surrenders before the learned Judge, on merits, in accordance with law<\/p>\n<p>and expeditiously. Every court must do the same. No special or<\/p>\n<p>specific direction appears to be necessary. Sufficient general directions<\/p>\n<p>have already been issued by this Court in the decision in <a href=\"\/doc\/147290035\/\">Alice George<\/p>\n<p>v. Dy.S.P. of Police<\/a> (2003 (1) KLT 339).\n<\/p>\n<p>     4. This application is accordingly dismissed.       I may however<\/p>\n<p>hasten to observe that if the petitioner appears before the learned<\/p>\n<p>Sessions Judge and applies for bail after giving sufficient prior<\/p>\n<p>Crl.M.C.No. 3464 of 2007<br \/>\n<span class=\"hidden_text\">                                    3<\/span><\/p>\n<p>notice to the Prosecutor in charge of the case,      the learned Judge<\/p>\n<p>must proceed to pass orders on merits, in accordance with law and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself.<\/p>\n<p>                                               (R.
